Petition to Probate~Last Will and Testament William Franklin Brock

As documented within this petition, William Franklin Brock, son of Valentine "Vol" Brock and Bethany Ginn Brock passed away on 21 August 1910 leaving a small personal and real estate.  His Widow, Cynthia E. Alford Brock petitioned the Courts for administration of the estate.

William Franklin Brock was twice married. His first wife was Sarah Brumfield with whom he had three known daughters. His second marriage was to Cynthia E. Alford on 11 December 1871. To this union was born seven children; 2 daughter and 5 sons.

To the Hon. J. S. Hicks, Chancellor Fourth Chancery District of Mississippi, and holding Sessions in and for the County of Pike, at Magnolia:
Your petitioner, Mrs. Synthia Brock, a resident and citizen of the County of Pike, state of Mississippi, with respect shows unto the court that on the 21 day of Aug., 1910, W. F. Brock, late a resident of said County, departed this life leaving a last will and testament duly signed, published and attested and which petitioner, in pursuance of the statue, herewith presents to your Honor for probate. That said will is duly subscribed by Dr. J. S. Brock, Clyde Brock, and W. H. McDaniel as witnesses to the signature and publication thereof.
Petitioner shows that all of said subscribing witnesses mow resigns in the County of Pike, and this affidavit of said witnesses to the signature and publication of said last will and testament is hereto attached and made a part of this petition.
Petitioner shows that at the time of the making and publishing said last will and testament, the said testator was over the age of 21 years, of sound and disposing mind and memory, and died seized and possessed of a small personal and real estate located in Pike County, where testator had a fixed place of residence.
Petitioner shows that no executor is named or appointed in said will, as same shows on its face, and that no administration upon the estate of said testator is necessary as far as she is advised and believes, petitioner bring the widow of said testator and dole legatee thereunder. In consideration whereof and to the and that said last will and testament may in all things be executed according to the true intent and meaning thereof, petitioner prays that the probate of said will be granted and the same be ordered for record, and if petitioner has not prayed for the proper relief, then she prays for such other, further and general relief, as in equity she may be entitled to, etc.

Catherine Brock was born Mar 1837 in Chesterfield County, South Carolina, a daughter of Squire H. Brock and Rachel Parker.

She married William L. Davis on 2 March 1857 in Chesterfield County, South Carolina. In late 1869 or early 1870, William and Catherine moved to Duval County, Florida where they settled for the rest of their lives.

DAVIS, age 40, Laborer, born in NC; Catherine DAVIS, age 35, born in SC; Theodore M. DAVIS, age 12, born in SC; Cecilia J. DAVIS, age 10, born in SC; Richard M. DAVIS, age 05, born in SC; Louisa A. DAVIS, age 02, born in SC.

They reared 7 children; 5 sons and 2 daughters. William was killed, when struck by lightning, in July 1891 and Catherine passed away in July 1917.

Catherine Brock Davis is my 1st Cousin 4 times removed.

Today’s subject is a Trust Deed from W. A. Pervis to Marshall + Richardson, 1878.1

State of North Carolina}
County of Anson } I, W. A. Pervis of the county of Anson in the State of North Carolina am indebted to Marshall & Richardson of the county of Anson and state aforesaid in the sum of one hundred dollars for which they hold my note to be due on the 15th day of Oct. A.D. 1878 and to secure the payment of the same I do hereby convey to him these articles of personal property to wit: (1) one bay mare, (1) wagon (1 horse), 12 head of hogs, (8) eight head of cattle, household furniture, farming tools &c. But on this special trust that if I fail to pay said debt and interest on or before the 15th day of Oct. A.D. 1878 then they may sell said property or so much thereof as may be necessary by public auction for cash, first giving twenty days notice at three public places and apply the proceeds of such sale to the discharge of said debt and interest in the same, and pay any surplus to me, given under my hand and seal this 1st day of March A.D. 1878.

Great Grandfather Purvis used personal property to secure a loan for One Hundred ($100.00) dollars. He needed the money to buy seed and fertilizer to enable the planting of crops for another season. The Note was due on 15 October 1878.

W. A. Pervis/Purvis is my 2nd Great Grandfather.

It's Family Time~James Brock and Martha Jane Teal


James Brock was born 19 October 1822, a son of Benjamin Brock and Temperance [LNU] of Chesterfield County, South Carolina. He had six siblings; 5 brothers and a sister.

James married Martha Jane Teal, daughter of William Teal and Isabella McRae about 1844. Their firstborn child, a son, William Daniel “Squire” Brock was born 27 April 1845.

Shortly after the birth of William Daniel, James and Martha along with Martha parents migrated to Barbour County, Alabama. Their next child, a daughter, Temperance A. Brock was born 30 December 1847 in Barbour County, Alabama. Over the next 25 years, James and Martha would add 12 more children to the family making a total of 14 children born to this union; five sons and nine daughters. Three of their children died rather young but the remainder lived long productive lives.

James acquired land which he farmed until his death in 1888. His wife, Martha Jane, passed away on 3 July 1886. Not quite two years later James passed away on 15 May 1888 at the age of 65. Both are buried in the Pea River Presbyterian Church Cemetery, Clio, Barbour County, Alabama.

James Brock tombstone online shows his death date as May 16, 1883. This is a misreading of the tombstone due to age. The last 8 in 1888 was misread as a three. Proof of this in a Barbour County Probate record.

The petition of the undersigned W. D. Brock respectfully represents that James Brock departed this life at his home in said County of Barbour on or about the 15th day of May 1888, leaving no last will or testament, so far as your petitioner knows or believes and that his death was known…

James Brock is a Great Grand Uncle.
