Trust Sale: The Dwelling House of V. W. Brock


Trust Sale.
BY virtue of a deed of trust heretofore executed to me as Trustee by V. W.  Brock and Moses Brock to secure the payment, of certain notes therein described, due to Thos. B. Rixby senior dec'd has been duly recorded in the office of the Clerk, of the Probate court of Hinds County --I will on Saturday, the 25th April 1840 before the door of the court house of Hinds county, Miss. sell for cash the following described property, to wit: a lot of ground in the town of Utica upon which is now erected the dwelling house of him the said V. W. Brock, containing one quarter of an acre; also, the south half of the south west quarter of section fourteen, and the south half of the west half of the north west quarter, of section twenty-three; also south half of the west half of the north east quarter, and north half of the east half of the north west quarter of section fifteen; also, the north half of the west half of the north west quarter of section fifteen; also, the north half of the west half of the north west quarter of section twenty-three; also, west half of the south west  quarter of section fifteen,  all situated in Township 3, Range 4 West; with all appurtenaces unto said land belonging or in any way appertaining to the said V. W. Brock.

The Reverend Valentine William Brock was born about 1806 in Chesterfield County, South Carolina a son of William Brock and his wife Charlotte [LNU]. 

William and Charlotte took their family to Louisiana and Mississippi before November 1826. In November 1826, their son Valentine was received by experience into membership with the Silver Creek Baptist Church, Pike County, Mississippi. 

Valentine married Vashti Brooks on 12 October 1835 in Claiborne County, Mississippi. To this union was born 7 children; two which died very young. After the death of his wife Vashti on 6 March 1851  Valentine married Martha Conger Sims on 16 March 1852.
Valentine William Brock served as a Baptist Minister during his lifetime.

V. W. Brock and Moses Brock are brothers. A death date for Valentine William Brock has not been found. He was last enumerated in the 1870 census for Clinton Township, Hinds County, Mississippi.

Death of Calvin Cook Sellers




Death of  Col. C. C. Sellers.-Died, at his residence, near Camden, Wilcox county, on Saturday last, 20th inst., Col. C. C. Sellers, for many years a prominent member of our State Senate and a distinguished member of the Bar. In every point of view, he was one of the most respectable men in the State, and his death has created a void particularly in the county of Wilcox, that will be difficult to fill.

Calvin Cook Sellers (30 Sept 1811-22 Mar 1852) was the son of Samuel Sellers and Alice "Allie" Cook. 

Calvin Cook Sellers served as County Clerk of Wilcox County for many years while studying to become a lawyer.

He served as Senator in the State Legislative for several terms.

In 1849, he was nominated for Congress to represent Alabama.

Calvin married  Eliza A. Howell on 12 Jun 1836 in Wilcox County, Alabama. He is survived by his Widow and 9 children.   

The Children of Calvin and Eliza Sellers are:
    i.    Calvin Cook Sellers Jr., born 3 Mar 1837; married Susan A. Seltzer, 18 Mar 1858, Wilcox County, Alabama; died 26 Mar 1900, Wilcox County, Alabama.
     ii.    William James Sellers was born on 22 Jun 1838. He died on 9 Jun 1839 at the age of 11 months.   

    iii.    Mary Sellers, born Jan 1840, Wilcox County, Alabama; married Robert J. Fulenwider; died 1915, Lauderdale County, Mississippi.
    iv.    Martha Sellers was born on 30 Jun 1841. She died on 5 Jul 1854 at the age of 13.
    v.    Samuel Sellers, born 7 Apr 1843; married Lucie Ann Johnson, 27 Sep 1869, Bibb County, Alabama; died 17 Aug 1885.
    vi.    Sarah Sellers was born about 1843.
    vii.    Sidney P. Sellers was born about 1844.
    viii.    Emily Sellers was born about 1846.
    ix.    Francis Marion Sellers, born 12 Sep 1847; married Louise Catherine  Moody; died 22 May 1917.



Calvin Cook Sellers is my 2nd Cousin 5 times removed.

