Amanuensis Monday~Land Deed, Isaac Hurst + Others to J. B. Douglass

Today’s subject is ta Chesterfield County, SC Land Deed between Isaac Hurst + Others to J. B. Douglass.1


Isaac Hurst, 1804-30 Sep 1884, was twice married. His first wife, Henrietta Rivers, passed away on 15 Aug 1865 after 40 years of marriage at the age of 60.

After her death, Isaac remarried to a young lady 20 years his junior named Sarah Ann “Sallie” [LNU]. The maiden named of Isaac Hurst second wife remained a mystery for many years until the below Land Deed was discovered.

Case in point, as late as June 2014 I did not know Sarah Ann‘s maiden name as indicated by my post on 6 June 2014.

This Chesterfield County Land Deed (1:388) proves that Isaac Hurst (1804-1884) married Sarah Ann McNair after the death of Henrietta Rivers.

                 Know all men by these presents that we Isaac Hurst and his wife Sarah Ann, Mary Ann McNair Neil C. McNair, Mary Ann Douglass, Harriett E. Sellers, Eliza Jane McNair, Sarah Ellen McNair and Margaret Emeline McNair all of the State and County aforesaid for and in consideration of Two Hundred and fifty Dollars to the said Isaac Hurst and his wife Sarah Ann paid by James B. Douglass which sum of money we agree shall be taken as an advancement to the said Sarah Ann Hurst and her said husband from the Estate of the late Neill McNair (deceased) have granted, bargained, Sold and released any by these presents do grant bargain Sell and release unto the said James B. Douglass all that tract and parcel of land on which D. A. McNair resided in his lifetime Situate lying and being in the County and State aforesaid on the waters of North Bear Creek bounded by lands of Estate of Neil McNair (dead) Henry Johnson Isaac F. Swiney, P. W. Massey, Phillip Hurst and lands of Neill McNair containing one hundred acres more or less together with all and Singular the rights members, hereditaments and appurtenances to the said Premises belonging or in any wise incident or appertaining To have and to hold all and Singular the said premises unto the said James B. Douglass his heirs and assigns forever. And we do hereby bind ourselves to warrant and forever defend all and Singular the said premises unto the said James B.                                  I, Rolin Kite one of the Magistrate in and for the County of Chesterfield and State aforesaid do certify unto all whom it may concern that Sarah Ann Hurst wife of the within named Isaac Hurst did this day appear before me and upon being privately and Separately examined by me did declare that she does freely voluntarily and without any compulsion dread or fear of any person or persons whomsoever release and forever relinquish unto the within named James B., Douglas his heirs and assigns all her interest and Estate and also all her right and claim of Dower and of inheritance in and to all and Singular the premises within mentioned and released and that her said renunciation and release of her Inheritances was positively and Bona Fide executed at least seven days before the day on which this certificate is made to wit the day of the date of the within Deed of release in the execution of which she hath and doth declare is aforesaid that she did in manner aforesaid from her husband as aforesaid. Given under my hand and seal this the 11th day of Dec. Anno Domini 1868.

Last Will and Testament~David Dry, 1879


David Dry is a real mystery. His Last Will and Testament is the only document I have found that mentions or names David Dry.

D. W. Honeycutt could be David W.., b. 1821 son of James Irvin Honeycutt or Drewry Wesley, b. 1820, son of Reuben George Huneycutt.

If you have any information on this man or any of the individuals mentioned within the Will I would love to hear from you.

