Chesterfield County SC Estates~Estate Folder #460~The Case of Franklin T. Brock

Each week, on Sunday, I will select an Estate Folder from the Estate files of Chesterfield County and discuss its contents. No known estates exist for the period before the Civil War. They were destroyed by the burning of the Courthouse. There are a few “Equity Records” in the State Archives. Do not overlook this valuable resource if you are looking for ancestors in Chesterfield County, South Carolina.

When Stephen Brock and his wife Nancy Smith Brock passed away they left among their heirs a young son named, Franklin T. Brock,  who was unable to care for himself.

Stephen had passed away on 11 Sept 1867 and young Franklin who was  born on May 20, 1860 was left in the care of his mother, Nancy Smith Brock.

Then on 12 January 1878 Nancy passed away leaving 18 year old Franklin unable to care for himself and without a guardian. Franklin had three (3) living brothers; so he wasn't left alone.  

On July 17 1879, Franklin brother Irvin Samuel Brock petitioned the courts stating that ”The petitioner (Irvin Samuel) had boarded, clothed and cared for the said [Franklin] for nearly fifteen months without any pay or compensation. And submit herewith his account Marked Exhibit “A” for his reasonable charges and expenses…”  [Images 1563 and 1564]



H. D. Malloy and T. F. Malloy on their oath states that the Petition is true to the best of their knowledge and the charges and expenses are reasonable.  Dated 29 July 1879

On 29 July 1870 The Courts allowed for the payments, charges and expenses along with the Court and attorney cost to be paid out of any funds in possession of the Courts belonging to Franklin T. Brock.  [Images 1568]

Franklin T. Brock passed away in October 1880. 

Franklin T. Brock is my 1st Cousin 3 times removed.

Treasure Chest Thursday~Petition for Guardianship of William Calhoun Brock

On 11 September 1867, Stephen Brock, passed away leaving his widow, Nancy Smith  and 6 children ranging in age from 19 to 4 years  of age. There were 5 sons and a daughter.
Then on 12 June 1878, Nancy Smith Brock passed away leaving two children under the age of twenty-one.

Irvin Samuel Brock, a brother to William Calhoun Brock, petitioned the Courts for Guardianship of his younger brother.

             To the Honorable W. J. Hanna Judge of Probate for said County
The Honorable petition of the undersigned Respectfully Represents
I. That your petitioner is a minor under the age under the age of twenty one years and over the age of fourteen years.
II. That your Petitioner as Heir at Law of his Mother Nancy Brock is Entitled to an inheritance of Personal property of the value of One hundred and Fifty Dollars
III. That your Petitioner has no one to take charge of the said personal Property for him
                  Wherefore your Petitioner Prays that this Court appoint Irvin S. Brock his Brother to act and Serve as his Guardian to take control and charge of the above mentioned Property and your Petitioner will ever Pray + c

I consent to serve as Guardian of William C. Brock if appointed by the Court.

William Calhoun Brock grew up, married Lulu McGrath of Virginia on 13 Nov 1894 and raised a family of five children; four daughters and a son. William C. died at the age of 57 on 5 December 1920. 

William Calhoun Brock is my 1st Cousin 3 times removed.

Stephen Brock died intestate on 11 September 1867 in Cheraw, Chesterfield County, South Carolina. 

His wife, Nancy Smith Brock, daughter of Wiley and Mary Smith was named administratrix of the Estate.

The estate folder show that an inventory was performed with the following item documented.

















Stephen Brock owned a lot in the town of Cheraw known as Lot 246 for which Peter Haley Brock petitioned the court to sell so that he could get his share.

The petition of Peter H. Brock

Sheweth that Stephen Brock late of said
County lately died intestate having him surviving
his widow Nancy Brock, P. H. Brock, Irvin S. Brock, Frank Brock & Calhoun Brock, and that the said intestate was Seized & possessed in his own right of the one half interest in a certain lot in the town of Cheraw Numbered 246 on Market Street continued-
Your petitioner being desirous of obtaining his share of the above property prays that a summons in partition do ifsue for the division or sale of the same.

To Nancy Brock, P. H. Brock, Irvin S. Brock, Frank Brock and Calhoun Brock legal heirs of Stephen Brock, who died intestate, Greetings-
You are hereby required to appear at the Court of probate, to be holden at Chesterfield Court House for Chesterfield County on Thursday the 23th day of January, A.D. 19870, to show cause if any you can, why the real estate of Stephen Brock deceased, situated in the County of Chesterfield and Town of Cheraw known as Lot No. 246 on Market street continued, should not be divided or sold, allotting to the said Nancy Brock the one third party thereof and to the said P. H. Brock, I. S. Brock, Frank Brock and Calhoun Brock each an equal share in the remaining two thirds.
Given under my hand and seal this 10^th day of January A. S. 1870.

Stephen Brock and Nancy Smith were married about 1847. In the 1850 census their first two children, Peter and Thomas, were ages 2 and 1. 

Several documents in this file names the heirs-at-law but mostly the file centered on Lot 246 in the town of Cheraw and the sale of said lot. 

Stephen and Nancy had 6 children; four are named above - P. H. Brock, Irvin S. Brock, Frank Brock and Calhoun Brock, Not named in the Estate are:  Thomas (1849-1850) and Louisa Jane (8 Oct 1851-12 Mar 1865). 

Nancy Smith Brock died 12 January 1878; eleven years after the loss of her husband, Stephen. They are buried in the Old St. David’s Episcopal Church cemetery.