On this day Judge J. B. Moore a member of the Committee appointed to draft suitable resolutions in memory of the Hon. Henry Brown Dec’d by request of said committee presents the following resolution which is by the Court ordered spread in in <sic> full upon the Records and are as follows to wit:
El Dorado Ark. Sept. 26th 1889
At a meeting of the El Dorado Bar held at the Court House on this day for the purpose of paying Tribute of respect to the memory of the Hon. Henry Brown lately a member of this Bar the following proceedings were had.
Judge W. M. VanHook was called to the chair and Wm. D. Jameson elected Secty <sic> of said meeting. On motion, Jesse B. Moore, T. J. Gaughan and Wm. D. Jameson were appointed a committee by the chair to draft suitable resolutions in memory of the life and character of deceased And on further motion, it was resolved that said committee prepare & present said resolutions to the Circuit County and Probate Courts of Union County. And that a copy of the same be furnished the family of deceased—
Whereas it has pleased Almighty God to remove from the walks of man the Hon. Henry Brown formerly a member of this Bar of long and honorable standing and three times a Judge of the County and Probate Courts of this County, whose death occurred in Howard Co. Arks on the 4th day March 1889. Therefore be it resolved
That in the death of our brother and associate the state of Arkansas has lost a valuable & Estimable Citizen, the Bar an able & distinguished Jurist, Society an honorable member and family a loving husband and devoted father.
2. Resolved—That during the long residence of Judge Brown in our midst covering a period of about thirty years we always recognized in him a true friend & an honest conscientious gentleman devoted to duty in the various walks of life, and that we deplore his untimely death

The Honorable Henry Epps Brown, born 28 May 1820 was the son of John H. Brown and Sarah Rivers.

Henry Epps Brown married Frances A. “Fannie” Shelton about 1855 in Union County, Arkansas.

Henry Epps and Fannie Shelton Brown had 4 children; Fannie brought 1 child into the marriage:
        i.    Cassy Ada Russell, born 3 Jan 1848, Alabama, United States; married Dr. William John Pinson, 2 May 1883, Union County, Arkansas; died 21 Dec 1938, Union County, Arkansas.
         ii.    Henry Clay "Hal" Brown, born 30 Aug 1856, Lauderdale County, Mississippi; married Mary Laconia Smith, 14 Jan 1878, El Dorado, Union, Arkansas; married 2nd, Ida Adeline Milliron, 30 Aug 1879, Collins, Texas; married 3rd Recenia Margaret Holland, 1878; died 15 Dec 1935, Terrell, Kaufman County, Texas.
         iii.    Amanda Rivers Brown, born 19 Feb 1857, Mississippi; married John J. Vogel, 25 Jul 1887, Miller, Arkansas; died 2 Sep 1934, ‎Miller County, Arkansas.
        iv.    Henrietta S. "Retta" Brown was born on 24 Jun 1861 in Mississippi. She died on 10 May 1933 at the age of 71 in El Dorado, Union, Arkansas and was buried in Woodlawn Cemetery, El Dorado, Union County, Arkansas.
 
BIRTH CONFLICT: Looking at the 1860 Census we find that Henrietta is one of 3 children in the household and is age two (2); thus making her birth year to be about 1858. Her Tombstone in the Woodlawn Cemetery, El Dorado, Union County, Arkansas has her birth recorded as Jun. 24, 1848. This date is definitely wrong. 
On her FindAGrave Memorial we find the following comments about Retta Brown
Daughter of Judge Henry and Francis Shelton Brown.
An elementary school building in El Dorado was named in her honor, the Retta Brown Elementary School. In 2010 that facility is more formally known as Retta Brown Academy of Communication and Technology, located at 505 Dixie Drive, El Dorado AR 71730.
       v.    Virginia M. "Jennie" Brown, born Mar 1865, El Dorado, Union, Arkansas; married Lewis A. Petit, 1887; died bef 1920.

The Honorable Henry Epps Brown died on 11 March 1889 according to his tombstone; not on the 4th as indicated in this tribute.

Henry Epps Brown is my 1st Cousin 5 times removed.

It’s Family Time~The E. C. Rivers Family


Emerson C. “EC” Rivers, Estelle Kelley & Susie Vera Rivers Hinson


Emerson Coit Rivers was born on 9 March 1913, a son of Emerson Coyt Rivers and Lucy Ellen Brock. He was the seventh of eight children born to this couple.

Emerson Coit Rivers was twice married; he first married Ruby Myrtle Sims on 19 October 1933 in Chesterfield, South Carolina. To this union was born one son Harry Donald, who died as an infant.