A paper writing purporting to be the last will and testament of David Dry is exhibited before me by Toney Reed one of the Executors therein named which is in the following means and figures to wit:
I David Dry of the county of Cabarrus and state of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following, that is to say;
First, that my Executors (hereafter named) shall provide for me, a decent burial suitable to the wishes of my family and friend and pay all funeral expenses together with my just debts out of the moneys that may come unto their hands as a part or parcel of my estate.
I give and devise unto my beloved wife Tamar Dry the entire tract of land on which I now live together with all my personal property the land consisting of forty two + one third acres to have and to hold to her the said Tamar/Tomas Dry for and during her natural life.
I give and devise to Tamar Ann Frances Barnheart two thirds of my land to be laid off so as to include the buildings, together with all my personal property to take affect after our death on the following conditions to wit That the said Tamer  A. F. Barnheart shall remain with and take care of us during during <sic> our natural lives and in the event she should fail to comply with the above conditions then and in that case this clause shall be void. 
I give and devise to William Geo. Martin Dry one third of my land to be laid off on the east side of Beus Creek.
I give and devise to my children the sum of one dollar each. And lastly I do hereby constitute and appoint my trusty friends Peter J. Lentz  + Tonly/Towly Reed my lawful Executors to all interests and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof.
In witnefs whereof I the said David Dry do hereunto set my hand and seal this 4 day of January AD 1877.

William Henry Harrison Dry was born on 22 Oct 1847 in Cabarrus County, North Carolina. He was a son of Tobias A. Dry and Mary Herlocker. He served during the Civil War. with Company H, 8th North Carolina Infantry enlisting on April 16, 1864.

William Henry Harrison Dry and Martha Jane Lefler were married on 2 Sep 1869 in Cabarrus County, North Carolina. Martha Jane Lefler was born on 21 Dec 1851 in Cabarrus County, North Carolina. She was the daughter of John and Fannie Lefler.
 
William Henry Harrison Dry and Martha Jane Lefler had the following children:
        i.    Laura Rosetta Dry, born 24 Mar 1869, Cabarrus County, North Carolina; married John Jacob Smith, 1889; died 2 Jan 1934, Monroe, Union, North Carolina.
         ii.    John A. Dry, born 5 Apr 1871; married Elizabeth Catherine Dry, 28 Dec 1893, Cabarrus County, North Carolina; died 15 Feb 1895.
         iii.    Martin Clifford Dry, born 7 May 1872, Cabarrus County, North Carolina; died 10 May 1941, Cabarrus County, North Carolina.
         iv.    James Franklin Dry was born in Dec 1877.
         v.    Frances Ellen Dry, born Nov 1879; married Charles A. Fink, abt 1901; died 29 Aug 1953, Cabarrus County, North Carolina.
         vi.    Charles Smith Dry was born in Oct 1881.
         vii.    George Cleveland Dry was born in Feb 1885. He died on 28 Jul 1960 at the age of 75.
         viii.    Carrie Elizabeth "Lizzie" Dry was born on 10 Jan 1884. She died on 9 Jul 1959.
         ix.    Robert Hoke Dry was born on 25 Dec 1887.
         x.    Iva Ethel Dry was born on 11 Dec 1890. She died on 9 Sep 1960 at the age of 69.
         xi.    Walter Clyde Dry was born on 11 Sep 1893.
Census records (1900/1910) states that William and Martha had 13 children of which 10 were living. I have only identified 11 of the 13 children.
William Henry Harrison Dry died on 28 Jan 1915 at the age of 67 in Cabarrus County, North Carolina. He was buried at Cold Springs United Methodist Church Cemetery in Concord, Cabarrus, North Carolina.
Martha Jane Lefler Dry died on 21 Sep 1916 at the age of 64 in Cabarrus County, North Carolina.  She was buried at Cold Springs United Methodist Church Cemetery in Concord, Cabarrus, North Carolina.


William Henry Harrison Dry is my 3rd Cousin 3 times removed.

             Know all men by these presents, that I Rilah Sellers of aforesaid County and State, for and in consideration of the sum of five hundred and Seventy-five dollars to me in hand heretofore paid by Samuel Sellers of the Same County and State have granted, bargained, Sold and released, and by these presents do hereby grant, bargain, sell and release unto the said Samuel Sellers all my right, title, interest and Estate in and to all and Singular the real Estate now belonging to the Estate of John M. Sellers deceased – the same being a tract of land Situate in the County aforesaid on the Waters of Deep Creek Containing one one <sic> hundred and fifty acres more or less, the same being my undivided interest in the Said land as one of  the Heirs and distributee of the said John M. Mississippi Estate #783~William B. Dickson

About 1836, Mary Ann Purvis daughter of James Purvis and Sarah McMillan married William B. Dickson.

