Sale of the Real Estate of Stephen Brock, deceased

The State of South Carolina
                                      To all to whom these presents shall come or be made known, Or whom the same may in anywise concern, I, Hugh Craig, Judge of Probate, for the County of Chesterfield in the said State, Send Greetings: Whereas P. H. Brock on of about the Fourth day of January in the year one thousand eight hundred and seventy did exhibit his Petition in the Court of Probate at Chesterfield C. H. in the Country of Chesterfield and sate aforesaid, for the division or sale of the real Estate of Stephen Brock deceased, situated in said County of Chesterfield in the town of Cheraw, and whereas upon the filing, of said Petition or summons in Petition was ifsued from the said Court and served upon the heirs and representatives of the said Stephen Brock and the Cause, being at issued before the Honorable Court aforesaid, came on to be heard on the thirteenth day of January one thousand eight hundred and seventy when the said Court, after a full hearing thereof, and mature deliberation in the premises, did Order, adjudge and decree that the Lot or parcel of land hereinafter mentioned and described, should be sold at Public Auction, by the Sheriff of Chesterfield County, on the terms,  for the purposes mentioned in said Decretal Order, as by reference thereto, in the Registry of the said Court, will appear;  And the said P. F. Stafford Sheriff of Chesterfield County, after having duly advertised the said Lot or parcel of Land for sale, by public outcry, on the seventh day of February in the year of our Lord one thousand eighth hundred and seventy Did then openly and publicly and according to the custom of Auction, sell and dispose of the said Lot or parcel of land below described, unto Peter H. Brock for One Hundred dollars being. At that price, the highest bidder for the same. Now Know All Men, That I, the said Hugh Craig, Judge of Probate, of Chesterfield County, in consideration of the premises, and also in consideration of the sum of One Hundred Dollars Paid me by the said Peter H. Brock  the receipt whereof is herby acknowledged,Have granted, bargained, sold and release, and by these presents Do grant, bargain,sell and  release unto the said Peter H. Brock and his heirs and Assigns, All the right, Title, interest, claim and demand which the said Stephen Brock in his life time and at the time of his death, had of, in and to a certain Lot or parcel of Land, situate in the Town of Cheraw and State aforesaid, known and distinguished in the plan of said Town as number Two Hundred and forty-six (246) on Market Street contained, reference being had to the plan of said Town will more fully appear Together with all and singular the rights, members, hereditament, and appurtenances whatsoever, to the said premises belonging or in anywise appertaining and the recessions and remainders, rents,issues and profits, benefits claim and demand whatsoever, both at Law and in Equity of the said Stephen Brock and of all the parties to the said suit, and of all persons rightfully claiming or to claim the same or any part thereof, by,from, or under them, or either of them. To have and to Hold the said Lot or parcel of land with its hereditaments, privileges and appurtenances, unto the said Peter H. Brock his heirs and assigns forever. In Witness, whereof I, the said High Craig, Judge of Probate for Chesterfield County, under and by virtue of the said Decree have hereunto Set my Hand and Seal, at Chesterfield C. H. this seventh day of February in the year of our Lord One thousand eight hundred and seventy and in the 94 year of the Sovereignty and Independence (pg. 45) of the United States of America.

Peter Haley Brock is the oldest of 5 sons borne to Stephen Brock and Nancy Smith. Stephen Brock parents are not proven; his wife, Nancy Smith is the daughter of Wiley Smith and Mary [LNU]. Stephen and Nancy had six children. Stephen Brock died 11 Septembert 1867. His wife, Nancy, died 12 Janauary 1878. They are buried in Old Saint Davids Episcopal Church Cemetery.

Stepen Brock is most likey my 2nd Great Grand Uncle.
