Stanly County NC Estate~Marcus ‘Mark’ Huneycutt

After years of research all that is known about the death of my 3rd Great Grandfather is that he died sometime between 1860 and 1870.  No record of his death or a tombstone has been found.
No Last Testament and Will has been found but there was a probate of his estate.
Mark I. Huneycutt  1
Probate Folder
Mark Huneycutt Estate Folder
https://familysearch.org/pal:/MM9.3.1/TH-1942-35569-26321-38?cc=1911121
I’m know this estate was created for the sole purpose to protect the heirs at law in the division of the real estate and personal property of one Mark I. Huneycutt.

The last record we have for Mark Huneycutt is his presence in the 1860 Census for Stanly County.

1860 CENSUS: Stanly County, North Carolina; Roll: M653_914; Image: 18; Family History Library Film: 803914, Page: 9 (stamped); Line 30, Dwelling 113, Family 113; Mark HUNEYCUTT, male, age 60, born in NC; Charity HUNEYCUTT, female, [wife], age 57, born in NC; Martin I. HUNEYCUTT, male, age 24, born in NC; Sallie HUNEYCUTT, female, age 28, born in NC; Bedy L. HUNEYCUTT, female, age 17, born in NC; John FURR, male, [Son-in-Law], age 30, born in NC; Betsey [HUNEYCUTT] FURR, female, age 21, born in NC and Mary E. FURR, female, [grand Daughter] age 9/12, born in NC

His wife Charity Dry is listed (without husband) in the 1870 Stanly County Census.

1870 CENSUS: Furr, Stanly County, North Carolina; Roll: M593_1160; Image: 127; Family History Library Film: 552659, Page: 58A(stamped); Line 25, Dwelling 4, Family 4; Cath [Charity Dry] HUNEYCUTT, Female, age 70, born in NC; Sarah HUNEYCUTT, Female [Daughter], age 37, born in NC; Beedy L. HUNEYCUTT, Female [Daughter], age 22, born in NC and Tobitha [Tabitha] HUNEYCUTT GrandDaughter], Female, age 15, born in NC.

This seems to indicate that Mark passed away between 1860 and 1870. But, why did the heirs wait until 1902 to settled his estate.

There are 24 images or pages to his estate on Family Search. I think the estate is incomplete. The earliest document is Image 13 and 14; both related to appointing a Guardian for my Grandmother and her two sisters.

The three sisters, Pearl, Etta and Theresa are grandchildren of Mark through his daughter Louvena Huneycutt Deese. It was amazing to see my grandmother named within this probate file.

  Image 14_Mark Huneycutt

The next document I want to discuss is a documents listing the children of Mark and Charity Dry. That document is image 19.

The Children of Mark and Charity are:

James W. Huneycutt, age 28, enlisted into Company ‘C”, 42th NC Infantry.1 The 42th NC Infantry was organized at Salisbury, North Carolina, in April, 1862. The unit served gallantly until it’s surrendered with the Army of Tennessee at the end of the War. Company “C:” consisting mostly of men from Stanly County, NC were led by Capt. D.A. Underwood, Stanly Co. and Capt. Jas. A. Howell, Stanly Co.  There were 10 Company’s within the 42nd Infantry.

The 42nd NC Infantry fought at:
Its losses were minimal for the the duration of the war.
“This unit lost 6 killed and 48 wounded at Ware Bottom Church and had 1 killed, 2 wounded, and 74 missing at Sugar Loaf. It surrendered on April 26, 1865.” 2

Treasure Chest Thursday~Marriage of D. E. Huneycutt and Beadie Starnes, 1894

On 2 April 1894, fifty-three year old Darling Ephraim Huneycutt and fifty year old Beadie Starnes were married by H. H. Huneycutt, a Baptist Minister in Stanly County, North Carolina.

Marriage D. E. Huneycutt & Beada Huneycutt Starnes

I, H. H. Huneycutt, a Baptist Minister united in matrimony D. E. Huneycutt and Belbie [Beada] Starns the parties licensed above, on the 2nd day of April 1894 at Arrenus Huneycutt house in Almond Township, in said County, according to law.

N. M. Bowers
                                                     H. H. Huneycutt

This would be the second marriage for both Beadie and her new suitor, Darling Ephraim. Beadie’s husband, Nathan T. Starnes had passed away 2 years and 3 months earlier on 24 December 1891. Darling Ephraim’ wife, Lunda Manuel, had died on 18 Jul 1893. just 8 1/2 months earlier.