Shortly after their marriage, William and Sarah migrated to Hinds County, Mississippi. There they begin to grow their family and William acquired very much property in the counties of Hinds and Copiah.

Sometime prior to 28 October 1844, William B. Dickson passed away leaving his pregnant widow, Mary Ann Purvis and 4 children; 3 daughters and a son. 

On 28 October 1884, A court order was issued the appraise the property of William B. Dickson. Named as appraisers were:
  • Wm. Stafford
  • George W. Osburn
  • Wm. B., Shearer
  • W. G. Jennings
  • E. H. Watson
  • or any 3 of the named individuals

A letter to the Courts by the Administrator, John Stewart, dated 26 December 1845 shows that Mary Ann Purvis Dickson and her children had returned to Chesterfield, South Carolina. [Image 1082]

shows that the said, Mary Ann Dickson, and the minor heirs of the said W. B. Dickson, now resides in the State of South Carolina; and that you petitioner believes a speedy re-sale of said lands would be for the benefit of the heirs, as stated in said Mary’s petition aforesaid, by reason of an early…”

Then on 5 May 1848, the local newspaper ran notice on the final settlement of the estate of William B. Dickson.

NOTICE is hereby given, that at the July term 1848, of the Honorable Probate Court of Hinds County, state of Mississippi, the undersigned, administrator, if the estate of WM. B. DICKSON, deceased, will present his account for final settlement and allowances at which time all persons interested may attend if they think proper.

In the Probate Court of said county, at the April Term 1848, thereof.
In the matter of the settlement of the estate of Wm. B. Dickson, dec’d.


JOHN STEWART, administrator of said deceased, having this day presented to the court, a petition for publication and notice of his intention of making a final settlement as such administrator, and the Court being satisfied from the proof &c., therein set forth, that said estate is now in a condition to be finally settled: It is therefore ordered by the court, that said administrator give notice of the presentation of said account, and his application for final settlement, by publication, in the “Raymond Gazette,” a newspaper printed and published in the Town of Raymond, for the space of sixty days, citing the unknown heirs and distributees and all persons interested in said estate, to be and appear before this court at its next July term, 1848, to show cause, if any they can, why said administrator should not be allowed to make said final settlement as prayed, and be discharged from all other and further liability.

It’s Family Time~James David Sellers

James David Sellers, born about 1822, was the 3rd of 14 children born to Roland Sellers and his wife Margaret Eddins.

About 1845, James David married Sarah Ann Gaskins, age 19, daughter of Darling Monroe Gaskins and Mary Nelson. Over the next 12 years, James David and Sarah Ann would grow their family with the birth of four daughters and a son. By the time their youngest had turned 4; a war was on the horizon and James David enlisted on 13 April 1861 with Co. 'B', 8th SC Infantry. 

Six months after enlisting to serve in the Civil War, James David died from Typhoid Fever on 15 October 1861 in Richmond, Virginia.

Military records, online at Fold3.com, shows that Sarah Ann Sellers claimed the effects of her deceased husband on 11 March 1862.

I don’t know if James David Sellers body was returned home or not; but, there is a Confederate Grave Marker for James David Sellers in the Hopewell Baptist Church Cemetery, Chesterfield, South Carolina.

The Children of James David Sellers and Sarah Ann Gaskins are:
        i.    Queen M. Sellers was born on 1 Sep 1846 in Chesterfield, Chesterfield, South Carolina. Never married.
        ii.    Alexander Hossick Sellers was born in May 1850 in Chesterfield, Chesterfield, South Carolina. He died on 15 Jun 1926 at the age of 76 and was buried at Hopewell Baptist Church Cemetery.
         iii.    Eliza Ann Sellers, born 16 Oct 1854, Ruby, Chesterfield, South Carolina; married Joel H. Douglass; died 16 May 1941, Junction City, Union, Arkansas.
         iv.    Louisa Jane Sellers, born 10 Jul 1856, Chesterfield, Chesterfield, South Carolina; married William Jesse Jenkins, 1881; died 24 Jan 1938.
         v.    Mary E. Sellers, born 22 Mar 1857, Chesterfield, Chesterfield, South Carolina; married Abraham D. Catoe, abt 1879; died 7 Mar 1945, Valdosta, Lowndes, Georgia.


