Know all men by these presents that I William A. Thurman of Chesterfield County and State aforesaid, for and in consideration of the sum of Twelve Hundred dollars to me paid, by Rosanna Gainey, John A. Thurman, Miles P. Thurman, Andrew J. Eddins, Thetus Thurman and Elively Ann Thurman of the State and County aforesaid have granted & sold conveyed and released and by these presents, do grant, sell, convey and release unto the said Rosanna Gainey, John A. Thurman, Miles P. Thurman, Andrew J. Eddins, Thetus Thurman and Elively Ann Thurman. All that certain tract or parcel situate in the County of aforesaid (whereon I now reside) on the waters of Deep Creek and Thompson Creek adjoining the lands of Jerusha Gulledge, Phillip J. Hurst, Henry Haney and others. Containing Two Hundred and ninety-two and a half acres more or less - references to Deeds from Lewis Ganey, Alexander ??{illegible}?, and the lines of John Craig, dec'd, will more fully show. Together with all and singular the rights, members, hereditaments and appurtenances to the said premises belonging or in any wise incident or appertaining: to have and to hold all and, Singular the premises before mentioned unto the said Rosanna Gainey, John A. Thurman, Miles P. Thurman, Andrew J. Eddins, Thetus Thurman and Elively Ann Thurman their heirs and assigns forever. And I do hereby bind myself, my heirs, Executors and Administrators to warrant and forever defend all and Singular the said premises unto the said Rosanna Gainey, John A. Thurman, Miles P. William Aaron Thurman, b. 30 September 1796 married Nancy Copeland. Nancy had passed away on 17 November 1843. This left eight children motherless and to be cared for by their father. 2 3

In this land deed 292 1/2 acres of land owned by William A. Thurman is being sold to his children for $1200.00. His son, William A. Thurman died in June 1864 at Petersburg, Virginia. and Joseph C. died in 1864 at the battle of 1864 in battle of Hawes Shop, Virginia. 

William Aaron Thurman died on 19 June 1893 in Chesterfield County, South Carolina.45

Gus Davis Succumbs Suddenly at Cheraw
Special to The State.
Cheraw, March 11. – Gus Davis dropped dead at the corner of Kershaw and Greened streets between 12 and 1 o’clock yesterday. Until recent Mr. Davis had a market in Cheraw, but on account of failing health he had given this up, and for the past few months had no regular business. He was a great sufferer from rheumatism. His death was due to hearth trouble.
Mr. Davis, whose wife died a year ago, is survived by three sons, Clarence, Walker and Barney. Mrs. Ada Johnson and Mrs. Kelly, both of the Teal Mill section of this County.

Augustus B. Davis was born on 26 August 1861 to William Blakeney Davis and Mary Jane Martin. He came from a large family with 9 siblings; 1 sister and 8 brothers. He married Margaret Odom and they also had a large family of 10 children; 5 sons and 5 daughters.

Augustus “Gus” died on 10 March 1920 most likely from a heart attack. His wife, Margaret, aka Maggie, had died in June 1918. Only 5 of his children; 2 daughters and 3 sons, survived their parents. 

Gus and Margaret are buried in the Peniel Cemetery. 

Augustus B. Davis is my 2nd cousin 3 times removed.

Conway Davis Missing In Pee Dee River


Conway Davis, age 27, the son of Carol C. Davis and Janie Irene Gardner Davis, died in a boating accident on Friday, 24th December 1954.  He and two hunting companions, Dewey Hurst and Foster Edgeworth were out duck hunting when they were thrown from their boat after hitting a snag that ripped a hole in the boat.     


All three survived the initial incident and all seemed to be well; Hurst swam to shore and Edgeworth used the boat as a flotation device and floated to shore successfully. 
 
Rescue squads from the surrounding communities of Dillon, Hamlet, Charlotte and men from the Sonoco in Hartsville, where Davis worked, aided in the search. The Sheriff, his deputies and men from Cheraw and Chesterfield were also active in the search. 
 
The accident happen between Cheraw and Society Hill. Mr. Davis is survived by his wife, 4 children and his parents.

