Amanuensis Monday~Last Will and Testament, Noah Sides

Today’s subject is the Last Will and Testament, Noah Sides, 1904.

Noah Sides was born in Jan 1826, a son of Daniel Sides and Esther Dry. He was a single farmer, born in Cabarrus County. His father, Daniel Sides, moved the family to Iredell County before 1850.  

Noah, age 85, died on 26 Feb 1911 in Iredell County, North Carolina. His younger brother James M. Sides and a nephew Nelson Alexander Lewis were co-executors of his estate.

His estate was quite  lengthy and complex. His probate folders can be viewed here:

North Carolina,
Iredell County.
I, Noah Sides of the aforesaid county and state, being of sound mind but considering the uncertainty of my earthly existence, do make and declare this my last will and testament.
First.
My executor hereinafter named shall give my body a decent burial, suitable to the wishes of my friends and relatives, pay all funeral expenses, together with all my just debts out of the first money which may come into their hands belonging to my estate.
Second.
I will devise and bequeath to my brothers A. A. Sides, J. M. Sides and my sisters Carolina L. Sides, Elizabeth C. Sides, Adaline E. Lewis, Sarah E. Sides, Margaret S. Sides during their natural lives, all my property of every description, consisting of lands and personal property, wheresoever situated, and at the death of either and each of said brothers and sisters the interest and estate herein devised and bequeathed shall at once rest in my remaining brothers and sisters for life only.
Third.
At the death of my brothers and sisters, each and all of them, then I will and bequeath said property to be divided as follows:
                To my nephew N. A. Lewis, I will and bequeath one third thereof to be his in fee simple and forever; to my niece Prudence V. Lewis one third thereof, but in the event of her death before she comes into the possession thereof, then I will and bequeath said one third to N. A. Lewis and my grandnephews J. G. Lewis and Henry E. Lewis equally, and the remaining one third I will and bequeath to John G. Lewis and Henry E. Lewis.
Fourth.
In the event of the death of either John G. Lewis or Henry E. Lewis without issue, then the part herein bequeathed to each shall become and belong to the survivor in fee simple and forever.
Fifth.
In the event J. G. Lewis or H. E. Lewis shall die before coming into the possession of my property as above set forth then I will and bequeath all their interest to N. A. Lewis in fee simple and forever.
Sixth.
I hereby constitute and appoint J. M. Sides N. A. Lewis my lawful executors to all intents and purposes to execute this my last will and testament, hereby revoking and rendering null and void all wills made prior hereto.
                In witness whereof I the said Noah Sides do hereunto set my hand and seal this the Jan. 16th 1904.

                A paper-writing purporting to be the last will and testament o of Noah Sides,deceased, is exhibited before me, the undersigned, Clerk Superior Court for said county by N. A. Lewis and J. M. Sides, the executors therein mentioned,and the due execution thereof by the said Noah Sides is duly proven by the oath and examination of J. H. White, and T. F. White, the subscribing witnesses thereto; who being duly sworn, doth depose and say and each for himself deposeth and saith that he is a subscribing witness to the paper-writing now shown him,  purporting to be the last will and testament of Noah Sides, deceased, that the said Noah sides in the presence of this deponent subscribed his name at the end of said paper-writing now shown as aforesaid and which bears date the 16th day of January 1904.
                And the deponent further saith, that the said Noah Sides testator aforesaid, did, at the time of subscribing his name as aforesaid, declare the said paper-writing so subscribed by him and exhibited, to be his last will and testament, and this deponent did thereupon subscribe his name to the end of said last will as an attesting witness thereto, and at the request and in the presence of the said testator. And this deponent further saith that at the said time when the said testator subscribed his name to the end of the said last will and testament as aforesaid and when deponent subscribed his name to the said last will as an attesting witness thereto as aforesaid the said Noah Sides was of sound mind and memory of full age to execute a will and was not under and restraint to the knowledge,information or belief of this deponent.  And further these deponent say not.

George R. Boatwright

This estate folder begins at image #742 and ends with image #760. (images 742-760)

George R. Boatwright was born 19 Jan 1819, a son of  Lewis Boatwright, Jr. and Elizabeth Rebecca Davis.

About 1852, he married Lauretta Hurst, b. 1831, a daughter of Isaac Hurst and Henrietta ‘Ritta’ Rivers. To this union were borne 6 children; 4 daughters and two sons.

George R. Boatwright died 9 April 1894 leaving a modest estate consisting of both real and personal property. His son Drury L. Boatwright was the Executor of the estate. 

Permission was received from the court to sell the personal property most likely because Lauretta had predeceased her husband. All the personal property was sold on 30 April 1894. The list of buyers at this sale is most interesting and I highly recommend you review the property list.

