Amanuensis Monday – Apprenticeship of Holifield Children (1868-1871)

Amanuensis Monday is a genealogy blogging theme. It was started by John Newmark who writes the TransylvanianDutch blog.
His definition of Amanuensis is:
Amanuensis: A person employed to write what another dictates or to copy what has been written by another.
Today’s subject is the apprenticeship of Milley, Ransom and Miles Holifield.  But first some background information.
The three children’s named within this apprenticeship case are sons and daughters of James Holifield and his wife Lucinda Sims.
James is the son of Moses Holifield and Emillia “Milly” Rivers Holifield.
Moses Holifield (1800-1870+) married Emillia "Milly" RIVERS back in Chesterfield, SC and migrated to Jones County Mississippi between 1830-1840.

Mark Rivers is Milly Rivers brother and he migrated with them or shortly after. He married Irena Catherine Hancock in Feb 1840 in Chesterfield (From Divorce Documents, copies of entire case in my files).

Milly & Mark also has a brother Luke Rivers married to Mary Salina Johns in the 1850 Census for Chesterfield County, 1860 Census for Jones County.

Mark & Catherine have no children before this apprenticeship they took care of some Driman/Dryman Children that are said to be nieces & nephews and I haven't connected yet.

In 1850 Mark filed for Divorce from Catherine for Adultery and it was granted.[1] But in 1860 they are back together.

This Court action is very surprising. I thought Mark & Catherine were divorced in 1859.

Catherine married George S. Fagan on 8 Sept 1879 in Choctaw Co.

Know all men by these presents that we     Rivers are held and firmly bound unto Bob Glover Judge of the Probate Court for said County and his successors in Office in the penal sum of nine hundred dollars for the true payment of which We bind ourselves our heirs’ executors and administrators jointly and sever ably by these presents sealed with our Seals and dated 20 Day of September 1871. The condition of the above obligation is such that whereas the said Bob Glover Judge as aforesaid have this day apprenticed to the above  bound      Rivers the following minors to wit: Milley Holifield aged twelve years Ransom Holifield aged ten years and Miles Holifield aged eight years who are orphans until they are twenty one years of age now if the Said     Rivers, shall at all times furnish said minors, with sufficient food and clothing treat them  humanly furnish them medical attendance when sick teach then or cause them to be taught to read and write and Cypher as far as the rule of law, and will conform to any law that may be passed here after, for the regulation of the duties of Master and Apprentice then this obligation to be void otherwise will to remain in full force & effect.

The last paragraph of this Court action is dated September 1871; Catherine married George Fagan Sept 1879. Mark Rivers was not found in the 1880 Census. It is believed that Mark Rivers died between 1871-1879 and this most likely made the apprenticeship null & void. If so, there should be some additional court action after 1871 and before September 1879.

What Happen to John R. Brown and his wife Elizabeth Pigford?

Minnie Sanders Rivers in her genealogy of “The Rivers Family of Chesterfield County, SC, 1926” stated that John BROWN married a Miss PIGFORD and added this note:

John died at the age of 36. He and his wife died in a day or two of each other and were buried in same graveyard. [They] left six small children. The Mother's people took four of them and their Uncle Epps Brown took [the] two oldest.

Based on research this is what I have found.

John R. Brown married Elizabeth Pigford and had 6 children;
Martha J. Brown, b. abt 1838;
Adelaide Brown, b. abt 1842;
Thomas D. Brown, b. abt 1844;
Enoch Timothy Brown, b. abt 1846;
Catherine Brown, b. abt 1848
M. L. Brown, female, b. abt 1852.

John R. & Elizabeth are listed in the 1850 Census for Anderson County, Texas. If family folklore is correct and he died at age 36 then he mostly likely died in 1851 in Texas and Elizabeth died shortly afterwards.

1850 CENSUS:[1] Anderson County, Texas; Roll M432_908; Page: 15B; Image: 22, Line 12, Dwelling 101, Family 101; John R. BROWN, male, farmer, age 35, born in GA; Elizabeth BROWN, female, age 28, born in GA; Adelaide BROWN, female, age 7, born in MS; Martha J. BROWN, female, age 12, born in MS; Thomas P. BROWN, male, age 5, born in MS; Timothy BROWN, male, age 3, born in MS and Catherine BROWN, female, age 1, born in MS.

In 1860, I could find no record of John Brown and his wife Elizabeth Pigford. Two of their children – Enoch Timothy BROWN, age 14, born in MS and M. L. BROWN, age 8, born in TX, were living with Alford D. and Charity A. PIGFORD, In Lauderdale Co., Mississippi.

1860 CENSUS:[2] Marion, Lauderdale Co., MS; Series: M653, Roll: 585, Page: 261, Line 13; Dwelling 131 Family 130; A. D. PIGFORD, male, farmer, age 38, born in NC; Charity A. PIGFORD, female, age 32, born in AL; E. T. BROWN, male, age 14, born in MS and M. L. BROWN, female, age 8, born in TX.

Their older daughter, Martha J. BROWN was married to Andrew S. BRADLEY and living in Clarke Co., AL.

1860 CENSUS:[3] Grove Hill PO, Clarke Co., AL; Series: M653, Roll: 6, Page: 736, Line 31, Dwelling 1572, Family 1784; Andrew S. BRADLEY, male, Farmer, age 29, born in AL; Martha J. BRADLEY, female, age 22, born in MS; Thomas BRADLEY, male, age 5, born in MS; William W. BRADLEY, male, age 4, born in MS and Elizabeth BRADLEY, female, age 2, born in MS.