Treasure Chest Thursday~Jacob Gainey and his Family


Jacob Gainy/Gainey was enumerated in the 1850 Census for Chesterfield County with his wife  and two children along with an older Rebecca Gainey believed to be Jacobs older sister. All members of the household were born in South Carolina.

That a minor sample of the entries contained with this small books; there are many more.
Jacob and Harriett are enumerated in three Census; the 1850-1860 and 1880 Chesterfield County Censuses. WE don’t have an exact date for Jacob but based on these three Census he was born between 1822 and 1826. However, we do have a burial date – 7 October 1894. He most likely died on this same date. 4 5 6

Additional information was found in the death certificate of Jacob and Harriet's’ son Lewis Gainey, born 2 March 1861 and died 19 April 1915. 7

We learn from the Death certificate above that Lewis Gainey mother was Harriett Parker, Lewis’ birth and death and that he died as the results of Bright’s Disease (Kidney Failure).

We know from the St. David's Parish, South Carolina Minutes of the Vestry 1768-1832,: Parish Register 1819-1924 that Jacob Gainey was buried in the St. David’s Churchyard but no tombstone has been found.

The Little Book St. David's Parish, South Carolina Minutes of the Vestry 1768-1832,: Parish Register 1819-1924 is a real gem and a true treasure.

William Riley Huneycutt was a son of Mark I. Huneycutt and his wife Charity Dry/Drye. He was their 3rd child and was born in October 1830. 

William Riley and Lydia were married on 14 May 1851 in Stanly County, North Carolina.1
 





William Riley and Lydia had six children, 2 sons and 4 daughters. They are enumerated and listed in the 1880 census for the Big Lick community of Stanly County.2

It is not known when William Riley or Lydia passed away. No tombstone, death  certificate or obituary has been found for William or Lydia.

Amanuensis Monday~Mark Huneycutt to Tobias A. Huneycutt

Today’s subject is a land deed from Mark Huneycutt to his oldest son, Tobias A. Huneycutt.1

This indenture made on the 18th day of April in the year of our Lord one thousand eight hundred & forty nine between Mark Huneycutt of the county of Stanly and state of North Carolina of the first part & Tobias A. Huneycutt of the county and state aforesaid of the second part and Mathias Furr of the county & state aforesaid of the third part Witnefseth that whereas the said Mark Huneycutt is justly indebted to the said Mathias Furr in the sum of Twenty dollars due by note and whereas the said Mark Huneycutt is honestly desirous to secure the payment of the said debt. Now therefore this indenture witnefseth that for and in consideration of the premises together with the further consideration of one dollar to the said Mark Huneycutt in hand paid by the said Tobias A. Huneycutt the receipt whereof is hereby acknowledged he the said Mark Huneycutt hath bargained granted & sold and by these presents doth grant bargain and sell unto the said Tobias A. Huneycutt a certain parcel or tract of land lying and being in the county & state aforesaid on the waters of Stoney Run Creek containing about one hundred acres adjoining the lands of Leonard Tucker and others and more fully described in a grant to Mark Huneycutt bearing date the 28th day of Sep 1848 to have and to hold the said lands & tenements and the appurtenances there unto belonging or in anywise appertaining to him the said Tobias A. Huneycutt his heirs and afsigns in fee simple forever … and discharged of any and all encumbrances whatsoever in special trust and confidence Witnefseth that the said Tobias A. Huneycutt shall and will hold keep use and apply the same to use and intent following and no other that is to say if the aforesaid debts and every part thereof shall not be fully paid off and satisfied on or before the 1st day of January A. D. 1850 then and in that case it shall be lawful and shall be the duty of the said Tobias A. Huneycutt being thereunto required by the said Mathias Furr having first advertised the same at the Court house in Albemarle and three other public [places] within the county of Stanly for the space of twenty days to proceed to sell the said land and premises at public to the heist <sis> bider <sic> and convey the same by proper assurances to the purchaser and out of the money arising from said sale to retain all necessary expenses of his trust or such part thereof as shall remain unpaid at the time of said sale and the over plus if any he the said Tobias A. Huneycutt shall well and truly return to the said Mark Huneycutt his executors and administrators In testimony whereof we have here unto set out hands and affixed our seals the year and date just above written.

