The Bankruptcy of James Brock


Transcription:

Southern District of Mississippi

In the matter of the petition of James      | In Bankruptcy,  
Brock of Pike county, Mississippi,             |
to be declared a bankrupt and to be         |  No. 608
discharged from his debts.
NOTICE is herby given that JAMES BROCK of,
Pike County, Mississippi has filed his petition in this
Court to be declared a bankrupt and to be discharged
from his debts, under the act of Congress in such case
made and provided; and that an order had been duly en-
tered in this Court appointing the
                         20th day of February next,
at the court room in the City of Jackson, in the county of
Hinds, in this district, as the time and place for hearing
of said petition. All person interested may then and
there appear and show cause, if any they have, why the
prayers of the petitioner shall not be granted.

While I have no direct evidence that led to the bankruptcy of James Brock snippets about his life points to a possible explanation.

From the Book “19th Century Baptist Church Records of Marion and Pike Counties, Mississippi” by Bevin J. Creel –page 28 we find the following information. 

[The following is from book 3. 25 June 1853, G. C. Fortinberry stated the report that James Brock had been “taking a drunken frollick for several days.” The church appointed B. W. Leggiett, Uriah Bowman and Jeremiah Smith to cite him to attend. 23 July 1853, James Brock was present and said he would not acknowledge the charge, nor would he deny it “and requested the church to race his name from the book.” The church voted to exclude him from fellowship.]

page 23 - James Brock came forward with respect to a charge that he got drunk, used bad language and wanted to fight. He said as for getting drunk that he denied it though he had drank some several draws that day, and said if he used improper language he did not recollect it. He stated that he had done wrong and was very “sorrow” for it. The acknowledgment was received and he retained his seat

page 24 - 27 June 1846-William Ellzey reported that on Monday 22 June 1846 he saw James Brock drunk. Brock not being present, a committee of William Ellzey and Benjamin Morris appointed to visit him.

Yes, I know this is after the declared bankruptcy but ”old habits” are hard to break. In reality, He repented and the church forgave him and life continued.

The case of James Brock was taken up. The brother was present, acknowledged that he was guilty, gave satisfaction, and was restored to his seat.

James Brock is my 1st Cousin 5 times removed.

Deed of Gift to Rachel Port Davis Newsom


Rachel Port Davis is my 2nd Cousin 3 times removed. Rachel Port Davis was born abt 1789, a daughter of Lt. Joseph B. Davis and his wife Anne Keene.

Rachel married James Newsom on 7 June 1813 in Marion County, South Carolina. 

Land Deeds are a great source for potential genealogical information on families. Not all land deeds will have pertinent information but when you do find a deed with information it could be your genealogical goldmine.

On 2 April 1818, Joseph B. Davis, father of Rachel Port Davis Newsom made the following Deed of Gift to his daughter. It was witnessed by a son and a brother of Joseph Davis.

Newsom}To all men to whom these presents Shall come Greeting I Joseph Davis of the State of South Carolina in the District of Marion Planter do in  Consideration of the love good will and regard I have for and bear Towards Daughter Rachel Port Newsom lend her the use of Two negroes Slaves and their increase the Said two Negro Slaves  known and distinguished by the Names of Peggy and Anthony during the natural life of her the said Rachel Port Newsom and give to her Ifsue if any at the time of her death but in case She should die leaving no ifsue then and in Such case the two above named Slaves to wit Peggy and Anthony and their increase (page 24) to be deemed a part of my Estate as if this Deed had never been given in confirmation of this my Deed I have this day delivered into the hand of her the Said Rachel Port Newsom one of the above named Negroes Slaves to wit. The Two Marriages of Sophia Lavinia “Suffie” Furr

Sophia Lavinia “Suffie” Furr is my 1st Cousin 3 times removed. She was born on 2 June 1868, a daughter of John Furr and Elizabeth Huneycutt.

Sophie was twice married.

Her first marriage occurred on 25 June 1898 when she married John D. Lentz. Sophia was age 30; John was age 49.


John and Sophie had four children before he died sometime before October 1905.

The children of John D. Lentz and Sophia Lavinia Furr are:

        i.    John Cecil Lentz was born in Jun 1899 in Albemarle, Stanly, North Carolina.
         ii.    Frances Lentz was born about 1901.
         iii.    Agnes Lentz was born about 1903.
         iv.    Arthur James Lentz was born on 7 Dec 1904. He died on 19 Mar 1978 at the age of 73.

After the death of her husband Sophie, with 4 small children needed a man in her life to help care for her and the children. She next married Thomas Jackson Kiser, a widower, on 21 October 1905 in Cabarrus County, North Carolina.

