1791 Land Deed~Benjamin Davis to Rachel Godfrey

Benjamin Davis to Rachel Godfrey

South Carolina} To all whom these presents shall come, or may in anywise Concern I, Benjamin Davis of the County of Liberty in the District of Georgetown and State of South Carolina Send Greeting Know Ye that I the said Benj. Davis for and in consideration of the great love good will and affection which I have and for and to bear to my daughter Rachel Godfrey wife of Richard Godfrey of the County & State aforesaid have given and granted and by these presents do give freely clearly and absolutely give and grant unto my Said Daughter and their lawful Ifsue of her Body three negroes Viz: Jockey Roxanna and Phillis together with all their increases until to have and to hold the said negroes Jockey, Roxana and Phillis together with their increases unto my Said Daughter Rachel Godfrey and her lawful Ifsuse to her and there only proper use and behoof forever but for the Want of Such Ifsuse the said Negroes and their increases must return to my other Children Viz: Ann, David, Joseph, Benjamin William and Henry and their lawful Ifsue of their bodied, and by them to be equally Divided share & Share alike and in farther Testimony whereof I have this day delivered my Said Daughter Rachel Godfrey and put her in possession of Roxana & Phillis in the name of the whole for the above purpose without conditions. In witnefs whereof I have hereunto Set my hand and seal the twelfth day of April in the year of our Lord one thousand Seven Hundred & ninety one and in the fourteenth year of American Independence.

Sign Seal and deliver the within instrument of Writing to the within names Rachel Godfrey for the uses and purposes therein contained inscribed and that the also Abraham Britton subscribe his name to the Same as a witnefs with her Self. Benjamin Davis was borne 17 July 1719 in Merion Township, Pennsylvania. Family members left Pennsylvania migrating into Delaware and finally to the Welsh Tract and Marion District of South Carolina. Benjamin arrived in the Cheraw District in 1739. 

On 21 February 1748/1749, William Davis married Rachel Port, daughter of Joseph Port and his wife Ann.  Benjamin Davis and Rachel Port had a family of twelve (12) children. 

When this Deed was executed on 12 April 1791, we can see by the children named that only  7 of their twelve children were named; the other having already passed away. Not named were sons, John, David, James and Francis; daughters, Mary Ann and Margaret.   

Benjamin A. Davis, Sr., died 27 September 1797. Rachel (Port) Davis died between 1800 and 1810. NOTE: Her FindAGrave memorial show that she died in Oct 1823 at the age of of 91. No source is given for this information. Her actual death date is currently unknown. 


Benjamin and Rachel are my 5th Great Grand Uncle and Aunt.

Two Men, One Name, 3 Wives

It amazes me to see the menagerie created by “family historian.” How can anyone with an education take two men with 23 years difference in their age and with different wives; mix them up and combine them to create another person.

To add to this menagerie both of these men are said to be sons of Uriah Page.

The Name:

Today we will look at these two men's with the name – Dempsey Page.

Dempsey Page, borne about 1793.

This Dempsey Page married a lady named Macey [Last name unknown].

Dempsey & Macey had 6 children based on an 1850 Census listing Montgomery County, North Carolina.

The Children of Dempsey Page & Macey are:

i. Tedrick Page was born about 1829.

ii. Wiley Page, born abt 1832; married Malinda Hagler, 24 Aug 1852, Cabarrus County, North Carolina.

iii. Delila Page was born about 1835.

iv. Edmund Page was born about 1841.

v. Sally Page was born about 1844. I'm certain that Sally was born Sarah Lucinda Page, 4 Aug 1845, a daughter of Dempsey Page and Maxey [LNU].   

vi. Darus Page was born about 1847.

No record of Dempsey, Macey and most of their children has been found after 1850, Stanly County, North Carolina. Marriage and several other listings were found for Wiley Page to Malinda Hagler and Sarah Lucinda Page to John Wesley Burleson.

Dempsey Page, borne 1815:

This Dempsey Page first married a lady named Melinda Brumly on 27 September 1843 in Cabarrus County, North Carolina. To this union was borne 6 children; four daughters and two sons. Melinda (Brumly) Page passed away at some point prior to 19 March 1867. With small children to care for, Dempsey married Elizabeth F. Stancil on 19 March 1867.