George also left a Will directing how his property was to be distributed. You can read his will at this link:

George and Lauretta are buried in the Hurst Family Cemetery, Chesterfield, South Carolina.

It’s Family Time~Phillip and Mary Gulledge Sellers

Phillip Sellers, Jr. son of Phillip Sellers Sr. and his wife Mary [LNU] was born about 1795 in Chesterfield County, South Carolina. He was their 4th child. Phillip Jr. had 8 brothers and no known sisters. 

In the mid-1820’s, Phillip Sellers, Jr. married Mary E. ‘Polly’ Gulledge, daughter of the Rev. Joel Gulledge and his wife Zilphia Huntley.  To this union were born 5 children; 2 daughters and 3 sons. 

Phillip was a farmer in Chesterfield and Anson County and left his Widow, Mary, a farm of two hundred and sixty eight (268) acres. 
 
Phillip died sometime before 1850. His wife, Mary passed away on 31 August 1875. She left a Will naming her children and how the property was to be divided.

Philip Sellers and Mary E. Gulledge had the following children:
 
i. Mary Frances Sellers, born 1824, Chesterfield, Chesterfield, South Carolina; married James Rex Moore Jr., abt 1846; died 1875.
ii. Phillip A. Sellers, born abt 1829, Chesterfield, Chesterfield, South Carolina; married Viny Phillips, 8 Mar 1860, Anson County, North Carolina; died 10 Aug 1862 in the Civil War at Petersburg, Virginia.
iii. Joel Sellers, born Jun 1831, Chesterfield, Chesterfield, South Carolina; married Rachel Phillips, 1865, Anson County, North Carolina; died bef 15 Jul 1912, Anson County, North Carolina.
iv. Elijah Sellers was born in 1832 in Chesterfield, Chesterfield, South Carolina. Killed at South Mountain, Maryland, September 14, 1862.
v. Martha E. Sellers, born 15 Oct 1837, Chesterfield, Chesterfield, South Carolina; married Robert Alexander Moore, 1859; died 11 Jan 1916, Chesterfield, Chesterfield, South Carolina.

Phillip Sellers, Jr. is my 1st Cousin 4 times removed.

          I, Martha H. Davis, of Chesterfield County, South Carolina being of sound mind and disposing mind, memory and understanding, do make, ordain, publish and declare the following is my last will and Testament, revoking all former wills by me at any time made-
1st,.– It is my Will and desire that all my just debts, and burial  expenses be paid, and my grave suitably marked by my executors hereinafter named.
2nd:-
I will, devise and bequeath all my property, personal and real and mixed wherever situate to my son, Weldon Davis, and my daughter Bessie Davis (share and share alike) in fee simple absolute.

Martha Hannah Davis died 23 March 1926 and was buried in Peniel Cemetery, Chesterfield County, South Carolina. Only two children survive her; Weldon and Bessie Davis.

Martha Hannah Rushing Davis died 23 March 1926 in Chesterfield County, South Carolina. Martha married George W. Martin Davis, son of William Blakeney Davis and Mary Jane Martin in 1878 according to information provided for the 1900 census.

Martha and George W. had eight children between 1878 and August 1891; 4 daughters and 4 sons. At her death, in March 1926, only two children survived her; a son, Weldon and daughter Bessie.

John Wiley Honeycutt was born 16 January 1823 in Montgomery County, North Carolina. He was the first born child of my 3rd Great Grandparents, Marcus I. ‘Mark’ Huneycutt and Charity Dry. 

John Wiley and Betsy had five children; 3 sons and 2 daughters. Both John Wiley and Betsy died sometime between 1870 and 1880. No tombstones or record of death have been found as of today's date.
 
John Wiley Honeycutt is my 2nd Great Grand Uncle.