James David Sellers is my 1st Cousin 4 times removed.

Deciphering the 1880 Census Schedule

The below digital images have been extracted from the Ancestry.com website so that we may examine one particular family listed on this page.

Ancestry transcribers have transcribed this family as the A. T. and M. W. T. Powell family.
The problem is that there is no A. T and M. W.  T.  Powell family. For many years I have looked and re-looked at this family in an attempt to determine exactly who the member are with this household.

Recently, I was in touch with another Powell researcher, Marilyn, and our correspondence triggers a thought/memory that has finally solved the mystery of this Powell Family and how they connect with other Powell's in Chesterfield and Marlboro County, South Carolina.

First, Ancestry has transcribed this Census entry as A. T. Powell. Close examination of line 16 shows that the initials are W. T. Powell.

Thus my correction of this Census record is: 
*  Head of household:  W. T. Powell  [William Thomas Powell, son of Richard Thompson Powell].
*  Wife M. W. T. Powell is Mary W. Dixon Powell
*  W. T. Powell is William Thomas Powell [Son of William + Mary]
*  M. W. Powell is [un-identified Daughter of William and Mary]
*  Ellen Powell is [Sister of the Senior Wm. T.; daughter of Richard T. Powell]

Marriage of Josiah Sellers

Josiah Sellers was born about 1829 a son of Abigail Sellers; Husband Name unknown. Abigail Sellers, 61, was born in 1789 in Chesterfield, South Carolina.

1850 CENSUS: Chesterfield, Chesterfield, South Carolina; Roll: M432_851; Image: 357, Page: 176A + B (stamped); Line 42, Dwelling 1192, Family 1192; Abigail SELLARS, female, age 61, born in SC; Josiah SELLARS, male, age 21, born in SC and Aaron SELLARS, male, age 19, born in SC.

Abigail had two sons in her household in 1850; Josiah age 21 and Aaron, age 19.

Aaron served in the Civil War with the 6th Regiment South Carolina Cavalry Company D (Aiken's Partisan Rangers) (1st Partisan Rangers) CSA.

On 13 Feb 1861, Josiah married Clara Ann Ware in Santa Clare, California.

In the 1870 Census, Josiah Sellers can be found in Alisal, Monterey, California.

On 27 October 1871, Josiah married Juanita Valencia in Monterey, California. I have no clue what happens to Clara Ann Ware.

Judgment Against Mary A. (Purvis) Dickson

Yesterday, I posted and discussed a lien that Mary A (Purvis) Dickson entered into with George W. Williams and Company.

Today’s post concerns a judgment against Mary A. (Purvis) Dickson issued on 14th September 1866.
Whereas, by virtue of an execution issued out of the Court of Common Pleas for the County of Chesterfield tested the 14th day of September in the year of our Lord one thousand eight hundred and sixty Six and returnable according to law directed to the Sheriff of Chesterfield County, and lodged in his office on the 14 day of October A. D. 1893 commanding him out of the personal and real property of Mary A. Dickson to satisfy a certain judgement which was rendered on the fourteenth day of September one thousand eight hundred and Sixty six in an action in the said Court between W. L. T. Prince administrator of John C. Coit deceased Plaintiff and Mary A. Dickson Defendant in favor of said Plaintiff against the said Defendant for the sum of Five Hundred and Fifty nine 10/100 Dollars as appears by the Judgement Roll filed in the Office of the Clerk of the Court of Common Pleas for said County, I have levied upon a certain tract of land in the County of Chesterfield aforesaid, herein after more particular described.

As shown in yesterdays post, this judgment is dated in the same year that a Bill for Injunction and settlement of the estate of Mary’s father John Purvis who had died 12 years earlier in Mar 1854.