Many online trees have Dempsey Page listed as Marion Dempsey Page. Marion Dempsey Page and Dempsey Page are again two different men. Dempsey Page was born 1815 probably in Montgomery County, NC; he may be the son of Uriah Page and Gracey.

Marion Dempsey Page was born in Jun 1846 in Edgecombe County, NC to Elizabeth Page.

Dempsey Page and Melinda Brumly had the following children:

i. Jane C. Page was born about 1845.

ii. Mary Ann Page, born abt 1847; married Robert May, 23 Dec 1867, Rowan County North Carolina.

iii. Simon Peter Page was born about 1849.

iv. Laura E. Page, born abt 1852; married Lewis H. May, 27 Nov 1870, Rowan County North Carolina; married John Alfred Clampet, 1879, Rowan, North Carolina.

v. Martha Page was born about 1857.

vi. John Allison Page, born abt 1860; married Laura Ann Foust, 12 Mar 1881, Rowan County North Carolina.

Dempsey wrote his Last Will and Testament on 18 March 1879. His estate was probated 4 April 1879 with Milas A. File named as Executor.

Dempsey Page died between 18 March 1879 and 4 April 1879.

It’s Family Time~The George W. Rummage Family

George W. Rummage was borne about 1834 in Montgomery County, North Carolina, a son of Thomas Rummage and his wife Nancy. 

Lydia G. Laton was borne  abt 1830 in Montgomery County, North Carolina, a daughter of John Laton, Sr. and his wife Catherine Dry. 

George W. Rummage and Lydia G. Laton were married  on 27 November 1856 in Stanly County, North Carolina. 

Then in April 1861, the Civil War began dragging all our young men into the conflict. George W. Rummage enlisted into Company “G” 42nd Infantry on 1 February 1862. He was captured, held as POW and died of disease on 6 November 1864 at Richmond, Virginia. 

In March 1869, Lydia G. Laton passed away leaving one son surviving.  

Their only known child, Robert F. Rummage, borne 30 April 1858 lost his father in the Civil War in November 1864 and his mother to an unknown cause in  March 1869.

In the 1870 Census, Robert F. Rummage can be found in the household of D. F. (Doctor Franklin ) and Elizabeth (Sarah Elizabeth Carter) Rummage. 



Lydia G. Laton is my 1st Cousin 4X Removed.

The Last Will and Testament of Dempsey Page

Dempsey Page, borne about 1815 was twice married. His first wife was Melinda Brumly with whom he had six children of which only three lived to adulthood. Melinda passed away before 19 March 1867. After the death of Melinda, Dempsey married Elizabeth F. Stancil on 19 March 1867.

Dempsey wrote his will on 18 March 1879. His Executor, Milas A. File, was granted Letter Testamentary on 4 April 1879.

Dempsey Page died between 18 March 1879 and 4 April 1879. No tombstone, obituary or death notice has been found for Dempsey.   

Transcription:

Last Will and Testament Dempsey Page 

State of North Carolina}

Rowan County}


In the name of God, Amen.

I, Dempsey Page, of the County and State aforesaid, being of sound mind& memory but weak in body, and considering the uncertainty of my earthly existence. Do make and declare this my last Will and Testament in manner and form following that is to say:--

First.--That my executor (hereinafter named) shall provide for my body a decent burial, suitable to the wishes of my children and friends, and pay all funeral expenses, together with my just debts however and to whomsoever owing, out of the moneys that may first come into his hands as a part or parcel of my estate. (pg 482)

Item First:--I give and bequeath devise to my beloved son John Alison, the plantation on which I now live containing about 94 acres lying on North side of Sherrill’s Ford road, adjoining Mrs Kinder’s, Mrs. Kestler’s & others, also one half of old plantation containing about 78 acres, lying on South Side of Witheroes Creek and joining M. A. File, Mrs Kinder’s & others, also my two horse wagon & harness together with two mules his choice one bed stead and furniture his choice, one Bureau his choice and provisions enough to last him & mules until he can make and gather a Crop.