Emerson Coit Rivers then married Estelle Kelley on 2 August 1939 in Norphlet, Union County, Arkansas. Estelle was the daughter of John Kelley and Laura Letcher.

Emerson Coit Rivers and Estelle Kelley had 4 children; 3 daughters and a son. 

Emerson Coit Rivers died 5 September 1994 in Henderson, Rusk County, Texas. His wife, Estelle Kelley Rivers died 19 Jan 2011.

In the photo above, shared by E.C. & Estelle’s daughter, is Vera Rivers Hinson, a sister of Emerson Coit Rivers.  Vera was born on 17 May 1909; married Robert C. Hinson on 27 July 1929 and died  5 February 1993 in Henderson, Rusk County, Texas. Robert and Vera share a tombstone in the Mount Olivet United Methodist Church Cemetery, Hunts Mill, Chesterfield County, South Carolina. Her obituary states that she was buried in the Pleasant Hill Cemetery, Henderson, Rusk County, Texas.

Treasure Chest Thursday~1955 City Directory, Monroe, NC

In late 1940 while living in South Carolina, my Father’s job at a local business was replaced with a machine. He had to find a new job and/or occupation.

After I completed the 1st grade in a small one-room School we moved across the State Line to Anson County, NC.

My Dad found work as a carpenter with a local construction company and we the children began school at a local high school. 
In 1955, I would turn 13 and start the 8th grade in school. Daddy was working away from home; I only knew that he was working construction elsewhere in the state.

Finding this 1955 City Directory for Monroe, NC, and finding my Father listed as a resident was quite surprising and a wonderful memento of my teenage years.

Tombstone Tuesday~Dixie Sellers Hillegass

Dixie Sellers was borne 17 April 1916, a daughter of Phillip Hardy Sellers and Ethel “Effie” McManus. She had one sibling, a younger brother, known by the name Paul Hardy Sellers.

At age 20, she married Raymond A. Hillegass on 6 Feb 1937 in Broward County, Florida.
Dixie Sellers Hillegass died 5 May 2006 and was buried in the Boca Raton Municipal Cemetery and Mausoleum, Boca Raton, Palm Beach County, Florida.

Dixie Rosalie Sellers Hillegass is my 3rd Cousin twice removed.

This indenture made this the 22nd day of December in the year of our Lord one thousand Eight hundred and forty eight between William R. Eddins of the State of Alabama and Wilcox County of the first part and William Eddins Son of the said William R. Eddins of the second part. Witnefseth that the Said William R. Eddins as well for and in consideration of the Natural love and affection which he the said William R. Eddins hath and bareth unto the said William Eddins given and granted and by these presents do give and grant unto the said William Eddins his executors administrators and assigns forever all that tract or parcel of Land lying and being in the county of Wilcox and state aforesaid known by being the South End of the South West quarter of the South West quarter Section Eighteen Township Ten Range Eleven containing twenty five acres in the district of lands subject to sale at Cahaba, Ala. Together with all and singular the hereditament & appurtenances thereunto belonging or in anywise appertaining & the reversion remainders issues & profits thereof & all the Estate rights title interest claim or demand whatsoever of him the said party of the first part either in Law or Equity of in the above given & granted premises & Every part & parcel thereof to have & to hold said party of the second part his heirs & afsigns to the sole & only proper use benefit & behoof of the said party of the second part his heirs and afsigns forever. In this land deed, William Riley Eddins is giving his son William Eddins 25 acres of land in Section 18, Township 10, Range 11.

By 1848 there are several William Riley Eddins and William Eddins in Wilcox County Alabama. There is William Riley Eddins, brother to Richard Eddins and there is William Riley Eddins son of Richard Eddins.

This land deed is between William Riley Eddins, brother of Richard Edding, to his oldest son, Abner William Eddins. 

William Riley Eddins is my 3rd Great Grand Uncle.

It’s Family Time~The William Washington Eddins Family

William W. Eddins was born  3 November 1863, a son of Joseph Columbus Eddins, Sr.  and Matilda Ann Tice of  Chesterfield, Chesterfield, South Carolina. He was eight of eleven children borne to William and Matilda Eddins.

Martha E. Previtte was born on 5 Sep 1863, a daughter of John Washington Previtte and Elisabeth “Bette” Davis.  in Anson County, North Carolina. She was the third of eleven children borne to John W. and Elizabeth “Bette” Previtte.

