From Wedded Bliss to Separation


SEPARATION AGREEMENT BETWEEN JACOB GAINEY AND SARAH [KENDRICKS-JACKSON] GAINEY OF CHESTERFIELD DISTRICT, 1826

Know all men these Presents that I Jacob Gainey of the District and State aforesaid in consequence of a Separation having taken place between myself and my wife Sarah Gainey and for the purpose of providing for the future maintenance of my said wife and also in consideration of the sum of  five Dollars to me in hand paid by John Evans  & Hugh Craig of the  District and State, Have bargained, Sold quit claimed and  released unto the said John Evans and Hugh Craig in trust for the said Sarah and for the use and benefit of the said Sarah Gainey (viz) One tract of land containing twenty two acres more or less conveyed to me by Richard Knight by deed dated the 20th day of April 1815.  Also one other tract conveyed to me by Flora McDonald and others dated 25th day of February 1815 & recorded in Book No. 6, Pages 124, 125 for one hundred acres more or less. Also one other tract of land containing one hundred acres more or less conveyed to me by Andah Burges by deed of Conveyance dated the 8th day of Febr, 1822. Also the following negroes, Sooky, Nelson,  Amy and Eliza together with all the Household furniture (with the exception of one Bed, one pot, one oven and table) one sorrel Horse, One half of the Stock of all kinds, consisting of Hogs & Cattle & Sheep. One riding chair, One cart, one half of the Corn & Wheat of this years Crop, which above mentioned property, the rents, issues and profits and services of the same, or any part thereof, I do hereby renounce release and forever quit claim unto the said John Evans & Hugh Craig in trust as aforesaid and that they the said John Evans and Hugh Craig, shall permit and suffer my said Wife, to enjoy the rents, issues, profits uses and services of the same, without the same being In any manner subject to my debts, contracts, disposal or control, And I do hereby bind myself to warrant and defend the above mentioned property to the said John Evans and Hugh Craig in trust as aforesaid.....Witness my hand & seal the twenty sixth day of April in this year of our Lord one thousand eight hundred and twenty six and in the fiftieth year of the sovereignty & Independence of the United States of America.