Item 2nd.:--I give and devise unto my beloved daughter Mary May, seventy five (75) acres of land to be taken off the Sloop Place on which they now live, to be taken off of said place next to M. A. Files, 50 acres being that run off by W. A. Houck & the other 25 acres joining James F. Cowan & M. A. File to have and to hold during their lifetime and then to go as hereinafter provided.

Item 3rd.:--I give and devise unto my beloved daughter Laura E. May, one half of my old home place of which mention is made in item first and also what will remain of the Sloop Place after Mary's share is taken off, also she is to have one years provisional laid off to her fro her and her two children.

Item 4th.:-- It is my will that if any of my children die without legal bodily heirs or children then and in that case the effects herein willed to them to return to the balance of my children then living or their children if they are dead & have left any legal bodily issue & in case of Mary and her husband should die first he her husband is to have the use of her effects during his life time & then return as aforestated.

Item 5th.:--It is my will and desire that all the residue of my Estate after taking the devises & legacies above mentioned, shall be sold at public sale, and the debts owing to me be collected and if there should be any surplus over and above the payments of debts, expenses and legacies, that such surplus shall be equally divided among my children, share and share alike to them, each and every one of them, their Executors, Administrators and assigns absolutely & forever.

And lastly, I do hereby constitute my trusted friend Milas A. File, my lawful executor to all intents and purposes (pg 483) to execute this my last Will and testament according to the true intent and meaning of the same, and every oar and clause thereof, hereby declaring utterly void all other Wills and Testaments by me heretofore made.

In witness whereof, I, the said Dempsey Page, do hereunto set my hand and seal this 18th day of March in the year of our Lord, 1879.

Horah, Judge of Probate for Rowan County, that Dempsey Page, late of said County, is dead, and has made a last Will and Testament in writing, which was exhibit to me a Judge as aforesaid, and duly proved, wherein the said testator hath appointed Milas A. File, Executor thereof: and the said Milas A. File, hath duly qualified as Executor as aforesaid.

These are therefore to authorize and empower the said Milas A. File as Executor as aforesaid, to take into his possession all and singular the goods and Chattels, rights and credits of the said testator, wheresoever in this State to be found; and a true and proper inventory thereof return on oath to the Judge of Probate for Rowan County, within the time prescribed by law; and all the just debts of the said testator to pay, so far as the said estate shall extend (pg 485) or amount to; and in all other things to execute the said Will and Testament agreeably to Law and his office and duty as Executor.

Its Family Time~Hugh Fleming Dove, Jr.

Hugh Fleming Dove, Jr. was born about 1807, a son of Hugh Fleming Dove, Sr. and
Christian Campbell. The family migrated from Scotland and lived in Bladen County, North Carolina and Marion County, South Carolina. As the  families begin to grow they also began to spread out across the States. 

Hugh Fleming Dove, Jr. married Mary Ann Campbell, daughter of Duncan Campbell. The date of this marriage is unknown at present but probably occurred in 1845/46. Their first born son, John D. Dove, was borne 10 August 1847.  Hugh, Jr. and Mary Ann only had 3 children; 2 daughters and a son, before he was murdered in 1852 by his wife’s brother, Hugh Campbell. 

This murder occurred in Marion County, South Carolina and the Governor, John H. Means, of South Carolina provided a $200.00 reward for the capture and jailing of Hugh Campbell.

July 16th, 1852.} 

To the Editor of the Star: An atrocious murder was committed in this District, near Little Pee Dee, on the person of Hugh Dove by Hugh Campbell. A  Coroner's inquest was held over him to-day, and a warrant issued for the arrest of Campbell, who has fled. 'This is to give notice to the public in order for his arrest; he is 5 feet 7 inches high, fair complexion, blue eves, black hair, thick beard, rather heavy set, walks quick and short, looks rather under when he looks at you, he is about 30 or 35 years old, has also a Roman nose.                            SAMUEL J. EXECUTIVE DEPARTMENT S. C.

                                                                        July 30th 1852 

WHEREAS information has been received by this Department that a murder was committed on the body of Hugh Dove in Marion District by HUGH CAMPBELL and that the said Campbell has either fled or conceals himself. Now in order that the said Campbell may be brought to trial, be it known,  that I, John H. Means, Governor in and over the State of South-Carolina, do issue this my Proclamation, offering a reward of TWO HUNDRED DOLLARS for his delivery to the Jail of Marion District.