John Purvis died intestate in March 1854, leaving his widow, Sarah Purvis and children: Mary A., widow of William B. Dickson; Charles G. Purvis; John C. Purvis; and Laura S. intermarried with James C. Craig. Additional information: The children of James C. and Laura Purvis Craig: Sallie P. Craig; John J. Craig; Alexander W. Craig; Laura E. Craig; Mollie A. Craig; Edgar Craig; Irene Craig; Leola Craig and James Craig who died at age 11. Alexander J. Purvis died 3 July 1860, leaving as his heir his mother and brothers + sisters; Sarah Purvis died intestate in April 1863; John C. Purvis died intestate 13 October 1864, leaving as his heirs Laura S. Craig, Mary A. Dickson, and Charles G. Purvis.


My first inclination was that Mary had defaulted on her lien and the judgment levied in the within Deed was the results of that default. However, the judgment in this Land deed has nothing to do with the lien she executed on 20 March 1869.

On 14 October 1893, the Sheriff of Chesterfield County was issued an execution order by the courts on the personal and real property of Mary A. (Purvis) Dickson to satisfy a certain judgement which was rendered on the fourteenth day of September one thousand eight hundred and Sixty six in an action in the said Court between W. L. T. Prince administrator of John C. Coit deceased Plaintiff and Mary A. Dickson Defendant in favor of said Plaintiff against the said Defendant for the sum of five Hundred and Fifty nine 10/100 Dollars.

The following was action was taken to satisfy this execution order:
Now Know ye, That I, D. B. Douglass Sheriff as aforesaid, by virtue of the said Execution, Levy and Sale, and by the Statute in such case made and provided, and for and in consideration of the said sum of four Hundred dollars to me in hands paid, or secured to be paid according to the terms of the said sale, Have granted, bargained and sold, and by these presents Do Grant bargain, sell and convey unto the said W. F. Stevenson as trustee as aforesaid his Heirs and assigns forever All that certain piece, parcel or tract of land situate lying and being in the County of Chesterfield State of South Carolina, lying on both sides of Thompson creek about four miles from the town of Cheraw on the Camden road containing eighteen Hundred acres more or less (1800) being the land allotted to said Mary A. Dickson in the partition of the lands of John Purvis deceased about the 9th of November 1864.

Because of loss of records, we have no knowledge as to how much land each of the three surviving children received but I’m betting that 1800 acres are ALL of the lands that Mary A. Dickson inherited from her father.

It is not known when Mary A. (Purvis) Dickson passed away but she is not enumerated in the 1900 Chesterfield County Census. The above court order issued on 14 October 1893 suggests that at that time Mary A. (Purvis) Dickson was alive and well. Therefore, she must have passed away sometime between 14 Oct 1893 and June 1900.

Mrs. Mary A. Dickson to George W. Williams + Co. Lien

Mary A. Purvis was the daughter of John Purvis and Sarah McMillian. John Purvis was a large land owner in Chesterfield County.

About 1836, Mary A. Purvis married William B. Dickson. Almost immediately after marriage, they moved to Hinds County, Mississippi. Their first child was born in 1837 and the 1850 Census states that she was born in Mississippi. By 1850, Mary with 5 children is back living with her parents in Chesterfield and she is listed as a widow.

In Mar 1854, her Father, John Purvis passed away.

When the estate was settled about 1866, Sarah and two more of her children had passed away and only 3 siblings remained -  Laura S. Craig, Mary A. Dickson, and Charles G. Purvis.

On 20 March 1869, Mary A (Purvis) Dickson executed a lien on her property for $150.00 in order to obtain supplies to be used and expended on the planting of said plantation and cultivation of the Soil.

She agreed to pay 12% interest per annum

She agreed that all crops would be sent to the lender (George W. William and Co.) so that he could sell them at a commission.

She agreed to pay the loan/lien off by 15 November 1869.

