Treasure Chest Thursday~Marriage of Thomas Hunnicutt and Isabella Ladd
Transcription:
Whereas Thomas Hunnicutt of Goochland County and Isabella Ladd daughter of James + Isabella Ladd dec’d of Charles City County having declared their intention of taking each other in Marriage before several monthly meetings of friends, held at Waynoka in Charles City County aforesaid, and their proceeding therein being approved. They appearing clear of all other marriage engagements, + having the consent of parties + friend concerned. Now these are to certify all whom it may concern that for the full accomplishment of their said intentions they the said Thomas Hunnicutt + Isabella Ladd, appeared in a public meeting of Friends and others held at Waynoka the fifth day of the eleventh month, in the year of our Lord One Thousand eight hundred + Eleven and he the said Thomas Hunnicutt taking the said Isabella Ladd by her hand did openly in a Solemn manner declare as follows. “In the presence of the Afsembly I take Isabella Ladd to be my wife, promising with Divine Afsistance to be unto her a faithful and loving Husband until death.” Or word to the same effect. And she the said Isabella Ladd, did likewise declare as follows. “In the presence of the Afsembly I take Thomas Hunnicutt to be my husband, promising with Divine Afsistance to be unto him a faithful and loving wife until death.” or word of the same impart. And the said Thomas Hunnicutt and Isabella [Ladd] now his wife, as a further confirmation of their said marriage, did then and there to these presents set their names, she according to custom afsuming the name of her husband. And we whose names are hereunto Subscribed being present at the Solemnization of the said marriage + subscription have as Witnefses thereof here unto set our names the day and year above written.

F. J. Osborne being sworn, doth say “That Mary Ann Huneycut, late of said County is dead, having first made and published her last will and testament; and that there is no executor named therein _ Further, that the property of the said Mary Ann Huneycut consisting of a lot of land in the city of Charlotte is worth about $2000, so far as can be ascertained at the date of this application, and that Mary Elizabeth Kendrick is the party entitled under said will to said property, the same being devises to F. J. Osborne and James W. Osborne in trust for said Mary Elizabeth Kendrick.

I, Mary Ann Huneycutt of Mecklenburg County in the State of North Carolina, being of sound mind, but considering the uncertainty of life, do make and declare this my last Will and testament in manner and form following_ I give, devise and bequeath all my real estate on Graham Street in the city of Charlotte conveyed to me by J. H. McAden & wife, to F. J. Osborne and James W. Osborne and the heirs of them and the heirs of the survivor, to hold in trust for the benefit of my beloved niece Mary Elizabeth Kendrick during her life.- The terms of the trust are as follows, Viz: That the said F. J. Osborne and James M. Osborne shall have charge of the said property after my death, collect the rents and profits arriving therefrom, and apply the same, or so much thereof as shall be necessary to the support and education of the said Mary Elizabeth Kendrick and the balance if any to invest for her benefit- And the said Trustees shall have the power when the said Mary Elizabeth Kendrick has arrived at the age of Twenty one years, by and with her consent, or before that time by and with the consent of her guardian to sell said property make good and sufficient title to the Purchaser, and to invest the money arriving from such sale in other property either real or personal, for her benefit.- It is my will that this trust shall expire at the death of the said Mary Elizabeth Kendrick and that the said property or the property substituted therefor, shall descend to her heirs, or to such person or persons as she may by will appoint---~~~~----
And I do herby revoke and make void all and every other will or wills by me heretofore made. In witness whereof, I, the said Mary Ann Huneycutt, have hereunto set my hand and seal this day of 1880.-

A paper purporting to be the last will and testament of Mary Ann Huneycutt deceased, is exhibited before me, the undersigned, Judge of Probate for said County, by F. J. Osborne one of the Trustees therein mentioned, and the due execution thereof by the said Mary Ann Huneycutt by the oath and examination of John A. Bixby & H. D. Duckworth the subscribing witnesses thereto, who being duly sworn, doth depose and say and each for himself deposeth and saith, that he is a subscribing witness to the paper writing now shown him, purporting to be the last will and Testament of Mary Ann Huneycutt that the said M. A. Huneycutt in the presence of the deponent subscribed her name with a mark, at the end of said paper writing which is now shown as aforesaid, and which bears date of the __day of – 1880 and the deponent further saith that the said Mary Ann Huneycutt the testatrix aforesaid, died at the time of subscribing her name as aforesaid declared the said paper writing so subscribed by her and exhibited to be her last will and Testament and this deponent did thereupon Subscribe his name at the end of said will as an attesting witness thereto and at the request and in the presence of the said Testatrix__And this deponent further saith that at the said time when the said Testatrix subscribed her name to the said Last Will as aforesaid, the said Mary Ann Huneycutt was sound of mind and memory, of full age to execute a will and was not under any restraint to the knowledge information and belied of this deponent And further these deponent say not.

