Ann G. Vereen & James R. Ervin Marriage Contract

Not much is known of Ann G. Vereen early life. Her father may be William Vereen.

On 2 January 1834, Ann G. Vereen entered into a marriage contract, seen below, to wed James R. Ervin. It is believed that James R. Ervin was also married to Ann Dozier Davis. It is not known which of these two ladies was his first wife.

After their wedding in January 1834, no record of Ann and James has been found.

The State of South Carolina
                    This indenture made the second day of January in the year of our Lord One Thousand Eight hundred and thirty four between Ann G. Vereen of the District of Marion of the first part, James R. Ervin of the District of Chesterfield of the second, and John C. Davis and A. L. Scarborough of the District, and all of the State aforesaid, of the third part. Witnesseth that Whereas a Marriage by God’s permission, is intended shortly to be had and Solemnized between the said Ann G. Vereen, and the said James R. Ervin, and whereas upon the party of the said intended marriage it was agreed that the property herein after more particularly mentioned and described, should be conveyed, transferred, and set over, unto the said John C. Davis & A. L. Scarborough and the survivor of them his Executors Administrators and assigns in trust nevertheless to and for the uses, intents and purposes herein after mentioned and declared, of and concerning the same, Now this Indenture Witnefseth That the said Ann G. Vereen for and inconsideration of the said intended marriage, and for the purpose of conveying into effect and execution the aforesaid agreement, and also for and inconsideration of five dollars to her in hand paid at and before the sealing and delivery of these presents, by the said John C. Davis and A. L. Scarborough,the receipt whereof is acknowledged, hath by & with the privily and comments of her said intended husband, the said James R. Ervin, testified by his being a party to and signing and sealing and (pg 468) delivery of these presents (partial sentence strikethrough) granted, bargained, bargained, <Sic> sold and delivered and by these presents doth grant, bargain, sell and deliver unto the said John C. Davis & A. L.Scarborough, and the survivor of them, his Executors, Administrators and afsigns the following negroe slaves, viz Polly, Jen, Clarenda, Daniel, June, Sue, Mammy, Nimdor, Jacob, Dinah, illegible, Rose, Matilda, William, Selvay, Robert, Will, Amy, Katy, Katy, <sic> Sim, and carriage & Horses. Together with the future ifsue and increase of the females of them, and the said Ann G. Vereen, for and in the consideration aforesaid, doth by these presents,transfer, afsign and transfer unto the said John C. Davis & A. L.Scarborough, a certain working obligation commonly called a Bond payable to her the said Ann G. Vereen by John H. Allston of Georgetown District, conditions for the payment with interest, the first installment due and payable on the first day of March next. Also the said Ann G. Vereen, for and in consideration of one dollar to her in hand paid by the said John C. Davis & A. L.Scarborough and in consideration of the premises herein before Stated and Set forth, doth hereby transfer and afsign and deliver to them the said John C. Davis & A. L. Scarborough all her illegible money, debts and bonds due her,In Trust ??? the (pg 469) lefs to and for the purposes, intents and uses herein afterward more particularly mentioned and exprefsed, that is to say that the said John C. Davis & A. L. Scarborough Shall have power to Sue for collect and demand all Such Sum or Sums of Money as is or may be due her, by bond, Note or other wise and with the Said Sum to purchase for her and with her consent to be first had and obtained Such real or personal estate or real & personal Estate as She may devise and when Said purchase is or Shall be made the Said Estate—real or personal, Shall be in trust, and be conveyed to and for the uses objects as is herein and will be herein after expressed and Subject to the same limitations and conditions and purposes, as the Negroes are, who are herein before more particularly named. To have and to hold all and Singular the Slaves, bonds and Notes, mortgages and other Securities for the payment of Money into the Said John C. Davis & A. L. Scarborough and the Survivors of them his heirs,Executors, administrators or afsigned, In Trust, nevertheless to and for the following uses and purposes, that is to say- until the Solemnization of the said intended marriage, In Trust to and for the use and behoof of the Said Ann G. Vereen, her Executors, administrators and afsigns from and after the Solemnization of the said marriage, then in trust to and for the uses benefit and behoof of Such person and persons and in Such portion and portions, Estate and Estates, manner and form as he said Ann G. Vereen not withstanding her intended  overture, by any deed or deeds executed in her lifetime (with the consent of her aforesaid trustee or the Survivor of them. Shall express limit and declare; and until such declaration and & appointments In Trust to and for (pg 470) the Joint use benefit and behoof of the said Ann G. Vereen and the Said James R. Ervin for and during their joint lives; but not to be subject in any manner or way whatsoever to the debts, contracts or engagements of the Said James R.Ervin and from and after the determination Such Estates, them in trust, to and for the use, benefit and behoof of Such person or persons in such proportion or proportions, Estate or Estates, manner & form as the Said Ann G. Vereen Shall by her last Will and Testament in writing, duly executed, express, limit,declare and appoint---which said deed or deed or last will and testament the said Ann G. Vereen notwithstanding her intended overture, by these presents is fully empowered and authorized to make so and execute But in case the said James R. Ervin, should depart this life, in the lifetime of the Said Ann G. Vereen then in trust for the sole and Separate use, benefit and behoof, of the said Ann G. Vereen her Executors, administrators and afsigns forever free and  absolutely discharged of and from all further trust.
But, in case the said Ann G. Vereen should depart this life,in the lifetime of the Said James R. Ervin leaving issue of the said intended marriage or should die leaving no ifsue & without have made any disposition, nomination or appointment by any deed or deeds, executed in her lifetime as aforesaid or by her last will and testament then in trust, to and for the benefit and behoof of the Said James R. Ervin then in trust to and for the use, benefit and behoof of the child or children, grand child or grandchildren, ifsue of the said intended marriage his, her or their Executors,administrators or afsigns (pg 471) forever; if more than one as tenants in common such grand child or grand children representing his her or their respective parents share; the said Ann G. Vereen doth convey in trust and with the power and authority to the Said John C. Davis and A. L. Scarborough that in case it Shall or may hereafter become necessary to Sell and convey any of the Said Slaves now in pofsefsion their ifsue and increase or any Slaves which may be bought as is contemplated or in case any land or real Estate shall hereafter be bought Subject to the trust limitations and conditions herein before Stated, that it shall and may be lawful for my said trustees by and with my consent in writing to Sell and convey any such Slave or staves or real Estate and with the processing arising from Such Sale or sales to purchase other Slaves or Slaves or Real Estate which shall be substituted for such Slave or real Estate to hold and Shall be in trust Subject to the same uses, intents, & limitations and provisions as the property herein conveyed to any said trustee, Shall or may be subject; In Witnefs whereof the parties to these presents have hereunto Set their hand the day and year above Written.

Scarborough (pg 472) Sign, Seal, and deliver the within instrument of writing for the purposes therein mentioned and that Francis Davis Signed his name with him as a subscribing witnefs. Sworn to before me this Eleventh day of January 1834.
