It’s Family Time~In Remembrance of Martin Daniel Sides

 My 3rd Great Grand Aunt Esther Sides, born 1805, married Daniel Sides on 20 December 1823 in Cabarrus County, North Carolina. To this union were born 12 children; 5 daughters and 7 sons.  Unfortunately, except for the youngest child who was a son, James, the other six were “of age to serve” when the Civil War began in January 1861. I do know that 3 of the 6 boys “of age” did serve in the Civil War and the youngest of these 3 did not survive the War.

In 3 documents I have the youngest of these serving called, Daniel M. Sides (1850 Census), Martin Sides (1860 Census) and Marion D. Sides (Civil War death note).

The 3 sons of Daniel and Esther that served were:

Christopher Sides, b. 1829> Company "C", 48th Regiment

Charles Daniel Sides, b. 1831> 5th NC Company I

Martin Daniel Sides, b. 1839> Company "C", 48th Regiment

Martin Daniel Sides enlisted on 1 August 1862. He died at Paris, Virginia of a “unnamed disease” on 30 October 1862.

Administrative Bond for the Estate of George Dry

George Dry was born 16 Jan 1805 in Kentucky, a son of George Dry and Anna Maria Phifer. He married Rowena last name unknown. To this union were born 9 children; 3 daughters and 6 sons.

His tombstone shows that George Dry died on 10 Feb 1867 at the age of 62. He died intestate and a Bond on his estate was issued on 25 February 1867.

Whereas, James J. Drye & John F. Drye has been appointed, by the County Court of Casey County, Administrators of George Drye deceased, intestate, NOW, we J. J. Drye & J. F. Drye Administrators and W. S. Drye and G. W. Drye sureties, do hereby covenant to and with the Commonwealth of Kentucky, that the said James J. Drye & John F. Drye  will, well and truly adminster the goods, chattels, credits and effects of the said intestate, according to law, and will further make a just and true account of all their actings and doings therein; and will, well and truly make a proper distribution of any surplus money, effects, and rents, which may come to their hands, or to any one for them by color of their office, to the persons entitled thereto. If it shall hereafter appear that a last WILL and TESTAMENT was made by the deceased, and the same be proved and recorded, we further covenant that the said J. J. Drye & J. F. Drye will, in such case, surrender their letters of administration; and that they will account with, and pay and deliver over to the Execut___ or Administrat__ with the WILL annexed, the assets in their hands unadministrated.

It’s Family Time~The Carey Hunley Davis, Sr. Family

Carey Hunley Davis was born 11 Jun 1888, a son of Lewis Boatwright Davis and his wife Barzilla Freeman. He was the 4th of eight sons born to this family. He had no known sisters. He was a farmer.

On 11 November 1915, Carey Hunley Davis married Mary Zulene Ellis. Mary was a daughter of James Thomas Ellis and his wife, Sarah “Sallie” E. Davis. Mary was the youngest of four children, 2 sisters and a brother, and was born 30 July 1894.

Carey Hunley Davis and his wife Mary Zulene Ellis had one child, a son, Carey Hunley Davis, Jr., born 23 January 1917.

Carey Hunley and Mary Zulene  Davis had celebrated 60+ years of marriage when he passed away on 20 April 1976.

CHESTERFIELD — Carey Hunley Davis, Sr., 87, a retired farmer died Tuesday. Funeral is 11 a.m. Thursday at Zoar United Methodist Church. [Death Notice, The Charlotte Observer, Charlotte, North Carolina, 21 April 1976, Page 9-B, column 1].

Mary Zulene (Ellis) Davis lived an additional 8 years passing away on 27 May 1984.

Mrs. Zulene Ellis Davis, 89 of Chesterfield; widow of Carey Davis, died May 27. Born in Darlington County, she was a daughter of the late James T. and Sallie Ellis. [Mrs. Zulene Ellis Davis obituary, The Chesterfield Advertiser, Chesterfield, Chesterfield County, South Carolina, 6 June 1984.]

Carey Hunley and Mary Zulene (Ellis) Davis are buried at Zoar United Methodist Church Cemetery, Brocks Mill, Chesterfield County, South Carolina. 

Carey Hunley Davis is my 2nd Cousin Twice Removed.

The Death of Barbara (Lipe) Dry

Barbara Lipe was born 16 November 1795, a daughter of Leonard Lipe and Barbara Wentz of Cabarrus County, North Carolina. Shortly after her marriage to Daniel Dry, the couple migrated to Perry County, Illinois.