At this day comes Brice McEver and files his petition, the object and prayers of which are for the appointment of a guardian for said minors, in the place of said petition the present guardian of said minors and the premises being seem and by the Court fully understood by the Court, So is order by the Court that the prayers of said petition be granted and John Petray appointed ass such guardian upon his entering into bond for said minors in the sum of one dollar which he accordingly does, with Brice McEver as his security.
John Petray assume Guardianship/Apprenticeship of the two boys as evidence by his household composition in 1860.
Brice McIver a Uncle of the minor children.

Its Family Time~ Stanmore Sellers
Stanmore Sellers1 was born on 1 Jan 1898 in Chesterfield, Chesterfield, South Carolina. 2 3 4
He was the first born son of James Arnold “Buck” Sellers and Nancy Jane "Jennie" Johnson.
Stanmore was named after his maternal Grandfather Stanmore P. Johnson.
Stanmore had two sisters; Elizabeth Jane and Mary Bell Sellers.
Stanmore’s life was cut short, at the age of 35, when he was killed in an automobile accident near McBee, South Carolina.
“The accident occurred when the driver attempted to pass a buggy on the hill leading up to the Seaboard overhead bridge. A passenger in the car, Glenn Adams was not seriously injured.” 5
Stanmore Sellers is my 1st Cousin twice removed.

NC Civil War Pension Application of Sarah Elizabeth [Page] Huneycutt
On 1 July 1902, Sarah Elizabeth [Page] Huneycutt, age 68, of Wadesboro, NC applied for a Widow pension for the service of her husband during the Civil War.
Her husband, James W. Huneycutt, had recently passed away on 19 November 1896. During the War, he had served in Company “C”, 42 NC Infantry.
There is an error on page 1 of this application where it states that James served in the 42 and strike-through was made and South Carolina written in; the 42th was a NC Regiment and James served with this NC Regiment. [https://www.fold3.com/image/271/49881976]
She stated the following:
She married before 1861 [actual marriage date was 20 May 1855]
Her husband died about Nov 1896 [died 19 Nov 1896]
She received a pension in South Carolina in June 1901 - She moved to North Carolina in October 1901- and has since that date and is now a resident of North Carolina.
John Dry was her witness to statements made within her NC Widow’s Application for a Pension.
John Dry was the son of Charles Andrew Dry and his wife Leah Tucker. John Dry and Sarah’s husband, James W. Huneycutt, were cousins.

Bro. Valentine Brock Passes Away

Bro. Brock was born in Alabama about A. D. 1825, and moved with his parents to Pike County, Miss, in A. D. 1828, in which county he lived until his death. Bro. Brock was married to Miss Barthana Ginn in 1845. He united with the Silver Creek Church in August 1869. He withdrew his membership in 1873 to go into the constitution of Bogue Chito Church, of which he remained an honored member until his death, Feb. 22, A.D. 1881. Bro. Brock was a man of sorrow and acquainted with grief, having had two sons killed; and but a little while before he was called the Lord very suddenly called his companion, which added greatly to the old man's sorrow. But the Lord did not leave him long in loneliness. Although his trials were so great and his sorrow so deep, his faith was firm and unwavering. It may truly be said of him, that he has come through great tribulation and has washed his robe and made it white in the blood of the lamb. Bro. Brock has gone where no sorrow can come; his troubles are all over; his soul at rest with that Saviour he loved.
Dearest brother, thou hast left us,
Here thy loss we deeply feel,
But 'tis God that has bereft us,
He can all our sorrows heal.
Yet again we hope to meet thee
When the day of life is fled,
Then in heaven with joy to greet the,
Where no farewell tear is shed.
Valentine and Bethany have a beautiful tombstone and portrait on their FindAGrave memorial.
Valentine Brock is my 2 cousin 4 times removed.