Darling’s 4 children and Beadie’ only child would create a blended family of three daughters and 2 sons.

D. E. Huneycutt Marriage

Beadie Huneycutt Starnes Huneycutt daughter of Marcus Huneycutt and Charity Dry died between 1900 and 1905. I have not found a record of her death but a through search has not yet been completed.

What I do know is that on 6 June 1900 Darling E. Huneycutt and his wife Beada Huneycutt were enumerated in the 1900 Census for Almond, Stanly County, NC, Page: 4A/182 (stamped); Line 29, Dwelling 56, Family 57.

Then on 30 March 1905 Darling E. Huneycutt (age 64)  married Annie Whitley (age 43) in Stanly County, NC.

Therefore, Beada Huneycutt most likely died between 6 June 1900 and 30 March 1905.

Beada Huneycutt is my 2nd Great Aunt.

Tuesday’s Tip~Confirmation, Verification of Derivative Sources

Here a good case why derivative sources should be double checked. My 3rd Great Grandmother is Charity Dry wife of Martin ‘Mark’ I. Huneycutt. Many on-line trees have a man by the name of Martin Dry as her Father; so I’m off looking for Martin Dry in all available resources within my library and on-line.

On of those major resources is a book compiled by Thornton W. Mitchell in 1987, revised and republished in 1992. His book is:

North Carolina Wills, A Testor Index, 1665-1900

I have a Corrected and Revised Edition and on Page 142 of that book Martin Dry is listed.

Martin Dry-Mitchell

Thornton W. Mitchell’s book says that Martin Dry left a Will in 1837 and that it can be found in PQS 5/405 (Pleas and Quarter Sessions, Book 5, page 405).

Now, I’m a genealogist and I found this information about a week ago. Due West of me about 40 miles, by Interstate 85, is the County seat of Cabarrus County, North Carolina. I’m ready to head west and get a copy yesterday. So early this morning the wife and I drove over to Concord, North Carolina to retrieve this WILL.

It was not to be!! I left empty handed.

I was informed by the very nice clerk at the front window that all those books had been transported to the State Archives for safe keeping. She did say I was welcome to examine the basement and see if what I was looking for was still on-hand and had not yet been shipped. So I took a stroll down the stairs into the basement of the Cabarrus County Courthouse. To me this small excursion was very fruitful. While I DID NOT find the Pleas and Quarters Session books; I did find several indexes and one of those index books that  I found was a Will Index Book.

So I open up the WILL INDEX Book to the page for the DRY surnames and low and behold but there he was listed on the very first line.

IMG_0199-Martin Dry

BUT, his WILL IS NOT in PQS-5, page 405 according to this WILL INDEX BOOK; it is listed being in PQS-2, page 405.

Mitchell’s Book is WRONG according to the Courthouse indexes.

I will not go so far as to say that this typewritten Index is an Original Source but I will say that I would put more faith in the data within the Index over the Book.

I still need a copy of this WILL and while Raleigh, NC is just a 1 1/2 hour trip eastward  I instead went to the NC State Archives and requested a copy of the Will by e-mail -- http://req.archives.ncdcr.gov/

Has requested information on A Court Minute.
For Person: Martin  Dry
In Year: 1837
County: Cabarrus County
Other  Info:
Seeking the Will of Martin Dry, 1837
Will Index at Cabarrus Courthouse show WILL is in
Pleas and Quarter Session 2/405
Thornton Mitchell Book give source as
Pleas and Quarter Session 5/405
Charles L. Purvis

This is a good lesson in the necessity to verify information from derivative sources.

It’s Family Time~Marcus “Mark” I. Huneycutt Family

Family Time
Marcus I. "Mark" Huneycutt was born about 1797 in Montgomery County, North Carolina.1 His parents are not known and have been a high priority for my research time. Mark and his family appeared in the 1830 census for Cabarrus County, North Carolina. By 1850, he had moved to Stanly County, NC and acquired a 100 acre Grant from the State. From 1850 through 1860 he was enumerated in Stanly County census. 2 3 4 5 6 Mark died sometime before the 1870 Census.7

Marcus I. "Mark" Huneycutt and Charity Dry were married on 18 Mar 1822.8 Charity Drye was born about 1803. 9 10