There, Daniel and Barbara raised a family of eight children in their twenty-one years of marriage. Her husband, Daniel died on 9 March 1836; but, Barbara lived until the age of 84, passing away in Perry County, Illinois. She was listed as passing away form apoplexy in February 1880 in the 1880 Mortality Schedule shown here:

Today’s Treasure ~ 1833 Marriage License for Hiram Pyle and Catherine Dry

Today’s treasure is the 1833 Marriage License of Hiram Pyle and Catherine Dry. Catherine Dry was borne 5 November 1817 in Perry County, Illinois. Catherine was a daughter of Daniel Dry and Barbara Lipe. Her parents roots were in Cabarrus County, North Carolina. Family lore is that Daniel's parents, Owen & Eve Dry did not approve of the marriage resulting in an estranged relationship. Shortly after their marriage, Daniel and  Barbara  moved to Perry County, Illinois. Their first borne, a son, died at age 2 and in the same year of his death their daughter Catherine was borne.  

At age 15, Catherine married Hiram Pyle on 18 April 1833 in Perry County, Illinois. Hiram was born Feb 1810 in Christian County, Kentucky, a son of John and Mary (Wells) Pyle.

Hiram and Catherine had seven children; 2 daughters and 5 sons.  Hiram Pyle died 28 October 1876. Two years and 3 months later, Catherine (Dry) Pyle passed away on 10 January 1879. Hiram, Catherine and other family members are entombed in the McElvain Cemetery, Du Quoin, Perry County, Illinois

It’s Family Time ~The Daniel Earnhart Family

Daniel Earnhart son of George Earnhart and Margaret Keppel was born 13 Feb. 1809 in Rowan County, North Carolina. Sometime in the early 1830’s Daniel Earnhart married Martha [LNU] and by September 1835 was in Bedford County, Tennessee where he purchased 128 acres of Land (DB FF:49) from his father, George Earnhart.  

Daniel and Martha would have seven children before her passing in the 1870’s after the 1870 Census was executed and before the 1880 Census were enumerated. The death certificate for one of those children, Mary C. Earnhart shows her mother to be “Lucy LENTZ”. The first name Lucy does not match Martha as shown in the Census but it may be a clue to her real surname.  

After the death of Martha in the 1870’s, Daniel then married a much younger lady called Ann; last name also unknown. No Tennessee marriage license has been found for either of these two marriages. In the 1880 Censuses for Bedford County Daniel is age 79 and Ann is age 27.   

Daniel Earnhart passed away between 2 March 1883, when he wrote his Will and 2 April 1883 when it was probated. After his death Ann, his widow, married William  Kimmons on 15 March 1885. William Kimmons passed away on 25 December 1914 and his widow Ann died 14 January 1925. The informant, Mrs. Fannie Crowell, for her Tennessee death certificate did know the names of her parents.

Daniel and Martha [LNU] Earnhart children were:

i. Malinda J. Earnhart was born about 1833.

ii. Harriett Earnhart, born abt 1835; married John W. Paschal; died bef 16 Jan 1864, Bedford County, Tennessee.

iii. Mary C. Earnhart, born 22 Nov 1837, Bedford County, Tennessee; married Charles Crowell, 15 Aug 1861, Bedford, Tennessee; died 9 Aug 1923, Unionville, Bedford, Tennessee.

iv. William Earnhart was born about 1838 in Bedford County, Tennessee.

v. John Henry Earnhart, born 6 Oct 1841, Tennessee; married Evaline Wise; died 25 Aug 1896, Christian County, Missouri.

vi. James A. Earnhart, born 1 Apr 1843, Bedford County, Tennessee; married Sarah E. Clardy; died 26 Jul 1925, Bedford County, Tennessee.

vii. George Earnhart, born 1845, Bedford County, Tennessee; married Martha Ellen Head, 5 Feb 1877; died 1904, Bedford County, Tennessee.

Daniel Earnhart is my 1st Cousin 5X Removed.