On Sept.. 28, 1848, the State of North Carolina provided Mark Huneycutt with a Land Grant (#151) of 100 acres on Stoney Run Creek.2 Now on the 18th of April 1849 Mark is selling this land (100 acres) to his oldest son (Tobias) to clear up a $20.00 dollar debt to Mathias Furr.

Census Sunday~1850 Household of William Burkley


First, I have one caveat for this article – some of the information contained within this article is hearsay and folklore.

The 1850 Census for Chesterfield County shows the William M. Burkley household as Dwelling 500 and Family 500. Within the household are:1
  • William M. Burkley, age 42
  • Mary Burkley, age 60
  • Elizabeth Rivers, age 75
  • Jesse Coker, age 18
Four individuals, of which, very little is known about any of them. The Census shows that William was born about 1808 in Georgia. However in 1860 his age is listed as 61 making his birth year to be 1799, a difference of 9 years. 

William M. Burkley is enumerated in the 1840-1850-1860 and 1870 Census for Chesterfield County, South Carolina. He wrote his Will on 29 December 1869 in Chesterfield County, South Carolina. Even though he was married to Mary, he left her nothing giving his entire estate to his niece – Sarah Frances Hancock. 2 3 4
“It is my will that all my just debts remaining unpaid at my death to be paid out of any personal property or moneys that I may leave and that the funeral expense of myself and wife Mary be paid in like manner.
I will and bequeath all my property both real and personal that I may seized and possess of unto my niece Sarah Frances Hancock to be hers her heirs and assigns forever at my death- the real property or estate above mentioned consisting of three tracts of land in said County adjoining each other, the first being the home track of One hundred (100) acres as will show by deed from Charles William Guardian to me made bearing date the 13th day of December A.D. 1843 the second containing thirty-three (33) acres more or less, reference being had to be made to me by Eliza Sellers, the one dated 27th June 1868 and the other dated the 21st day of August 1869 will fully show the third containing two (2) acres more or less will show by deed from Isaac F. Sweeney to me dated the twenty-third day of the December 1861 the personal property above mentioned consisting of stock of all kinds, farming implements household and kitchen furniture and other property to tedious to mention the above to belong to my said niece at my death provided she remains unmarried and reside with me and my said wife as long as either of us shall live and if my said wife shall survive me she my said niece shall take care of her and support her during her life.”

So Mary in this Census is his wife, as noted in his Will. But who is Mary? because Elizabeth Rivers is in the household many have suggested that she is Mary Rivers. Others say that William M. Burkley married Mary R. Sellers, daughter or grand daughter of Hardy Sellers and Mary Cook.

This note is from a dear departed friend and fellow genealogist, Marie G. Wiggins
Other information (some from the Rivers family) state that the wife of William Berkley wasn't Mary Sellers, but was Mary Rivers, daughter of Isaac Rivers and Nancy Parker. However, Marie Wiggins records show her as Mary Sellers. After the death of her first husband, Thomas Gaddy, in Georgia, she remarried to William Berkley (also spelled in the census records as Brinkley) and returned to Chesterfield County, SC where the couple were enumerated in the 1850, 1860 and 1870 census. They are buried on their farm, near the Old Sellers Graveyard. Marie Wiggins.

There is a Chesterfield County equity record that shows Mary Sellers married to Thomas Gaddy.5

See Will of Hardy Sellers. Hardy Sellers died testate on or about 17th January 1835, leaving widow, Levinia Sellers and children: Hardy Huntley Sellers and Zylpha Ann Sellers and the children & grandchildren from a former marriage, John Sellers; Abraham Sellers; Philip Sellers; Richard Sellers; Mary who intermarried with Thomas Gaddy; Elijah Gulledge, James Gulledge, & Pheobe Gulledge the children of Pheobe, a deceased daughter of Hardy Sellers who predeceased her father; and, Iverson L. Briley, the son of Jane, a deceased daughter of Hardy Sellers who predeceased her father.

John Stten 1850 DekalbThere is also the 1850 census for DeKalb County showing Mary Gaddy, age 61, with her daughter Martha and son-in-law, John Steen.6











Thomas Gaddy did die in Georgia in October 1849.7

Circumstantial evidence suggest that the story of Mary Sellers marrying William M. Burkley may be true. Still the facts are that there is no proof of Mary’s surname found as of this date. It’s ALL speculation.