Exhibit A
Last Will and Testament of Daniel Sides
I Daniel Sides of the County of Iredell and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following that is to say:
First, That my executor hereinafter named shall provide for my body a decent burial suitable to the wishes of my relatives and friends, and pay all funeral expenses together with all my just debts whosoever and to whomsoever owing out of the moneys that may first come into hands as part or parcel of my estate.
Item. I   devise to my beloved wife Esther Sides all my real and personal property to have and to hold as long as she lives, then to be divided as hereinafter mentioned, and I further devise that Noah, A. A. & James M. Sides tend the farm and take care of all the family I may leave here at my death and pay all doctor bills, and if the said Noah, A. A. & James M. Sides do not tend the farm as above mentioned and take care of the family as above named then my wife Esther shall have power to rent to the highest bidder all the lands and apply the proceeds to the maintenance of the family.
Item. I devise and bequeath to my son J. W. Sides the North part of the Robin Potts tract of land beginning at the Thomas James corner thence to post oak corner not far from the James barn thence North to James M. Sharpe corner thence West to Mary Sharpe line thence South to the north edge of the timber south of the house he now lives in thence eats to the spring bench thence South to the beginning; And the remainder of the tract shall be left as it is if they the children can agree to keep it if not it shall be sold to the highest bidder and the money divided between the children living at the time of sale.
Item. I further devise that as long as the children remain single the place where I now reside shall be a common home for them all but if any of them shall marry them they the married ones shall look out for some other place.
Item. I further devise that if any of my children shall die without heirs their part shall go back to the other children living.
Item. I give and bequeath to my grandson William Sides fifty dollars to be paid to him at the expiration of three years after my death.
Item. I give and bequeath to my granddaughter Mary Sides twenty five dollars to be paid at the expiration of three years after my death.
Item. I give and bequeath to my grandson Lawrence C. Sides twenty five dollars to be paid to him at the expiration of three years after my death.
Item. I further devise that after the death of my wife Esther Sides all my lands except the home place shall be equally divided between my children living at my death, by a commission consisting of three disinterested men, and then each child’ slot shall be determined by drawing for it; and the home place shall remain a home for all the single members of the family as long as they shall live, if they choose to do so, and then be divided between the next of kin. 
Item. I further devise that at the death of my wife Esther Sides all the personal property be equally divided between my living children or in case they can’t agree then to be sold to the highest bidder and the proceeds divided equally among them.
And lastly, I do hereby constitute and appoint my sons, J. W. Sides, Noah Sides, A. A. Sides, and James M. Sides my lawful executors to all intents and purposes to execute this my last Will and testament according to the true intent and meaning of the same and every part and clause thereof hereby revoking and declaring utterly void all other wills and testaments by me heretofore made.
            In witness whereof I the said Daniel Sides do hereunto set my hand and seal this 9th day of January 1880.

Daniel Sides borne 1806 died shortly before April 1881. His Will and Estate, largely real property, was probated in April 1881. He married Esther Dry daughter of Johann Martin Dry and Catherine Keppel.
Daniel and Esther had a large family of 12 children; 7 sons and 5 daughters. 
No tombstone have been found for Daniel or his wife Esther. A specific death date was not included in his probate file.

 
Daniel Sides is the husband of my 3rd Great  Grand Aunt, Esther Dry Sides.

Treasure Chest Thursday~Daniel Sides and Esther Dry Marriage Record, 1823.

Esther Dry, daughter of Johann Martin Dry and Catherine Keppel married Daniel Sides, son of Christopher Sides and Mary Esther Lipe on 20 December 1823 in Cabarrus County, North Carolina.¹ 
 
Daniel and Esther would raise a  large family of 12 children; 7 sons and 5 daughters. They and their children can be found in Censuses for Cabarrus County North Carolina for 1830 through 1880. 
 
The 1880 census is that last Census in which Daniel and Esther were enumerated.²

No tombstones or obituary has been found. I did find a Probate File in Iredell County which indicates that Daniel Sides died sometime before 19 April 1881 and at that time Esther was still living.³

Wednesday’s Child~Jackson McNair

The Cheraw Gazette of the 26^th inst., says:

“We are pained to learn that Jackson McNair, a son of Alexander McNair, Esq., of this District, was killed on Monday last, by the falling of a tree. It appears that McNair and his son were in a field pulling fodder, when the accident occurred.”

Jackson McNair was a young man of 21-22 years of age in 1854. I calculate "Monday last" to be 18 September 1854 for the date of the accident.

John Calvin Purvis was a son of James Francis Purvis and Lucy Pearl Deese. He married Alice Morton in 1938. 

Uncle John was a fine man and I will always remember him. He was quite a character and you always knew where you stood with John.

Amanuensis Monday~Guardianship of Jas. K. & E. B. Smith

Amanuensis Monday is a genealogy blogging theme. It was started by John Newmark who writes the TransylvanianDutch blog.

His definition of Amanuensis is:
Amanuensis: A person employed to write what another dictates or to copy what has been written by another.

Today’s subject is the Guardianship of Jas. K. & E. B. Smith.¹

Shortly before 3 January 1890, James K. Smith and his brother Elisha Brown Smith, Jr. submitted a request to the Courts for the the appointment of a Guardian. This request is rather strange in that both of these boys were approaching the age of majority. James K. Smith, born March 1870 was approaching his 20th birthday and E. B. Smith, born July 1872 was almost 18 years of age.