We the subscribers are jointly and severally held + firmly bound to his Excellency Samuel Ashe Esquire + his Sucefsors in office in the sum of five hundred pounds to be void only on conditions that there is no obstructions in a marriage intended to be celebrated between Rowland Honeycut and Patsey Taylor Witnefs Our hands and Seals this 20th December 1797.

It’s Family Time~Mark and Catherine Hancock Rivers
Irena Catherine Hancock was born in Jan 1822 in Chesterfield, Chesterfield County, South Carolina. Her parents are unknown.
Irena Catherine Hancock and Mark S. Rivers were married in Feb 1840 in Chesterfield, Chesterfield, South Carolina.
Mark S. Rivers, son of Mark Rivers and Annie Parker, was born about 1808 in Chesterfield, Chesterfield, South Carolina.
They had no children. Shortly after their marriage in February 1840, they decided to move to Mississippi joining Mark’s Sister Amelia ‘Milly’ Rivers and her husband Moses Holifield who had also recently moved to from Chesterfield.
Then sometime in the 1850’s Mark and Millie’s brother Luke Rivers moved his wife and family to Jones County, Mississippi.

Trouble be-seized the family and on 1 January 1859, Mark Rivers filed a complaint in Open Court for a divorce accusing Catherine Rivers, his wife, of adultery.

District of said State while presiding in Chancery.
Be it remembered that a regular term of the Chancery Court was begun and held in and for said County at the courthouse thereof in the Town of Ellisville on the 3rd Monday of April A.D. 1859 it being the time and place designated by law for holding said court. Present the Honorable Wm M. Hancock Judge and Chancellor of the County E. M. Duvall Sheriff of said county. D. M. Shows clerk of said Court.

Be it remembered that the plaintiff in the above stated case did on the first day of January A.D. 1859 file his bill of complaint in the clerks office of said court which is in the words and figures following to wit…
The divorce was granted on 19 April 1959. Yet, Mark and Catherine continued to live together as husband and wife.

On 5 January 1868, Mark Rivers petitioned the court to have 3 destitute Holifiled children apprentice to him for care. These Holifield children were the grandchildren of Mark’s sister Milly and her husband Moses Holifield.
This day came Mr. Rivers who is a resident of said County and brought with him Milly Holifield Ranson Holifield aged twelve years Ransom Holifield aged ten years and Miles Holifield aged eight years and makes known to the County, that they orphans and destitute of the necessary means of support and makes application to the Court to have the, apprenticed to him until they respectively attain full age of twenty one years and the said Rivers consenting to taker the said Milly, Ransom, & Miles Holifield…
Even though Mark had divorced Catherine back in 1859 he became very benevolent in 1878. I believe that Mark knew he was dying because on 22 Mar 1878, he made a Deed of Gift to Catherine Rivers for 198 acres of land in Choctaw County, Alabama. (DB “N”, pages 381-382).
I believe Mark Rivers died sometime before 8 September 1879. On 8 Sep 1879, Irena Catherine Hancock and George S. Fagan were married in Choctaw County, Alabama.
George S. Fagan, son of Patsy Fagan, was born about 1807 in SC. George died before 1900. Catherine lived a few more years and is believed to have passed away before 1903.
George S. Fagan and Irena Catherine Hancock reared the following child:
i. Amanda J. Fagan was born about 1860.
George S. Fagan and Irena Catherine Hancock Rivers are beleived to be the biological parents of Amanda J. Fagan.
Mark S. Rivers is my 4th Great Grand Uncle.