Elizabeth Rivers, age 75 in the Burkley household, if her age is correct, she was born in 1775. Nothing more is known about this Elizabeth Rivers; this is the only census in which she appeared.

Jesse Coker, at age 27, enlisted into the 53rd NC Infantry  on 20 March 1862 in Union County, North Carolina.  He died January 2, 1863 in Raleigh, North Carolina from Typhoid fever.8
 1870 Wm BurkleyTo confuse the situation even more, in the 1870 Census, two teenage females appears in the household. 9


I have no idea who these teenage girls are or who they belong too. They certainly are not the children of William and Mary but they are most likely are their granddaughters.

Featured Family~John W. and Mary Abigail Sellers Brock


Family TimeJohn W. Brock was born on 1 Sep 18471 in Chesterfield County, South Carolina, a son of Squire H. Brock and his wife Rachel Parker. 

Mary Abigail Sellers was born on 24 Mar 18482 in Madison County, Tennessee, United States. Mary’s father was killed in Tennessee in an accident and the family returned to Chesterfield County, South Carolina about 1854-55. 

John W. Brock and Mary Abigail Sellers were married on 14 Mar 1869 in Cheraw, Chesterfield, South Carolina.3
 
John and Mary only had one child who died young. He and Mary lived their their entire lifetime in the Courthouse township where he was a farmer.  

The Family Bible shows a Mary R. E. Brock b. 12 July 1881 and died 22 May 1884. This is believed to be John and Mary Abigail’s daughter, their only child.4

John W. Brock passed away on 30 August 1895 in Cheraw, South Carolina. His death date is recorded in a Family Bible owned by my mother. No tombstone has been found for John or Mary Abigail but there are believed to be buried in Zoar UMC Cemetery.5
After John’s death in 1895, his widow, Mary Abigail went to live with my great grandparent Benjamin Franklin Brock and his wife Louise Ellen Sellers Brock. Louise Ellen and Mary Abigail were sisters, Mary being the oldest.6

Mary Abigail Sellers Brock died on 3 May 1907 in Cheraw, South Carolina. 7

Perplexed~When Did Tobias Huneycutt Die?


Tobias Huneycutt was born in 1824, a son of Mark I. Huneycutt and his wife, Charity Drye. He was their first born of eight children, five sons and three daughters. 

Tobias married Elizabeth Mariam “Mary Ann” Huneycutt, daughter of Andrew Jackson Huneycutt and Mary Ann Crayton on 7 Nov 1852.

On January 1st, 1864, Tobias enlisted into Capt. Snead's Company (Local Defense) North Carolina; Formerly Company C, Salisbury Prison Guard Battalion
(also known as Freeman's Battalion, Infantry), Confederate.


On 23 August 1864, Tobias Huneycutt is reported to have died from remit[tent] fever.”

But, did he really die or was this a hoax to avoid the war?

In 1870, Tobias and his wife Elizabeth can be found in Charlotte, Mecklenburg County, North Carolina.

Another potential indicator of Tobias’ survival of the Civil War is the birth of his youngest daughter, Tabitha Huneycutt, in 1869. 

If he did survive the civil war; when did he really die? Is the 26 June 1874 his actual death date; if so why does so many individuals have this date listed but none of them can give you a source for the date?

Simpson and James Simpson of the county and State are foresaid of the one part and James P. J. Purvis of the other part of the County and state are foresaid. Witnesseth that the said Thomas G. Simpson and James Simpson does here by sell release set over and convey to the said James P. J. Purvis  for and in consideration of the some<sic> of two hundred dollars paid in hand for all that tract or part of land lying and being in the county of Hinds known and designated and known as the East half of the North West quarter of Section No. Eight Township  Six in Range Two East containing eighty acres and 3/100 of an acre we the said Thomas S. Simpson and James Simpson do warrant and will ever defend the same from any other person or person whatsoever to the said James P. J. James P. J. Purvis was the grandson of Gilbert and Effica Howell Purvis. He married Elizabeth Rose Campbell in January 1832 and they had three children, a daughter and two sons, before his unexpected death in 1836.