Thomas J. Kiser and his new bride were first enumerated in 1910, Cabarrus County, North Carolina where we find Thomas, his new bride, 4 step-children, and a new addition to the family, a daughter Betty Gladys Kiser, age 2.


Thomas and Sophia would have one other child during their time together a son, Charlie Cleveland Kiser born 8 December 1913.

While her two marriages were sort of short-lived; Sophia would live a long life of 84 years passing away on  27 February 1953 with pneumonia. 

Thomas Jackson Kiser and Sophia Lavinia “Suffie” Furr  are buried in the Roberta Baptist Church Cemetery, Concord, Cabarrus County, North Carolina.

The Death of Tobias A. Huneycutt

The exact death date of Tobias A. Huneycutt is unknown. On-line trees would have you to believed that Tobias died 26 June 1874. There are many on-line trees that have this date but none of the trees have a source for the date. Chances are they don’t know the source because it was copied from another tree. Those that I have contacted searching for a source have no idea where the date originated. 

Tobias A. Huneycutt was born about 1824 in Montgomery County, North Carolina. He was the 2nd born son of  Marcus “Mark” I. Huneycutt and his wife Charity Dry. He had an older brother John Wiley and 6 other brothers and sisters. 

On 7 November 1852, Tobias A. Huneycutt married Elizabeth Mariam “Mary Ann” Huneycutt. Elizabeth Mariam Huneycutt was born 16 November 1832, a daughter of Andrew Jackson Huneycutt and his wife  Mary Ann “Polly” Crayton. Tobias and Elizabeth had their first 4 children living in Stanly County, North Carolina. Then between 1857 and 1860 they moved their family to Mecklenburg County, North Carolina where their last 3 children were born.

The children of Tobias A. Huneycutt and Elizabeth Mariam Huneycutt are:

        i.    Rufus Franklin Huneycutt, born 24 Dec 1850, Stanly County, North Carolina; married Sarah R. George; died 8 Sep 1915, Charlotte, Mecklenburg, North Carolina.
         ii.    Andrew Jackson Huneycutt, born 14 Aug 1853, Stanly County, North Carolina; married Mary Ann Kendrick, 27 Jun 1878, Mecklenburg County, North Carolina; married Sarah E. Graham, 27 Feb 1884, Mecklenburg County, North Carolina; died 22 Sep 1920.
         iii.    Mary A. C. Huneycutt, born 1855, Stanly County, North Carolina; married John Robinson Rigler, 14 Dec 1872, Charlotte, Mecklenburg, North Carolina; died bef Oct 1880.
         iv.    Sarah Jane Huneycutt, born abt 1857, Stanly County, North Carolina; married John Wiseman Clontz, 4 Jul 1881, Mecklenburg County, North Carolina; died 12 Sep 1904, Buncombe County, North Carolina.

         vii.    Tabitha Lenora Huneycutt, born 20 Aug 1868, Mecklenburg County, North Carolina; married William Henry Oxenham, 26 Dec 1893, Mecklenburg County, North Carolina; died 28 Dec 1934, Richmond, Richmond, Virginia.

As stated in the beginning paragraph, the exact death date of Tobias A. Huneycutt is UNKNOWN. In our initial research, we learned of his presence in the 1870 Census for Charlotte, Mecklenburg, North Carolina.

Then in 1880, we find Elizabeth, widow, alone, with her 3 youngest daughters. So, with this Census, we know that her husband, Tobias A. Huneycutt died between July 1870 and June 1880. While we have narrowed his death to a 10-year span its still a long ways from an exact date of 26 June 1874 as found in on-line trees.

After further research, we find Tobias and Elizabeth alive and able to execute documents in the Court system on 24 May 1874. So now we have narrowed Tobias’ death date to between 24 May 1874 and  June 1880 still a six years span.

On 24 May 1874 Tobias, his wife Elizabeth and son, Andrew Jackson executed a Land Deed to Edwards & Moody for the lot on which Tobias A. Huneycutt now lived.   

Beginning at a Stake a Corner of the J. A. Fore property on First Street and runs East to Myers Street Lot 148 feet, thence with Myers line S. E. 30 feet Thence with Hunnycuts line to First Street 148 feet thence with First Street to the beginning 30 feet containing a fraction of an Acre. Being a fraction of an Acre being part lot now occupied by T. A. Hunnycut south of the depot of C.C. & A. Rail Road. 1

I still have not found an exact death date for Tobias A. Huneycutt. We know that on 24 May 1874 he was able to execute a Land Deed and that by 1880 he was deceased. The search continues.

Tobias A. Huneycutt is my 2nd Great GrandUncle.