Sale of Frederick and Siddie Rivers Estate Lands
Frederick F. Rivers, Jr. and his wife, Sarah “Siddie” Boatwright both died within 13 months of each other. First, Frederick died 31 May 1860 then Sarah died on 3 July 1861. Their death left 7 surviving children:
i. William M. "Billy" Rivers, born 1805, Chesterfield, Chesterfield, South Carolina; married Anne Eliza Kelley, 27 Dec 1837, Mt. Croghan, Chesterfield, South Carolina; died Mar. 18, 1891, Mt. Croghan, Chesterfield, South Carolina.
ii. Sarah "Siddie" Rivers was born in 1808 in Chesterfield, Chesterfield, South Carolina. She was still living on 23 Jan 1879.
iii. David T. Rivers, born 10 Jun 1810, Chesterfield, Chesterfield, South Carolina; married Katherine Eugenia Edgeworth, abt 1844, Chesterfield, Chesterfield, South Carolina; died 8 Feb 1891, Chesterfield, Chesterfield, South Carolina.
iv. Lewis Rivers, born 6 Nov 1811, Chesterfield, Chesterfield, South Carolina; married Lenora L. Padgett, 12 Dec 1839, Mt. Croghan, Chesterfield, South Carolina; died 11 Feb 1895, Chesterfield, Chesterfield, South Carolina.

vi. Frederick F. Rivers III was born in 1828 in Chesterfield, Chesterfield, South Carolina. He served in the Civil War and died before 11 Jan 1866 at the age of 38 most likely due to service connected injuries. Frederick had his estate probated on 29 Jan 1866; Probate Folder #103 in Chesterfield, Chesterfield, South Carolina. He was buried in Chesterfield, Chesterfield, South Carolina.
vii. James Calvin Rivers, born 9 Jan 1831, Chesterfield, Chesterfield, South Carolina; married Louise Gatewood, 5 Jan 1860, Chesterfield, Chesterfield, South Carolina; died 3 Nov 1907, Chesterfield, Chesterfield, South Carolina.
Sometime near 11 January 1866, one of the children, Frederick III, passed away leaving 6 remaining children.
On 28 April 1869, five of the remaining six children, William, Sarah, Lewis, Eliza and Calvin sold their interest in their parents estate lands (162 + acres) to their brother David T. Rivers for $500.00 dollars. [Chesterfield County, SC; Deed Book 4, pages 497 and 498].
Another Chesterfield Land Deed (DB 4, pages 263 to 265] shows that the six children sold 69 acres to B. F. White for three hundred and sixty seven dollars ($367.00).

Know all men by these presents that we William Rivers Sarah Rives Lewis Rivers Eliza Rivers + Calvin Rivers of the State and County aforesaid for and in consideration of the sum of $500 Five hundred Dollars to us paid in hand by David Rivers of the State and County aforesaid have granted bargained sold and released and by these presents do grant bargain sell and release unto the said David Rivers a certain piece or parcel of land lying and being in the State and County aforesaid lying on Jimmey’s Creek bounded on the West by lands of John John Bitels [Bittle??] and Phillip G. Hinson in East by lands of A. J. Edins [Eddins] and others containing 162 1/2 more or less together with all and singular the rights members hereditaments and appurtenances to the said premises belonging in in <sic> anywise incidents or appertancy [appertaining] to have and to hold all and singular premises above mentioned unto the said David Rivers his heirs and afsigns against ourselves our heirs and against any person or persons whomsoever lawfully claiming the same or any p[art thereof. The State of South Carolina
To all whom these presents shall come or be made known, or whom the same may in anywise concern I P F Spofford Sheriff of the County of Chesterfield in the said state send Greeting Whereas William B. Davis In on or about the twenty fifth of December in the year one thousand eight hundred and Seventy One did exhibit his Petition in the Court of Probate in the County of Chesterfield and State aforesaid asking that the real estate of C. W. Davis deceased might be sold. And the Court, being at issue before the Honorable Court aforesaid, came on to be heard on the first day of January A. D. one thousand eight hundred and seventy two when the said Court, after a full hearing thereof and mature deliberations in the premises, did order, adjudge and decree that the the <sic> real estate of C. W. Davis deceased hereinafter mentioned and described should be sold at Public Auction by the Sheriff of Chesterfield County, on the terms and for the purposes mentioned in said decretal order, as by reference thereto on file in the said Court, will appear. And the said Sheriff after having duly advertised the said real estate for sale, by public outcry on the fifth day of February in the year of our Lord one thousand eight hundred and Seventy Two did then, openly and publicly and according to the custom of Auction, Sell and dispose of the said Real estate below described unto Jesse C. Smith for the sum of one thousand and ten dollars$1010.00 he being at that price the highest bidder for the same.
Now know all men That I the said P F Spofford Sheriff as aforesaid in consideration of the premises and also in consideration of the sum of Three Dollars paid by the said Jesse C. Smith the receipt whereof is hereby acknowledged have granted, bargained, sold and released, and by these presents do grant, bargain, sell and release unto the said Jesse C. Smith and his heirs and assigns, All that piece parcel and tract of land, Situate lying and being in the County of Chesterfield and State aforesaid on the waters of Abrams Creek, Containing three hundred and fifty six acres more or less, bounded by lands of G. R. Boatwright, R. W. Smith, Mary Jones, Isaac Smith and Owen Bittle. Together with all and Singular the Rights, Members, hereditaments and appurtenances whatsoever, to the said tract of land, belonging or in anywise appertaining and the reversions and remainders, rents, issues and profits thereof and Also, all the estate, right, title,interest, dower, possessions, property, benefit, claim and demand whatsoever, both at law and in Equity of the said C. W. Davis deceased and of all the parties in the Said Suit and of all other persons rightfully claiming or to claim the same or any part thereof by from or under them or either of them.
To Have and to Hold the said tract of land herein before mentioned and described with its hereditaments, privileges and appurtenances unto the said Jesse C. Smith his heirs and assigns forever.