William Washington Eddins and Martha E. Previtte were married in 1882 based on information contained in the 1900 census for Chesterfield County, South Carolina.
Married 18 years 5 children 4 living;.

William Washington Eddins and Martha E. Previtte had the following children:

i. Female Infant Eddins died and buried on 2 Sep 1888 at the age of 0 in Chesterfield, Chesterfield, South Carolina, United States.
ii. Fanny J. Eddins was born on 29 Jul 1889 in Chesterfield, Chesterfield, South Carolina; married Hezekiah Smith; died 23 November 1865, Rocky Mount, Nash, North Carolina.
iii.
Ila Violet Eddins was born in Oct 1891 in Chesterfield, Chesterfield, South Carolina; married Jasper Jackson Watts; died 23 July 1971, Concord, Cabarrus, North Carolina.
iv. Henry Thomas Eddins, born 3 Sep 1893, Chesterfield, Chesterfield, South Carolina; married Sally Teal; died 20 Sep 1956, Charlotte, Mecklenburg, North Carolina.
v.
William Benjamin Eddins was born in Oct 1898 in Chesterfield, Chesterfield, South Carolina; married Jessie Viola Kiker; died April 1975, Charleston, South Carolina.

William Washington Eddins died on 20 May 1924 at the age of 60 in Anson County, North Carolina and was buried on 21 May 1924 in Chesterfield, Chesterfield, South Carolina.

Martha E. Previtte Eddins died on 21 Apr 1934 at the age of 70 in Wadesboro, Anson, North Carolina and was buried on 23 Apr 1934 at Zoar UMC Cemetery in  Chesterfield, Chesterfield, South Carolina.

Mrs. W. W. EDDINS - Mrs. Martha Privett Eddins, widow of the late W. W. Eddins, died at her home on the White Store road last Saturday night. The funeral was held Monday by Rev. W. H. Moore at Zoar church, in Chesterfield County, and interment was in the church cemetery.
Mrs. Eddins was a daughter of the late John Privett, and was born in Chesterfield County 71 years ago. She had lived in Anson County for many years. She was an excellent Christian woman and had been a member at Zoar church since girlhood. She was a good neighbor and had a large circle of friends. Many funeral designs showed the esteem in which she was held. She is survived by two sons and two daughters. [The Messenger and Intelligencer, 26 April 1934, page 5.]



Martha E. Previtte Eddins is my Great Grand Aunt. She is a sister to my Great Grandmother Mary Hulda Previtte Purvis.

Treasure Chest Thursday~Asa C. Deese and Mary Anna Huneycutt, 1896.

Mary Anna Huneycutt born 10 Sept 1859, a daughter of David M. Huneycutt and Edith Underwood.

Asa C. Deese, born 2 Oct. 1839, was the son of  Charles Deese and Frances Pigg.

Mary Anna and Asa C. Deese were married on 19 August 1896. Their marriage is recorded in Book 5, Page 27, Union County, North Carolina.
Asa and Mary had one adopted daughter, Carrie Alton Deese, b. 6 Nov 1893. Asa C. Deese died on 4 October 1916 in Wadesboro, Anson County, North Carolina. His wife, Mary Anna, died 2 January 1936.

Their daughter Carrie, married 6 July 1920 and raised a family of five children.

Asa C. and Mary Anna Deese are buried in the Seago Cemetery, Wadesboro, Anson County, North Carolina.  

Mary Anna Huneycutt Deese is my 1st Cousin 3 times removed.

Phillip Hardy Sellers was born 30 October 1875, a son of Phillip Albert Sellers and Anna Jane Douglass of Chesterfield County, South Carolina. He married Ethel “Effie” McManus about 1913.

Phillip Hardy Sellers is my 2nd cousin 3 times removed.

     Whereas Hector McNeil decease late of said County died intestate as we are informed leaving (illegible word??) he lived & at the time of his death divers goods debts rights & credits, within the State aforesaid and we being desiring that the said goods rights and credits may be well & truly administered and converted & disposed of do hereby grant unto James Parker full Power of the (illegible word?) of these present to administered the good & chattels rights and credits of Said deceased which to him in his life time & at the time of his death did belong to ask, levy, recover & receive the same, and pay the debts in which the deceased Stood bound so far as his said goods & rights, credits, land transactions & hereditaments will Extend according to the rate & the order of the law to make a perfect & just Inventory of said goods and chattels, rights & credits and the Lands to Exhibited in the Office of the clerk of this Court at or before the Expiration of three months from the date hereof and to render a Just account of the said administration when due unto legally required and Said James Parker his truly Ordained administrator of all and Singular the goods & chattels, rights & credits moneys & effects of the said deceased.