Today's Obituary: Mary Ellen (Kepley) Copple

Mary Kepley Copple

Mary Kepley was born in Davidson Co., N. C, May 2nd, 1836, and died at her home July 13, 1902, age 66 years, 2 months and 11 days. She was married to A. K. Copple, July 9th, 1865, to this union were born seven children, three boys and four girls. The husband and two daughters survive her. She professed faith in Christ at the age of 30 and united with the Liberty Baptist Church, North Carolina. She with her husband and family came to Kansas in March 1883 and settled in Osborne county where they have since made their home. She united with the Downs Baptist church Nov. 1889 and retained her membership until her death. Mrs. Copple has been failing in health for several year and for the past two years has been entirely helpless, though amid her afflictions she was not known to murmur or complain and as the end drew near she expressed her firm faith in Christ and said to those around her that she was willing and ready to depart this life and to be with her Savior. Mary (Kepley) Copple was the daughter of Daniel Keppel. Her Mother is unknown. Alfred Kenny Copple and wife Mary moved their family of six to Kansas in March 1883. A seventh child was born after their arrival on 7 February 1884.  Alfred Kenny Copple died on 22 August 1919.

Mary Ellen (Kepley) Copple is my 2nd Cousin 4X Removed.

Barbara L. Dry vs Charles Dry, John R. Dry and Others

 On 2 Feb 1897, Phillip Wiley Dry, son of Solomon Dry and Esther Melchor and husband of Barbara L. Bost passed away leaving an estate of both personal and real property.

Suit was made whereas the plaintiff above named has begun an action in said Court for dower and thirds in the lands of her late husband, P. W. Dry described in the complaint of the plaintiff , to-wit: About 100 acres in No. township. Cabarrus county, adjoining the lands of Charley Bost, Reed and Allison, Wesley Cassell and Henry Bost. The same is the land on which the said widow now resides.

Suit:

SUPERIOR COURT. Barbara L. Dry, Plaintiff, vs. Charles Dry, John R. Dry, Mary J. Ross and husband, Cornelius Ross, Lindy C. Bryant and husband, John W. Bryant, Bettie Smith and husband, R. L. Smith, Defendants.

It appearing to the satisfaction of the Court from the return of M. I. Buchanan, Sheriff of Cabarrus county, N. C, and from the affidavit of L. T. Hartsell, filed In the above entitled action, that John R. Dry, Lundy C. Bryant, and husband; John W. Bryant, Bettie Smith and husband, R. L. Smith, are nonresidents of this State, and after due diligence cannot be found within the State of North Carolina, and are necessary and proper parties to the above entitled action, and whereas the plaintiff above named has begun an action in said Court for dower and thirds in the lands of her late husband, P. W. Dry described in the complaint of the plaintiff, to-wit: About 100 acres in No. township. Cabarrus county, adjoining the lands of Charley Bost, Reed and Allison, Wesley Cassell and Henry Bost. The same is the land on which the said widow now resides.

And whereas, the said defendants John Dry, Lundy C. Bryant and husband, John W Bryant. Bettie Smith and husband R. L. Smith, have an interest actual or contingent as heirs of law of said P. W. Dry in said lands.

Now, therefore, the said John R. Dry. Lundy C. Bryant and husband, John W. Bryant, Bettie Smith and husband, R. L. Smith, are hereby notified that unless they be and appear at the office of the Clerk of the Superior Court of said County and State aforesaid on or before the 15th day of November, and plead, answer or demur to the complaint of the plaintiff in this action, that the plaintiff will apply to the Court for the relief demanded in the complaint and for costs of action. This 27th day of September, 1897.

COMMISSIONER'S SALE OF LAND Under authority and by virtue of a decree of the Superior Court of Cabarrus County, in a special proceeding entitled Geo. F. Barnhardt, Administrator P. W. Dry, against Chas, Dry. John R. Dry and others, defendants in the above entitled action, to sell land for assets to pay debts, I will, as administrator and commissioner, on Monday, the 3rd day of July, 1899, at 12 o'clock, sell to the highest bidder, at the Court House door in Concord, N. C, the following described land in said County near Bear Cold Spring, viz : About 100 acres in No. township, Cabarrus county, adjoining the lands of Charles Bost, Reed A Allison, Wesley Cassell and Henry Bost, the same being the lands upon which P. W. Dry lived, less the 29 acres of said tract allotted to Barbara L Dry as dower as recorded in office of Clerk Superior Court, Cabarrus county, in book orders and decrees, No. 4, pages 413 and 415. Terms: One third cash, Balance purchase money due in 6 months from date of sale, interest 6 per cent, per annum, with approved security.

Phillip Wiley was married 3 times. In addition to the 5 children named in the above legal action, Phillip and Barbara had two sons who are deceased, Herman and Henry S. Dry. Mary Jane Ross in the above action is a daughter of his 1st wife, Leah Ridenhour. There were no children of his 2nd wife, Susan/Sarah Bost, widow of Henry Thomas.   

