Amanuensis Monday~Mark Huneycutt to Tobias A. Huneycutt

Today’s subject is a land deed from Mark Huneycutt to his oldest son, Tobias A. Huneycutt.1
Mark Huneycutt to Tobias A. Huneycutt
This indenture made on the 18th day of April in the year of our Lord one thousand eight hundred & forty nine between Mark Huneycutt of the county of Stanly and state of North Carolina of the first part & Tobias A. Huneycutt of the county and state aforesaid of the second part and Mathias Furr of the county & state aforesaid of the third part Witnefseth that whereas the said Mark Huneycutt is justly indebted to the said Mathias Furr in the sum of Twenty dollars due by note and whereas the said Mark Huneycutt is honestly desirous to secure the payment of the said debt. Now therefore this indenture witnefseth that for and in consideration of the premises together with the further consideration of one dollar to the said Mark Huneycutt in hand paid by the said Tobias A. Huneycutt the receipt whereof is hereby acknowledged he the said Mark Huneycutt hath bargained granted & sold and by these presents doth grant bargain and sell unto the said Tobias A. Huneycutt a certain parcel or tract of land lying and being in the county & state aforesaid on the waters of Stoney Run Creek containing about one hundred acres adjoining the lands of Leonard Tucker and others and more fully described in a grant to Mark Huneycutt bearing date the 28th day of Sep 1848 to have and to hold the said lands & tenements and the appurtenances there unto belonging or in anywise appertaining to him the said Tobias A. Huneycutt his heirs and afsigns in fee simple forever … and discharged of any and all encumbrances whatsoever in special trust and confidence Witnefseth that the said Tobias A. Huneycutt shall and will hold keep use and apply the same to use and intent following and no other that is to say if the aforesaid debts and every part thereof shall not be fully paid off and satisfied on or before the 1st day of January A. D. 1850 then and in that case it shall be lawful and shall be the duty of the said Tobias A. Huneycutt being thereunto required by the said Mathias Furr having first advertised the same at the Court house in Albemarle and three other public [places] within the county of Stanly for the space of twenty days to proceed to sell the said land and premises at public to the heist <sis> bider <sic> and convey the same by proper assurances to the purchaser and out of the money arising from said sale to retain all necessary expenses of his trust or such part thereof as shall remain unpaid at the time of said sale and the over plus if any he the said Tobias A. Huneycutt shall well and truly return to the said Mark Huneycutt his executors and administrators In testimony whereof we have here unto set out hands and affixed our seals the year and date just above written.

On Sept.. 28, 1848, the State of North Carolina provided Mark Huneycutt with a Land Grant (#151) of 100 acres on Stoney Run Creek.2 Now on the 18th of April 1849 Mark is selling this land (100 acres) to his oldest son (Tobias) to clear up a $20.00 dollar debt to Mathias Furr.