This is the only known document that mentions the death of Hector McNeill and proved that he died sometime before September 1847 in Carroll County, Mississippi.

Hector McNeill was born between 1791-1800, a son of John McNeill and Louisa Moultrie. He married Mariah W. Norwood of Darlington, South Carolina. He died before September 1847.

It’s Family Time~Ferguson Hale Smith Families

Ferguson Hale Smith was born Sept 1815, a son of Rilah Smith and Timmey Spencer. He was the third born of six children with 2 brothers and 3 sisters.

Ferguson Hale Smith was married three times. He first married at the age of 26 to Catherine Melton  daughter of Lewis T. Melton and Rebecca Lewis. Catherine was born in 1821 in Chesterfield County, South Carolina.

Ferguson Hale Smith and Catherine Melton had the following children:
        i.    Albert M. Smith was born in 1842 in Chesterfield, Chesterfield, South Carolina, United States. He served in the Civil War with Capt. Coit's Company "Chesterfield Artillery" enlisting 25 August 1861. He died 11 Dec 1861 at the age of 19.
Ferguson H. Smith, his father, was paid Seventy-one dollars and thirty-six Cents ($71.36) the pay he was entitled to for those 3 months and 17 days. Payment made by Confederate States of America on April 5, 1862. No. 327, Confederate States of America, Treasury Department. Film #1447136.
         ii.    Elisha Brown Smith, born 29 Jun 1844, Chesterfield, Chesterfield, South Carolina; married Martha Jane Graves, abt 1866; died 8 Jun 1925, Chesterfield, Chesterfield, South Carolina.
         iii.    L. Elizabeth Smith was born in 1846.

Ferguson’s wife, Catherine Melton Smith, died about July 1867 leaving him was a large family to care for while still maintaining his daily farming chores.
Ferguson needed a wife and he found her in the form of the Widow of William Rivers who had died in the Civil War. The widow, Mary Ann Graves Rivers, was the daughter of Thomas J. Graves and Eliza Mollie Rivers. Mary Ann was born in 1838 in Chesterfield, Chesterfield, South Carolina and had one son, Thomas J. Rivers, born to the union between her and William Rivers.
Ferguson Hale Smith and Mary Ann Graves Rivers were married about 1867. This date is based on the birth of her first child to this union on 29 August 1868 and the death of Ferguson’s  1st wife Catherine about July 1867.

Ferguson Hale Smith and Mary Ann Graves had the following children:

        i.    Rev. Adolphus Bunyan Smith, born 29 Aug 1868, Chesterfield, Chesterfield, South Carolina; married Jesse E. Flake, 24 Dec 1895, Anson County, North Carolina; died 7 Nov 1932, Charlotte, Mecklenburg, North Carolina.
        ii.    Marion Augustus Smith, born 25 Nov 1870, Chesterfield, Chesterfield, South Carolina; married Annie Virginia Jones; died 18 Nov 1954, Rockingham, Richmond, North Carolina.

Sadly, Mary Ann Graves Rivers Smith died shortly after the birth of her son, Marion Augustus Smith, on 25 Nov 1870.

Ferguson Hale Smith then married his 3rd wife, Ann Rebecca Powell. Ann, age 24, was born 8 Jan. 1847, a daughter of Thompson B. Powell and Mary Boatwright.

