Chesterfield County SC Estates~Estate Folder #133–Stephen Brock.

 

This is a new series of posting, appearing every Sunday, on selected Estate Folders from the Estate files of Chesterfield County. No known estates exist for the period before the Civil War. They were destroyed with the burning of the Courthouse. There are a few “Equity Records” in the State Archives. Do not overlook this valuable resources if you are looking for ancestors in Chesterfield County, South Carolina.

Stephen Brock died intestate on 11 September 1867 in Cheraw, Chesterfield County, South Carolina. 

His wife, Nancy Smith Brock, daughter of Wiley and Mary Smith was named administratrix of the Estate.

The estate folder show that an inventory was performed with the following item documented.

Stephen Brock owned a lot in the town of Cheraw known as Lot 246 for which Peter Haley Brock petitioned the court to sell so that he could get his share.

The petition of Peter H. Brock

Sheweth that Stephen Brock late of said
County lately died intestate having him surviving
his widow Nancy Brock, P. H. Brock, Irvin S. Brock, Frank Brock & Calhoun Brock, and that the said intestate was Seized & possessed in his own right of the one half interest in a certain lot in the town of Cheraw Numbered 246 on Market Street continued-
Your petitioner being desirous of obtaining his share of the above property prays that a summons in partition do ifsue for the division or sale of the same.

The State of South Carolina}
To Nancy Brock, P. H. Brock, Irvin S. Brock, Frank Brock and Calhoun Brock legal heirs of Stephen Brock, who died intestate, Greetings-
You are hereby required to appear at the Court of probate, to be holden at Chesterfield Court House for Chesterfield County on Thursday the 23th day of January, A.D. 19870, to show cause if any you can, why the real estate of Stephen Brock deceased, situated in the County of Chesterfield and Town of Cheraw known as Lot No. 246 on Market street continued, should not be divided or sold, allotting to the said Nancy Brock the one third party thereof and to the said P. H. Brock, I. S. Brock, Frank Brock and Calhoun Brock each an equal share in the remaining two thirds.
Given under my hand and seal this 10th day of January A. S. 1870.

Stephen Brock and Nancy Smith were married about 1847. In the 1850 census their first two children, Peter and Thomas, were ages 2 and 1. 

Several documents in this file names the heirs-at-law but mostly the file centered on Lot 246 in the town of Cheraw and the sale of said lot. 

Stephen and Nancy had 6 children; four are named above - P. H. Brock, Irvin S. Brock, Frank Brock and Calhoun Brock, Not named in the Estate are:  Thomas (1849-1850) and Louisa Jane (8 Oct 1851-12 Mar 1865). 

Nancy Smith Brock died 12 January 1878; eleven years after the loss of her husband, Stephen. They are buried in the Old St. David’s Episcopal Church cemetery.