Carroll Washington Davis died on 6 February 1863. His 2nd Wife, Mary Boatwright Davis, passed away on 22 February 1863. By Christmas of 1871 their estate was still unsettled. So, the oldest son of the first marriage, William Benjamin Davis petitioned the Courts to sell the 346 acres of land.
The farm (346 acres) went on sale, at public auction, on 5th of February 1872 and was sold to Jesse C. Smith, the highest bidder, at $1010.00 dollars.
Carroll Washington Davis was twice married to sisters. He first married Elizabeth Boatwright, daughter of Lewis Boatwright and Elizabeth Rebecca Davis on 17 Feb 1846. To this union was born 3 children:
- William Benjamin Davis
- Julia Elizabeth Davis
- George Richard Davis
Carroll Washington then married her (Elizabeth) younger sister Mary Boatwright on 10 August 1854. To this union was born 4 children:
- Catherine Jane Davis
- Lewis Boatwright Davis
- Margaret Elizabeth Davis
- Mary Eliza Davis

It’s Family Time~Ambrose M. Huneycutt, Sr.
Ambrose M. Huneycutt Sr. was born about 1804 in Montgomery County, North Carolina. He appeared in censuses from 1830 to 1860. 1 2 He died on 14 Jan 1879 at the age of 75 in Cabarrus County, North Carolina.3
Ambrose M. Huneycutt Sr. and Elizabeth "Betty" Morgan were married about 1824. Elizabeth "Betty" Morgan was born about 1797. 4 She died about 1852 at the age of 55.
Ambrose M. Huneycutt and Elizabeth Morgan had the following children:
i. Marcus Jackson "Mark" Huneycutt, born 7 Aug 1825, Montgomery County, North Carolina; married Susann, abt 1852; died 25 Oct 1913.
ii. Gabriel Huneycutt, born abt 1828, Montgomery County, North Carolina; married Jincy .
iii. George H. Huneycutt was born about 1832 in Montgomery County, North Carolina. 5 He served in the military.
iv. Ambrose M. Huneycutt Jr., born abt 1838, Montgomery County, North Carolina; married Sarah; died 20 Nov 1862 in the Civil War. .
v. Elizabeth D. Huneycutt was born about 1837 in Montgomery County, North Carolina. 6
vi. Mary Huneycutt was born about 1845. 7 8
Ambrose M. Huneycutt Sr. and Cynthia Gow were married on 14 Dec 1854.9 Cynthia Gow was born about 1830. 10
Ambrose M. Huneycutt and Cynthia Gow had the following children:
i. Eva M. Huneycutt was born about 1854. 11
ii. James Harrell Huneycutt was born on 15 Sep 1857 in Stanly County, North Carolina. 12 He died on 6 Jun 1939 at the age of 81 in Salisbury, Rowan, North Carolina.
This family have proven to be a real challenge and a lot of additional research is needed to fill in the gaps. If you are related to or have knowledge of this family I would love to hear from you.