Ferguson Hale Smith and Ann Rebecca Powell had the following children:

    i.    Arthur P. Smith, born 29 Sep 1872, Chesterfield, Chesterfield, South Carolina,; married Susie Coker, 1900; died 23 Apr 1947, Columbia, Richland, South Carolina.
     ii.    Etna Florence Smith, born 16 Aug 1877, Chesterfield, Chesterfield, South Carolina; married Carl Gerome Morgan; died 7 Apr 1937, Chesterfield, Chesterfield, South Carolina.
     iii.    Nettie M. Smith was born in Dec 1879 in Chesterfield, Chesterfield, South Carolina She died 28 April 1967, Florence, Florence, South Carolina.
     iv.    Mamie Clara Smith, born 4 Feb 1882, Chesterfield, Chesterfield, South Carolina; married Jesse Lee Jenkins; died 1 Jan 1975, Pageland, Chesterfield, South Carolina.
     v.    Annie Garfield Smith was born on 11 Dec 1884 in Chesterfield, Chesterfield, South Carolina She died on 24 Nov 1946 at the age of 61 in Chesterfield, Chesterfield, South Carolina. Buried at Hopewell, never married.


Ferguson Hale Smith was a farmer and raised 17 children with 3 wives and one step-child.

Mary Ann Graves Rivers Smith, the second wife of Ferguson Hale Smith, is my 1st Cousin 4 times removed.

The Estate Lands of Marcus “Mark” Huneycutt


Marcus “Mark” Huneycutt is my 3rd Great Grandfather. He died sometime between 1860 and 1870. No record of his death or tombstone has been found as of this posting. The last known record of Mark is the 1860 Census for Stanly County, North Carolina.

Regardless of when he died his impact on his descendants was enormous. The settlement of his Estate lingered in the courts into the early 1900’s. By then all his children, except his son Martin Irensus Huneycutt, were deceased and the remnants of his estate (land) was sold and divided between his grandchildren and greet-grandchildren.

One of those recipients was Lucy Deese, my Grandmother and the  Sr. great-granddaughter of Marcus “Mark” Huneycutt.

Back in August 2019, I shared a land deed, dated March 1911 that was the final disposition of the Marcus "Mark" Huneycutt Estate Lands.
Since that posting, I have found two other land deeds regarding the estate lands of Marcus “Mark” Huneycutt. Today’s land deed is from DEED BOOK 28, pages 481 & 482 and is titled - R. W. Simpson, Commr. to M. I. Huneycutt.

This M. I. Huneycutt is Martin Irenus Huneycutt, the son of Marcus Huneycutt, Sr. deceased.

             This Deed, made by R.W. Simpson, Commissioner, under a Judgment of the Superior Court of said county, in the Special Proceeding entitled M. I. Huneycutt, B. L. Huneycutt, D. E. Huneycutt et. al. against A. J. Huneycutt, Lizzie Garibaldi et. al.  to M. I. Huneycutt of Stanly County. Witnessseth: That whereas the said R. W. Simpson being thereto licensed by a Judgment in said Proceeding, did, on the First day of September, 1902, after due advertisement, expose the land hereinafter described to public sale at Court House door in Albemarle and then and there the said M. I. Huneycutt became the last and highest bidder for said land at the sum of Five Hundred & Ten Dollars, and complied with the terms of sale; and whereas upon report of said sale to said Court, the same was confirmed and the said R. W. Simpson, Commissioner as aforesaid was ordered by the Judgment of said Court to execute a Deed in fee simple to said purchaser, upon payment of said purchase money; and whereas, the said purchase money has been paid in full; Now, in consideration of the premises, the said R. W/ Simpson, Commissioner as aforesaid, doth hereby Bargain, sell and Convey to the said M. I. Huneycutt his heirs and assigns that certain parcel or tract of land situate in said County (page 482) adjoining the lands of Levi H. Huneycutt, Sam Hinson, Frank Whitley and others in Furr Township and bounded as follows: Beginning at a post oak, 2 red oaks, dogwood and pine in the Jas. L. Hartsell old line & runs with said line No. 75 Wt. 6 chs. to said Hartsells Corner on the bank of watery branch, thence the same course continued in all 25 chs. to a post O. by a post oak & 2 red O's; thence N. 10 Et. 60 chs. to a stake by a post oak & 2 red oaks, thence due east 35 chs. to a post O, by a red O & 2 black Jacks; thence So. 10 Wt. 30 chs to a post oak in a branch by 2 dog woods, a sweet gum & a pine; thence direct course to the beginning, known as the Mark I. Huneycutt lands containing Two Hundred acres, more or less.
To have and to hold said Land, with its appurtenances to him the said M. I. Huneycutt heirs and assigns forever, in as full and ample manner as said R. W. Simpson, Commissioner as aforesaid, is authorized and empowered to convey the same. In witness whereof, the said R. W. Simpson, Commissioners, etc., hath hereto set his hand and seal, this 9 day of April 1903.