Barbara Leah (Bost) Dry died 21 February 1907. Phillip Wiley and Barbara Leah Dry are buried in the

Cold Springs United Methodist Church Cemetery, Concord, Cabarrus County, North Carolina.

1799 Baptism Entry for John George Dry (23 Apr 1799-6 Jan 1857)

 Church records are essential documents in our Genealogical research prior to the early 1900's. While some states did documents births, death and marriage pre-1910; most states did not began this type of documentation until laws were passed around 1910 making it a requirement. You might find a “Death Notice” in the local newspapers but the modern day obituary as we are acquainted with today were very rare. If a death was documented it would most likely be within a church.  

Today, I have chosen the Baptism Record of my 3rd Great Grand Uncle, John George Dry to share with my readers. 

John George was born 23 April 1799, a son on Johan Martin Dry and Catherine Keppel. His baptism is documented in the St. John’s Lutheran Church Baptismal Records, Concord, North Carolina, His parents and family members were active in this church. The Baptismal Records, 1797-1847 of St. John’s Lutheran were transcribed by Adelaide and Eugenia Lore, Concord, NC, 1977.

The baptism was recorded as a baptism facts in my genealogical database.

George Arnhart to Daniel Arnhart_Deed

George Earnhart was born 9 June 1759 in Cabarrus County, NC. He was twice married; first to Elizabeth Barbara Cauble and second to Margaret Keppel, daughter of Peter Keppel, Sr. and Anna Elizabeth Grobb. No marriage documents have been found for either of these marriage but we know that the 2nd marriage took place before July 1803.

In or about 1812, George and Margaret Earnhart along with several other families left Cabarrus and Rowan County and migrated to Bedford County, Tennessee.

In an affidavit, dated 26 April 1836,  for a Revolutionary War Pension, George Earnhart stated that he remained [in NC] after the Revolution until about 24 years ago [1812]. I removed into Bedford County State of Tennessee near Shelbyville where I lived about seven years [till 1819] and then removed into this County where I have lived ever since and where I now live [Madison County, Tenn.].

In September 1835 when the within Land Deed was executed George and Elisabeth (Keppel) Earnhart  were in their mid-70’s and had lived a long life.

This Indenture made the eighteenth day of September in the year of our Lord one thousand Eight hundred and thirty five by and between George Arnhart of the County of Bedford and State of Tennessee of the one part and Daniel Arnhart his son of the county and State aforesaid Witnefseth that the Said George Arnhart for and in consideration of the Natural Love and affection which he the said George Arnhart bears toward his son Also the further consideration of a Bond for one thousand Dollars bearing date the 18 day of September 1835 in which the said Daniel Arnhart agrees to maintain the said George and his wife during their Natural lives hath given and granted aliened and confirmed And by these presents do give grant alien and conform unto the said Danial Arnhart his heirs and afsigns a certain tract or parcel of Land with the appurtenances thereunto belonging Situate lying and being in the County aforesaid on the South bank of Duck River & bounded as follows Beginning at a hickory Stump on the South bank of Duck River Capleys corner thence West with Culps line thirty six poles to a Walnut in said Culps line Thence South 27 Degrees East twenty seven poles to a Stake thence South fifty nine Degrees West one hundred and thirty five poles with Benjamin Arnharts line to a Cedar, and pin Oak Thence West two hundred and sixty two poles to a Cedar the West boundary line of the original Survey of one thousand Acres Thence South Seventy eight poles to a Stake John Warrens corner Thence East with Warrens line one hundred and seventy nine poles to a Ash, said Warrens North East Corner thence South (29) twenty nine & one half Poles to Henry Arnharts corner on a White Oak (pg 50) thence North Sixty two East one hundred and thirty Seven poles with Henry Arnharts line to pin Oak & Locust thence North Ten degrees East thirty two poles to a Stake Thence East thirty poles to Henry Arnhart Corner on the South west bank of Duck River thence down the meandering of said River to the beginning Containing by estimation one hundred and Seventy Eight Acres (and twenty poles) [Note: these 3 words (and twenty poles ) are out of place] to Daniel Arnharts his heirs and afsigns forever to have and to hold the said land and premises with the appurtenances thereunto belonging 0r in anywise appertaining unto the Said Daniel Arnhart his heirs and afsigns forever And the said George Arnhart for himself and his heirs the said land and premises and every part and parcel thereof against himself and his heirs & afsigns and all and every person whatever and warrant and for ever defend by these presents. In Witnefs whereof the said George Arnhart has hereunto set his hand and seal the day and date above written.

Given under my hand at Office in Shellyville 2 November, 1835.
