The Estate Lands of Marcus “Mark” Huneycutt
Marcus “Mark” Huneycutt is my 3rd Great Grandfather. He died sometime between 1860 and 1870. No record of his death or tombstone has been found as of this posting. The last known record of Mark is the 1860 Census for Stanly County, North Carolina.

FURR, female, [grand Daughter] age 9/12, born in NC.
Regardless of when he died his impact on his descendants was enormous. The settlement of his Estate lingered in the courts into the early 1900’s. By then all his children, except his son Martin Irensus Huneycutt, were deceased and the remnants of his estate (land) was sold and divided between his grandchildren and greet-grandchildren.
One of those recipients was Lucy Deese, my Grandmother and the Sr. great-granddaughter of Marcus “Mark” Huneycutt.
Back in August 2019, I shared a land deed, dated March 1911 that was the final disposition of the Marcus "Mark" Huneycutt Estate Lands.
Since that posting, I have found two other land deeds regarding the estate lands of Marcus “Mark” Huneycutt. Today’s land deed is from DEED BOOK 28, pages 481 & 482 and is titled - R. W. Simpson, Commr. to M. I. Huneycutt.
This M. I. Huneycutt is Martin Irenus Huneycutt, the son of Marcus Huneycutt, Sr. deceased.

This Deed, made by R.W. Simpson, Commissioner, under a Judgment of the Superior Court of said county, in the Special Proceeding entitled M. I. Huneycutt, B. L. Huneycutt, D. E. Huneycutt et. al. against A. J. Huneycutt, Lizzie Garibaldi et. al. to M. I. Huneycutt of Stanly County. Witnessseth: That whereas the said R. W. Simpson being thereto licensed by a Judgment in said Proceeding, did, on the First day of September, 1902, after due advertisement, expose the land hereinafter described to public sale at Court House door in Albemarle and then and there the said M. I. Huneycutt became the last and highest bidder for said land at the sum of Five Hundred & Ten Dollars, and complied with the terms of sale; and whereas upon report of said sale to said Court, the same was confirmed and the said R. W. Simpson, Commissioner as aforesaid was ordered by the Judgment of said Court to execute a Deed in fee simple to said purchaser, upon payment of said purchase money; and whereas, the said purchase money has been paid in full; Now, in consideration of the premises, the said R. W/ Simpson, Commissioner as aforesaid, doth hereby Bargain, sell and Convey to the said M. I. Huneycutt his heirs and assigns that certain parcel or tract of land situate in said County (page 482) adjoining the lands of Levi H. Huneycutt, Sam Hinson, Frank Whitley and others in Furr Township and bounded as follows: Beginning at a post oak, 2 red oaks, dogwood and pine in the Jas. L. Hartsell old line & runs with said line No. 75 Wt. 6 chs. to said Hartsells Corner on the bank of watery branch, thence the same course continued in all 25 chs. to a post O. by a post oak & 2 red O's; thence N. 10 Et. 60 chs. to a stake by a post oak & 2 red oaks, thence due east 35 chs. to a post O, by a red O & 2 black Jacks; thence So. 10 Wt. 30 chs to a post oak in a branch by 2 dog woods, a sweet gum & a pine; thence direct course to the beginning, known as the Mark I. Huneycutt lands containing Two Hundred acres, more or less.
To have and to hold said Land, with its appurtenances to him the said M. I. Huneycutt heirs and assigns forever, in as full and ample manner as said R. W. Simpson, Commissioner as aforesaid, is authorized and empowered to convey the same. In witness whereof, the said R. W. Simpson, Commissioners, etc., hath hereto set his hand and seal, this 9 day of April 1903.

The due execution of the foregoing and within deed was this the 9th day of April A.D. 1903 duly proven before me R. A. Crowell, Clerk Superior Court of Stanly County by the acknowledgment of R. W. The foregoing Deed was filed in this office for registration June 20th, 1903 at 4 o'clock P.M. and duly registered.

This deed is dated 9 April 1903. The Court appointed Commissioner, R. W. Simpson, has sold the land to “the said M. I. Huneycutt became the last and highest bidder for said land at the sum of Five Hundred & Ten Dollars, and complied with the terms of sale; and whereas upon report of said sale to said Court, the same was confirmed and the said R. W. Simpson, Commissioner as aforesaid was ordered by the Judgment of said Court to execute a Deed in fee simple to said purchaser,...”
This should have been the end of the probate but as shown above in my earlier posting some of the heirs-at-law brought suit and the final outcome lingered for another eight years until March 1911.
Marcus “Mark” Huneycutt is my 3rd Great Grandfather.