Added Comments: 

  • 27 June 1878 – Andrew Jackson Huneycutt, brother to Tobias, married Mary Ann Kendrick in Mecklenburg County, North Carolina. On the application for Marriage, Andrew Jackson Huneycutt reports that his Father is Dead and his Mother is living.
This narrows Tobias' death date to between 24 May 1874 and 27 June 1878.

The William Henry Oxenham and Tabitha Lenora Huneycutt Family

Tabitha Lenora Huneycutt is my first cousin 3 times removed. She was born on 20 August 1878, a daughter of Tobias A. Huneycutt and Elizabeth Mariam “Mary Ann“ Huneycutt. She was their seventh and last-born child.

Tobias A. Huneycutt died before 1880 and his daughter Tabitha, age 11, is found with her Mother Elizabeth Mariam “Mary Ann “Huneycutt in the 1880 census for Mecklenburg County, North Carolina.

After that, I lost track of Tabitha until the early part of this month. Tabitha Lenora Huneycutt married William Henry Oxenham, of England, on 26 December 1893 in Mecklenburg County, North Carolina. Her mother had died 8 years earlier in June 1885.

After the birth of two children, both boys, William and Tabitha moved to Henrico County, Virginia sometime between February 1898 (birth of 2nd son) and May 1900 (birth of daughter Marion). After the birth of Daughter Marion in Feb 1900; Tabitha and William had one additional child, another daughter, Grace born December 1902.

The children of William Henry Oxenham and Tabitha Lenora Huneycutt are:

        i.    Thomas H. Oxenham was born in Jul 1895 in North Carolina.
        ii.    William T. Oxenham was born in Feb 1898 in North Carolina.
        iii.    Marian Siegel Oxenham, born May 1900, Henrico County, Virginia; married Wilbur Montague Rhodes.
         iv.    Grace L. Oxenham, born 25 Dec 1902; married Roy Julius Lanning; died 17 Jan 1963, Richmond, Virginia.

William Henry Oxenham died 9 Jan 1928 in Richmond County Virginia. His wife Tabitha lived another 6 years passing away on 28 December 1934 in Richmond.

William Henry and Tabitha Lenora along with their daughter Grace are buried in the Riverview Cemetery, Richmond, Richmond City, Virginia.

As stated above, Tabitha Lenora Huneycutt Oxenham is my first cousin 3 times removed.

The Marriage of Lucy Pearl Deese

Lucy Pearl Deese, daughter of John Calvin Deese, was the only one of my grandparents that I knew. My other Grandmother and both grandfathers died before I was born in 1942.
Grandma Pearly lived until 1970 giving me many years to enjoy her company and presence in my life. She also had a sister and three half-sisters that lived a long life along with Grandma Pearly.

Grandma Pearly (Lucy Pearl Deese) married my Grandfather James Francis “Jim” Purvis abt 1910. To this union were borne 7 children of which six lived to adulthood, married, and had families of their own. Jim and Pearly’s firstborn, a daughter by the name Levina, passed away as a baby.

For many years I searched for a marriage date for my Grandparents without success. I located a Family Bible of my Great Grandparents but it contains no entry for the marriage of their son to Lucy Pearl Deese.

For many years the closest I could nail down a date of marriage was before 14 March 1908. This date is the date of the Last Will and Testament of  John Calvin Deese, father of Lucy Pearl Deese.


  • Item 5, of John Calvin Deese Will, reads: 
  • Item V. I give and bequeath to my daughter, Lucy Pearly Purvis, the sum of One Dollar ($1.00).
Lucy was married to Jim Purvis before John Calvin Deese wrote and signed his Last Will and testament on 14 March 1908.

I never gave up on finding a marriage date for my grandparents and that objective was rewarded when I subscribed to Newspapers.com. The 12 March 1908 edition of The Messenger and Intelligencer (Wadesboro, North Carolina); Thu, Page 1, col 6.

Morven News
Miss Pearly Dees and Mr. James Purvis were married Sunday [8 Mar 1908]. Owing to the objections to the match by the parents of the bride, they used the South Carolina Ceremony. [The Messenger and Intelligencer (Wadesboro, North Carolina)12 Mar 1908, Thu, Page 1, col 6.]


I now know they were married on 8 March 1908 in Chesterfield, South Carolina. I had no knowledge that there were objections to the marriage by Lucy's father and step-mother. 
  • Owing to the objections to the match by the parents of the bride, they used the South Carolina Ceremony.
 Regardless, the marriage was a lasting one until Lucy lost her husband in February 1936. She never remarried and passed away in 1970.

Update:

My wife was released from the hospital after approximately 6 weeks of hospitalization. She is improving daily and regaining her strength. Over the next few days, I hope to return to posting on Carolina_Family_Roots.