In 1927, Harry Alexander Davis published an unsourced book of the David/Davis family entitled “The Davis family (Davies and David) in Wales and America : genealogy of Morgan David of Pennsylvania.”
The book has been widely used by Davis researchers within the United States. The book is not without errors and as stated before none of the information within the book has been sourced. One of those errors will be addressed in this web post.
On pages 54 and 55 of the book, Mr. Davis shows that the 7th child of Thomas Davis and Nancy Rivers was a daughter name Margaret Elizabeth who married Lewis Boatwright.
Elizabeth did marry Lewis Boatwright, Jr. but in several deeds related to his estate, she maintains that her name is Elizabeth Rebecca NOT Margaret Elizabeth as stated in the Davis book. See Chesterfield County Land Deeds, DB 1, page 46-47 and DB 3, page 301-302.
One child of Margaret and Lewis is not mentioned in the Davis book. That child was Louisa Ann who married Duncan Teal. Dates for individuals do not match census records; there is a known death date for Lewis but no known death date exists for Elizabeth Rebecca Davis Boatwright.

Chesterfield District}
Know all men by these presents that I Lewis Boatwright of the State and district aforesaid for and in consideration of the sum of two hundred and fifty ($250} to me in hand paid have granted bargained sold and released and by these presents do grant bargain sale and release unto my son Samuel Boatwright of the said State and district a certain piece parcel and tract of land containing two hundred and fifty-one (251) [acres] more or less bounded on the North by R. Smith’s land on the East by W. W. Davis’s land on the South by Geo. Boatwright’s land and on the East by Wesley Streator’s land together with all and singular the rights members hereditaments and appurtenances to the said premises belonging or in any wise incident or appertaining to have and to hold all and singular the above-mentioned premise unto the said Samuel Boatwright his heirs and assigns forever and I the said Lewis Boatwright do hereby warrant and forever defend the said premises with their appurtenances unto the said Samuel Boatwright and bind myself my heirs executors and administrators to warrant and defend the same unto the said Samuel Boatwright is heirs and assigns forever against myself and heirs and from and against the claim or claims of any person claiming the same. This indenture made the fifth day of June in the year of our Lord one thousand eight hundred and thirty Eight Between William Wood of the state of N. Carolina and county of Montgomery of the one part and Dempsey Honeycutte Senr of the same county + State aforesaid of the other part Witnefseth that for + in consideration of the sum of fifty dollars to him in hand paid before the signing sealing of these presents the receipt whereof is hereby fully acknowledged by him the said William Wood hath given granted bargained + sold + by these presents doth give grant bargain + sell unto the said Dempsey Huneycutt his heirs and assigns forever all that piece parcel plantation or tract of land + improvement situated in Montgomery on the East prong of Island creek joining John Peeks South east line Beginning at a stake at the Allenton road leading to Charlotte on John Peeks line running with his line north west 175 poles to a stake thence a south East course 180 poles to a stake thence south 175 poles to a stake on the south side of the Allenton road thence a west course 175 poles to a stake thence 50 poles to the beginning containing 200 acres more or lefs also with all ways waters watercourses and every appurtenances thereunto belonging to have and to hold the said land and tenements unto him the said Dempsey Huneycutt his heirs exrs + adms + afsigns forever to the only proper use + behoof of him the said Dempsey Huneycutt and the sd William Wood for himself and each of his heirs do forever warrant and defend the right + title of said land clear + free from him the said William Wood his heirs and afsigns unto Dempsey Huneycutt his heirs + afsigns forever where unto I the said William Wood hath hereunto set his hand and affixed my seal the day + year first above written.

Dempsey Huneycutt Sr died sometime after 23 September 1849 and when the 1850 Census was enumerated. He should be listed in the 1850 Mortality schedule but he is not. The below document is the last document I have found that names Dempsey Huneycutt before his death.

On page 66 – Commencing on Saturday before the 4th Lord’s Day in [23] September 1849 The Meadow Creek association met with Elder G. Little delivering a sermon from Titus 2nd Chapter 14th verse. On the next page (67) present at this meeting was Hezekiah Hearne, D. Little and Demcy Hunnicut representatives from the Meadow Creek Church.