Their children – Thomas D. & Catherine were living with their Uncle Epps Rivers BROWN in Franklin Township, Union County Arkansas.

1860 CENSUS:[4] Union County Arkansas, Franklin Township, Page 316, Film #0803051, Dwelling 703, Family 657, Epps R. BROWN, Lawyer & Farmer, age 50, born GA; Dorinda BROWN, age 40, born AL; Sallie BROWN, age 16, born MS; Napoleon BROWN, age 15, born MS; Lafayette BROWN, age 13, born AR; Martha BROWN, age 10, born MS; Nancy BROWN, age 08, born AR; Lucy BROWN, age 06, born AR; Mollie BROWN, age 03, born AR; Lizzie BROWN, age 7/12, born AR; Sarah [RIVERS] BROWN, age 78, born SC; Thomas BROWN, age 16, born MS; Catherine BROWN, age 11, born MS.

This accounts for all of the children EXCEPT for Adelaide BROWN, daughter, b. abt 1842.

In 1870[5], Kate was with Martha J. Bradley and her children (Martha was a widow) in Lauderdale Co and Thomas D. Brown and his wife, Mary Blackwell were neighbors with Enoch Thomas Brown in their household.

Martha’s husband, Andrew most likely died during the Civil War; but, to date I have found no record.

1870 CENSUS:[6] Toomsuba PO, Lauderdale Co., MS; Series: M593, Roll: 735, Page: 61, Line 10, Dwelling 645, Family 645; Martha BRADLY, female, age 32, born in MS; Thomas BRADLY, male, age 15, born in MS; Alice BRADLY, female, age 12, born in MS; Mattie BRADLY, female, age 7, born in MS and Kate BROWN, female, age 22, born in MS.

1870 CENSUS:[7] Toomsuba PO, Lauderdale Co., MS; Series: M593, Roll: 735, Page: 61, Line 17, Dwelling 647, Family 647; Thomas D. BROWN, male, age 26, born in MS; Mary [Blackwell] BROWN, female, age 21, born in MS; Enoch T. BROWN, male, [Brother], age 24, born in MS.

I have looked at an index for Anderson County, Texas probate record and there is no listing for the Brown surname.

How could the parents of these children pass away and they get from Texas to Mississippi and Arkansas without some kind of probate action.

No cemetery record has been found for John R. and Elizabeth but this is to be expected; the minor children did not have any means of paying for burial or tombstone.

This couple is a real mystery that I hope one day to find exactly what happen to them while in Texas.

There's a real interesting deed on file in the Chesterfield County Courthouse between Lucy Brock and W. T. Powell.  After the death of Alsey and her son Pleasant, Lucy places all her property in trust for the benefit of her children and grandchildren.

DEED: Lucy BROCK to W. T. POWELL.
Lucy puts all of her property in trust with W. T. POWELL to hold the same for the benefit of her children. She refers to the natural love for her son Charles A. BROCK and his wife Sarah J. BROCK and Mary Kerry BROCK the child of Irvin S. BROCK. Ten ($10.00) dollars paid to W. T. POWELL and 3 lots (Lot #156, 157 and 158) in the Town of Cheraw to be placed in trust. One was the lot where her son Pleasant A. BROCK resided at the time of his death (d. 28 Feb. 1873). W. T. POWELL shall hold the same for the use and benefit of Charles A. BROCK, his wife Sarah J. BROCK and Mary Nezzie BROCK, the child of Irvin S. BROCK, living with Charles A. BROCK and Sarah J. Brock.

If Charles and Sarah should not have children then at their death to pass to Mary Kezzie BROCK, and if she is not living to pass to SARAH BROCK, the widow of Hezekiah BROCK.[2]

Military Monday – David Richard Teal

David Richard Teal's Civil War Record[1] can be found on Fold3.com , a paid subscription website. His entire record consists of 6 pages /image one of which page one is an Index page.

He enlisted on January 1, 1864, very late into the War.  He enlisted as a Private into Co. E, 21st South Carolina Volunteers Infantry. This was Capt. Benjamin T. Davis outfit and many of his friend's neighbors and cousins were members of this unit.  He enlisted for 3 years and the January –February Muster Roil showed him due a $50.00 bounty.

The next image is a Muster Roll for April 30 - August 31, 1864 - This image showed that he was furlough 1 Sept. 1964 and again indicated he was due a $50.00 bounty.

Image 5 is a Muster Roll for Sept-Oct 1864 – shows David absent without and still due a bounty of $50.00.

Only two additional images remains and they are displayed below

Image 5 – Shows David Richard Teal as a Prisoner of War (POW) at Point Lookout, Maryland.

He was captured on March 4, 1865 in Chesterfield, SC.   This is very important. March the 4th 1865 was the day that Gen. Sherman Union forces entered the town of Chesterfield destroying everything and burning the Courthouse to the ground.  This is the second record that I have examined where Chesterfield men were captured at home on 4 March and imprisoned as POW's. The first was my second great grandfather Hezekiah Brock.

David Richard Teal made it back home from Point Lookout and Married Nancy J. Davis, daughter of John Calvin Davis and Charlotte Hurst.  David and Nancy had 6 children; 5 daughters and a son. Nancy J. Davis Teal died in 1895[2] (date on Tombstone) and David Richard Teal remarried in 1897 to Lucinda Caulder; they had 4 children, 2 sons and 2 daughters.

Finally, Image 6 is the Oath of allegiance that David Richard teal signed upon his release from Point Lookout, Maryland on 21 June 1865.