This deed is dated 9 April 1903. The Court appointed Commissioner, R. W. Simpson, has sold the land to “the said M. I. Huneycutt became the last and highest bidder for said land at the sum of Five Hundred & Ten Dollars, and complied with the terms of sale; and whereas upon report of said sale to said Court, the same was confirmed and the said R. W. Simpson, Commissioner as aforesaid was ordered by the Judgment of said Court to execute a Deed in fee simple to said purchaser,...”
This should have been the end of the probate but as shown above in my earlier posting some of the heirs-at-law brought suit and the final outcome lingered for another eight years until March 1911.

Marcus “Mark” Huneycutt is my 3rd Great Grandfather.

Today’s subject is a  Deed between Samuel Dees to Daniel M. Johnson, 1843.

Samuel Deese is my 2nd Great Grandfather. His wife was  Sarah “Sallie” Hill, b. about 1815, Anson County, North Carolina. The parents of Sarah “Sallie” Hill is one of my “Brick Walls”. For over 40 years no-one, including myself, has proven the parents of Sarah “Sallie” Hill. Yes, I know there are many online trees that says her parents are Rev. John Hill (1749-1817) and his wife, Huldah Jackson (1764-1840).

The Family Bible of Rev. John Hill is included in his Rev. War Records and yes he had a daughter Sarah that died young plus his will has no mention of a daughter Sarah living after his death in 1817.

I’m a dedicated researcher that has used land deeds to solve many genealogical problems. So, I went looking for Land Deeds executed by Samuel Deese, Sarah Hill or Sarah Deese. I found one and it was no help; but, I will share it here today.

Anson County} This Indenture is made this the 14th day of February 1843 between Daniel Johnson on one part and Samuel Dees on the other The following obligation are as follows, viz; I Samuel Dees do give bargain sell and release one brown Mare Mule and the crop that I expect to make this Season for the consideration of forty dollars paid to me Samuel Dees in hand also for the rent of the place on which the said Dees lines, Viz: twenty-five Hundred pounds Cotton in the Seed to be delivered as gathered from the field. The conditions of the above obligation are such as when the said Samuel Dees pays the above-named sum in money to the said Johnson together with the rent they are null and void but in otherwise to remain in full force and affect.             Daniel M. Obituary Sunday~Jim McDuffie Lost



JIM McDUFFIE LOST
Jim McDuffie, who lived on the Cheraw-Morven road near the Britt school House not far from the North Carolina line, has wandered away from home.
His mind unbalanced, Jim McDuffie left home Tuesday, taking his little boy with him. The following Thursday the two were found in the woods not far from home. The boy was taken home but the father refused to come. It was thought that he would soon follow but he failed to do so and Sheriff J. T. Grant and his deputy, Mr. C. J. Sellers were notified.
A posse of bout 40 men was formed and the woods were searched Saturday, Sunday, Monday and Tuesday, day and night, but no trace of him was found.
Though demented he is considered harmless. He is about 55 years of age and when last seen was wearing a black hat, blue shirt and yellow corduroy pants, and was barefooted. He has a cancer on one side of his face and nose; is about 5 feet and 6 inches in height; weighs about 140 pounds and had dark mustache.
The Sheriff requests that he be notified by anyone seeing this man.

James Daniel McDuffie was born in Sept 1865, a son of John William McDuffie and Elizabeth Morris of Anson County, North Carolina. In 1889, he married Mary Melissa Morris, a daughter of Joseph Morris and Jane “Jenny” Burr.

After the birth of 6 children, Mary Melissa passed away about August 1909. All indications are that she died shortly after the birth of her sixth child, Paul Joseph McDuffie on 31 August 1909. Her death left James Daniel was 6 children ranging in age from 17 to the baby just born.

The article above states that “His mind unbalanced, Jim McDuffie left home Tuesday, taking his little boy with him.“ The small boy most likely was either Daniel or Paul Joseph. The sheriff found both Jim and his son. They took the son with them and left Jim alone where they found him. The decision to leave Jim resulted in the loss of his life as indicated with the below Death Certificate. 

James McDuffie died on 11 September 1921 after leaving home 4 days earlier. 


James Daniel McDuffie was my 1st Cousin 3 times removed.