Guardianship of Rachel and Columbus Lafayette Rivers, Jr.


On 30 January 2014 I wrote an article entitled - Thriller Thursday~Corn Liquor, Guns and Back Room Drinking = Death which told of the death of Columbus Rivers by his brother–in-law. The article can be read here:

This senseless killing left a young widow with two small children, ages 2 and 1 month. These two children were Rachel Rivers and Columbus LaFayette Rivers, Jr. children of Atlanta J. Smith Rivers and her now deceased husband, Columbus LaFayette Rivers, Sr.  

Columbus Sr. left no will but his estate (Apartment 62, Packet No. 6) was probated with his widow, Atlanta Smith Rivers and his brother Joseph Lee Rivers as administrators. 1

About 1914, Atlanta remarried taking as her second husband Alton John Weatherly. To this union were borne three children; all daughters. 

Then in June 1917, Atlanta J. Weatherly petitioned the court as guardian for funds to pay the cost of a hospital visits for one of the two children.2

To Milton McLaurin Judge of probate for Marlboro County in the State aforesaid:
The petition of Atlanta J. Weatherly as guardian for Rachel Rivers and Columbus L. Rivers, respectfully shwos <sic> to this Court:
1. That the petitioner is the duly qualified guardian of the above mentioned minors.
2. That there is now in the hands of said petitioner the sum of Four Hundred Eleven & 65/100 Dollars belonging to Rachel and Columbus L. Rivers respectively. As shown <sic> by last returns filed.
3. That during the last four years your petitioner has been forced to spend more or less money on the said minors for the proper food, clothing, physicians accounts etc., and that she finds it necessary now to carry one of the minors to the hospital for treatment.
THEREFORE, Your petitioner prays that an order by [be] passed by this Court permitting and directing your petitioner as guardian of Rachel Rivers and Columbus L. Rivers to use the sum of Two Hundred Eleven & 65/100 Dollars, to pay the above expenses, and she will ever pray.

Know ye that for and in consideration of the sum of five dollars for every hundred acres hereby granted paid into our treasury by Mark Honeycutt hath given and granted and by these presents do give and grant unto the said Mark Huneycutt a tract of Land  containing one hundred acres lying and being in the County of Stanly on Strong run Creek adjoining Josiah Tucker formerly Leonard Tucker Beginning at a post oak by two post oaks in said Tucker's line and runs south sixty five west thirty one chains and seventy five links crossing Stoney Creek three times to a stake by two post oaks and a red oak thence south thirty east thirty one chains and seventy five links to a red oak by a pine and post oak thence north sixty five east thirty one chains and seventy five links to the said Tucker's line thence with it north thirty west thirty one chains and seventy five links crofsing said creek to the Beginning Entered 9th August 1847
As by the plat hereunto annexed doth appear together with all roads waters mines minerals hereditaments and appurtenances to the said land belonging or appertaining to hold to the said Mark Huneycutt his heirs and assigns forever yielding and paying to us such sums of money yearly or other wise as our general assembly from time to time may direct provided always that the said grantee shall cause this grant to be registered in the registers office of our said County of Stanly within twelve months from the date hereof otherwise the same shall be void
In testimony whereof we have caused these our letters to be made patent and our great seal to be here unto affixed. Witnefs William A. Graham our governor at Raleigh the 28th day of September in the 75th year of our Independence and in the year of our Lord one thousand eight hundred and forty eight

Mark Huneycutt received his land grant on Stony Run Creek in Stanly County on Sept. 26, 1848. Mark continued to farm this land up until his death sometime between 1860 and 1870. Even though he died before 1870; his estate was not probated until May 1902.

Did the family hang onto the land and continue to farm it to provided a living: I don’t known. But, I do know that in May 1902, the family and executors petitioned the state to sell the land because there was not enough acreage to partition and divide among all the legatees. 2 3

Wherefore your petitioner pray that the Court will appoint some competent person to sell said land after due advertisement to the highest bidder on such terms as to the Court may seem proper and report his proceeding in regard to said sale to this court without delay. M. H. Colwell,