Their Father E. B. Smith, Sr., died in 11 January 1873 and their Mother passed away 19 July 1874 leaving both of these boys without parents while they were still infants. 

What prompted this request to be made so late? Seems to me it was more appropriate to submit the request back in July 1874 when their only living parent passed away.

Whereas, Jas. K. Smith & E. B. Smith heirs at Law of Estate E. B. Smith late of Chesterfield County deceased is a minors entitles to a share in estate of E. B. Smith applied to me to appoint Jesse C. Smith to be their Guardian.
For the better securing the said estate for the benefit of the said minors and for the more careful maintenance and education, I do hereby commit the tuition, guardianship and education of the said Jas. K. Smith & E. B. Smith to you, the said Jesse C. Smith charging you to maintain them in meat, drink, washing, lodging, clothing, and such good education as may be fitting according to the circumstances of interest of the said Jas. K. Smith & E. B. Smith during their minority, take charge of their estate, do such things as a Guardian should, and render a true and faithful account of the said estate, and of your management thereof, when thereunto duly required.
Given under my Hand and seal, this Third day of January in the year of our Lord one thousand eight hundred and ninety and in the 114 year of the Independence of the United States of America.

E. B. Smith, Sr. was married to Delilah M. Wallace about 1844. At their death they were the parents of 11 Children; 3 daughters and 8 sons. One daughter, Frances died at the age of 12 in October 1863.

This is a new series of posting, appearing every Sunday, on selected Estate Folders from the Estate files of Chesterfield County. No known estates exist for the period before the Civil War. They were destroyed with the burning of the Courthouse. There are a few “Equity Records” in the State Archives. ----The State of South Carolina ----

I Archibald McQuaige of the District of Chesterfield and State aforesaid do make publish and declare this my last Will and Testament in manner and form following that is to say –
First—I will and desire that all my just debts and funeral expenses be paid out of my Estate—
Second—I give and bequeath to my wife Catherine the whole of my estate, after the payment of my debts and funeral expenses, both real and personal consisting of the tract of land whereon I now reside, lying on both sides of the road leading to Wadesborough, containing about three hundred and thirty there acres and stock of cattle, Horses Hogs Sheep Plantation tools Household and Kitchen furniture for and during the term of her natural life, and at her death, as follows, to wit---
To my son Farquar McQuaig I give that part of my real estate which lies on the East and North side of the road leading to Wadesborough, it being about the one half of the tract upon which I now reside and which I have given to my wife for life, to him and his heirs forever.
To my son Colon McQuaig I give that part of my real estate which lies on the West and South side of the road leading to Wadesborough, it being the remaining one half of the same tract, to him and his heirs forever.
I give unto my sons Farquar and Colon the whole of my personal property of all kinds whatsoever which remains at the death of my wife, to be equally divided between them. On the condition that they pay to each of my daughters to wit – Margaret May, Pamela Crawford, Abigail Melton and Mary Stroud the sum of ten dollars which I intend to be their portion of my estate
Third – I constitute and appoint my wife Catherine, Executrix and my son Colon executor of this my Last Will and testament.
In testimony whereof I have hereunto set my hand and seal this twenty second day of August in the year of Our Lord one thousand eight hundred and fifty eight.

in the presence of us who at his request
and in the presence of each other have
hereunto affixed our names as witnesses thereto.
 

Archibald McQuaige estate file (Probate Folder #27) does not show as exact date for his death.
His Last Will and Testaments is dated 22 August 1858.
He was alive in 1860 when the 1860 Census were enumerated in Chesterfield County, South Carolina (7 July 1860)

1860 CENSUS: Chesterfield, South Carolina; Roll: M653_1217; Image: 264; Family History Library Film: 805217, Page: 130 (stamped); Line 35, Dwelling 523, Family 522; Archd McQUAGE, male, age 76, born in NC and Catherine McQUAGE, Female, age 71, born in SC.
 
The earliest date of documents within the estate folder are dated 5 September 1887. I believed that Archibald died much earlier than that and something (probably the sale of his land) resulted in the necessity to probate his estate.
 
Archibald and Catherine had at least 7 children; six of these children are named above in his Will.
i.    Pamela McQuaige, born Jul 1818; married Stephen Crawford; died 1901.
ii.    Mary McQuaige, born abt 1823; married Calvin C. Stroud.
iii.   Colon McQuaige was born about 1825.
iv.   Farquar McQuaige was born about 1827.
v.    Margaret McQuaige was born (date unknown). Margaret May
vi.   Abigail McQuaige was born (date unknown). Abigail Melton
vii.   Daniel McQuaige was born about 1833.(died before his father wrote his will in August 1858?)