Marcus I. Huneycutt and Charity Dry had the following children:

i. John Wiley Huneycutt, born 16 Jan 1823; married Elizabeth Brooks.
ii. Tobias A. Huneycutt, born abt 1824, Stanly County, North Carolina; married Elizabeth Mariam Huneycutt, 7 Nov 1852, Stanly County, North Carolina.
iii. David M. Huneycutt, born abt 1828; married Edith Underwood.
iv. William Riley Huneycutt, born Mar 1830; married Lydia Brooks, 14 May 1851, Stanly County, North Carolina.
v. Sarah "Sallie" Huneycutt, born abt 1831.
vi. James W. Huneycutt, born 26 Apr 1833, Cabarrus Country, North Carolina; married Sarah Elizabeth Page, 20 May 1855, Stanly County, North Carolina; died 19 Nov 1896, Chesterfield, Chesterfield, South Carolina.
vii. Martin I. Huneycutt, born 14 Dec 1835, Montgomery County, North Carolina; married Unicey [LNU].
viii. Elizabeth "Bettie" Huneycutt, born abt 1838; married John Furr.
ix. Beada Huneycutt, born abt 1842; married Nathan T. Starnes, 6 Apr 1882, Stanly County, North Carolina.

The children are all named within the Probate file of Marcus I Huneycutt. What is not known is when, where and how both Mark and Charity passed away. I know it was before 1880. Marcus is not listed in the 1870 Census but Charity is; neither is listed in 1880 Census.

The discovery of Marcus as the father of my 2nd Great Grandfather, James W. Huneycutt is a very recent find, so much work remains to be done on this family and the identification of Marcus and Charity’s parents.

Marcus and Charity Huneycutt are my paternal 3rd Great Grandparents.

Amanuensis Monday is a genealogy blogging theme. It was started by John Newmark who writes the TransylvanianDutch blog.

His definition of Amanuensis is:
Amanuensis: A person employed to write what another dictates or to copy what has been written by another.

Today’s subject is a list of heirs of Mark I. Honeycutt from his probate folder, Probate Office, Stanly County, North Carolina.1

Mark Honeycutt married Charity Dry on 18 Oct 1822 in Stanley County, North Carolina.
The last census in which Mark Honeycutt was found is the 1860 Census for Stanly County, North Carolina. He’s there with his wife and 4 of his children, a new son-in-law, John Furr and his first born grandchild Mary E. Furr.
1860 CENSUS: Stanly County, North Carolina; Roll: M653_914; Image: 18; Family History Library Film: 803914, Page: 9 (stamped); Line 30, Dwelling 113, Family 113; Mark HUNEYCUTT, male, age 60, born in NC; Charity HUNEYCUTT, female, [wife], age 57, born in NC; Martin I. HUNEYCUTT, male, age 24, born in NC; Sallie HUNEYCUTT, female, age 28, born in NC; Bedy L. HUNEYCUTT, female, age 17, born in NC; John FURR, male, [Son-in-Law], age 30, born in NC; Betsey [HUNEYCUTT] FURR, female, age 21, born in NC and Mary E. FURR, female, {grand Daughter] age 9/12, born in NC.2
After challenging a local Facebook group to help identify the parents of 2nd Great Grandfather, James W. Huneycutt, a long time friend, Julie Hampton, found the probate file of Mark Honeycutt.I had given her a Family Group Sheet for James W. Honeycutt which enabled her to identify Mark Honeycutt as the father of James W. Honeycutt and thus my 3rd Great Grandfather.

From the 1850 and 1860 Census I have identified 7 children for Mark and Charity Honeycutt. However, one document from that probate folder shows that there were 9 children; thus I an missing two children. These two are sons, Wiley and David Honeycutt.

The above document has the Children of Mark and Charity Honeycutt listed on the left and their surviving children on the right side. Remember, Mark was last found in an 1860 Census; these probate records are dated  January 1902 through 1911 and deals mostly with the partition of lands because there are so many descendants that they are unable to partition the land; it must be sold.
Children of Mark Honeycutt listed are:
  1. Martin I. Honeycutt
  2. James W. Honeycutt
  3. Wm [R.] Honeycutt
  4. Wiley Honeycutt
  5. David Honeycutt
  6. Tobe/Tobias Honeycutt
  7. Bettie Furr
  8. Sarah Daze
  9. Beadie Honeycutt
Wiley and David are not listed in the household in 1850 and 1860. It is believed that Mark Honeycutt died between 1860-1870 and the children kept farming the 100 acres of land he received in 1848 from Land Grant #151. No death date or tombstone had been found for Mark or Charity Honeycutt.

Mark and Charity Dry Honeycutt are my 3rd Great Grandparents.