The State of South Carolina
             Memorandum of agreement made and entered into this twentieth day of March in the year of our Lord one thousand eight hundred and Sixty nine between  George W. Williams, Edward C. Williams, James M. Taylor, William Birarie, Edward Platt, Joseph R. Robertson and James Bridge Jr doing business and trading under the name and style of George W. William + Co. of the State aforesaid of the first part and Mrs. Mary A. Dickson resident of the County of Chesterfield State of aforesaid of the second part.
First, The parties of the first part agrees with the party of the second part who is engaged in the cultivation of the soil upon a plantation in same County and State 4 miles west of Cheraw to make advances to him during the current year in money or supplies to be used and expended on the planting of said plantation and cultivation of the Soil the said advances not to exceeds in all the sum of One hundred and fifty Dollars the said party of the second part first giving to the party of the first part a lien on the Crops which may be made during this year upon the lands in the cultivation of which the advances so made shall have been expended in preference a full liens existing or otherwise to the extent of such advances with interest thereon at the rate of Twelve (12) per cent per annum in accordance with the provisions of the Act of Assembly of the said state in such case made and provided.
Second, the party of the Second part covenants and agrees with the parties of the first part in consideration of the advances so made and to be made by them to him that he will expended and apply the whole of said advances in and upon the planting and cultivation of his plantation in in <sic> which he is now engaged and for and in consideration of the premises the said party of the second part hath given and granted and by these presents doth give and grant to the said parties of the first part and to the Survivor or Survivors of them and the Executors and administrators or assigns of such Survivor a lien on the entire crop which shall or may be made during the current year upon the land in the cultivation of which the advances so made by the party of the first part shall be expended, in preference to all others liens existing or otherwise to the extent and amount of such advances together with interest thereon at the rate of twelve (12) per cent per annum in accordance with the provisions of the Act of Assembly of the said State entitled "An Act to secure advances for agricultural purposes" ratified on the twenty-fifth day of September eighteen hundred and Sixty-Six and subject to all the powers, conditions and provisions therein contained.
Third The party of the second part covenants and agrees with the parties of the first part on consideration of the advances so made and to be made by them to him that he will send to them for sale on commission the entire crop of cotton made on said plantation and in default thereof that he will pay to them a commission of two and one half percent on the estimated value of every bale of cotton not sent to them for Sale And further the party of the second part gives the party of the first part a lien on the entire crop for said commission in the same manner as far advances previously named.
Fourth The party of the Second part obligates to send to the partied of the first part sufficient Cotton to pay all advances prior to 15th November next In testimony whereof the parties hereto have hereunder set their hands the day and years first above written.

Was this lien redeemed? It's unclear whether it was redeemed. A common practice during this time was to annotate along the edges of the document whether the lien was redeemed or in default. There is no annotation on this lien.

Tomorrow we will look at another land deed and speculate on the impact of this Lien on the circumstance documented within the forthcoming land deed.

Amanuensis Monday~The Estate Lands of William Burkley

Amanuensis Monday is a genealogy blogging theme. It was started by John Newmark who writes the TransylvanianDutch blog.


His definition of Amanuensis is:
Amanuensis: A person employed to write what another dictates or to copy what has been written by another.



Today’s subject is a Chesterfield County, SC Land Deed from Mary E. Cato to Alexander Sellers, 1882.1


The land deed, transcribed below, clearly states that the land being sold was acquired by inheritance from the estate of William M. Burkley.

release unto the said Alexander Sellers all my right Title and interest in and to the Estate of William M. Burkley both real and personal the real being that piece parcel and tract of land Situate lying

The problem I have with this is the Will of William M. Burkley states that all his property both real and personal had been left to his Niece – Sarah Frances Hancock.

So which is it? Was both real and personal property left to the Sellers children or was it left to Sarah Frances Hancock? The Land Deed seems to suggest the Will was not carried out as written.

Burkley both real and personal the real being that piece parcel and tract of land Situate lying and being in the County of Chesterfield on the North Side of the public road leading from Chesterfield Court House to Camden about three and a half miles from Said Court House. The same being a tract of land conveyed to Alexander Sellers, Queen M. Sellers, Louiza J. Sellers, and Mary E. Sellers by the last Will of William M. Burkley deceased. Estate of James Purvis, Sr.~Inventory and Appraisement

I have written about James F. Purvis, Sr. b. abt 1760 several times. About 1818 James along with other brothers, most notably Gilbert  Purvis, moved from Chesterfield County, South Carolina to the Hinds and Simpson County area of Mississippi after stopping off in Clarke County, Alabama for a short time.