Campbell is about 30 or 35 years old; 5 feet 8 inches high, stout built, walks quick and steps short; has blue eyes, Roman nose, black hair and thick beard.

Marriage Announcement~Willie Morriss and Charity Short

 After many years of looking for the marriage of my 3rd Great Grandparents I finally hit the jackpot last night. For years we have looked for the marriage of  a Wiley Morris and Charity Short. 

Last night newspaper clipping shows that his name WAS NOT Wiley Morris but Willie Morriss.

Sadly, the article did not declare a specific date but we now know that Willie Morriss and Charity Short were married near Sneedsborough, NC in September 1833.

The Marriage of James Clark and Mary Tyson Davis

Mary Tyson Davis was born about 1844 the 3rd of ten children borne to John David and Mary Tyson. She had 6 brothers and 3 sisters.

On 21 Apr 1761 in  Wilmington, New Castle County, Delaware, Mary Tyson Davis and James Clark were married. James was borne about 1736 in New Castle County, Delaware. His parents are currently unknown.  



James and Mary had one known child, a daughter, called Jean Davis. Sadly, they lost her at age 23. 

Jean Clark was born 1773 and died 4 April 1796. Her father, James Clark died 17 March 1790 in Kenton, Kent, Delaware. It is not known, at present, when Mary Tyson (Davis) Clark passed away. 

Mary Tyson (Davis) Clark is my 1st Cousin 6X Removed.

It’s Family Time~The James David Weaver Family

Today Carolina Family Roots post is a Works-in-Progress. I will be the first to say that it has a long way to go to meet the Genealogical Proof Standard (GPS). So lets begin. 

Edy Sellers was born about 1799 in South Carolina. Her parents (unproven) are Phillip Sellers, Sr. and Mary Gulledge. In the 1800 Chesterfield Census, Phillip and Mary had 2 daughters under the age of 10. In 1810, they had 4 daughters under the age of 10. By 1830, only 2 daughters under the age of 9 can be found in the Phillip and Mary (Gulledge) Sellers household. 

James David Weaver was born about 1797 in South Carolina. His parents are unknown.

James David Weaver and Edy Sellers were married about 1827, probably in South Carolina. David was a widow with 4 small children; 3 daughters and a son. Edy Sellers was age 28 and never been married. David and Edy Sellers moved to Alabama before their 1st child was borne in Dallas County, Alabama in 1828. By 1840, they had relocated to Tuscaloosa County, Alabama where they remained the rest of their life.   

James David and Edy (Sellers) Weaver had 5 children, all daughters. 

i. Cassandra D. Weaver, born abt 1828, Alabama; married William McFerrin, 27 Dec 1846, Tuscaloosa County, Alabama; married John Marion Lanier, 8 Apr 1866, Tuscaloosa County, Alabama; died abt 1875, Mooreville, Lee, Mississippi.

ii. Louisa Caroline Weaver, born abt 1830, Tuscaloosa, Alabama; married David West; died bef 21 Dec 1869, Angelina, Texas.

iii. Mary Francis Weaver, born Oct 1832, Tuscaloosa, Tuscaloosa, Alabama; married William J. Loggins; died aft 15 Apr 1910, Tuscaloosa, Alabama.

iv. Nancy Ann Weaver, born 9 Sep 1833, Tuscaloosa, Tuscaloosa, Alabama; married John Blackman Starkey, 20 Jan 1851, Tuscaloosa County, Alabama; died 20 Oct 1914, Rose Bud, White, Arkansas.

v. Malinda Ann Weaver, born 6 Apr 1838, Tuscaloosa, Alabama; married Leonard Littleberry Battle, 18 Dec 1856, Tuscaloosa County, Alabama; died 25 Apr 1896, Tuscaloosa, Alabama.

All the above children plus the children from his first marriage are named in the Tuscaloosa County Probate Records. Unfortunately, those records are not available on line. Alabama has some strict guidelines for accessibility to their “Public Record”. They are not so public.

I have touched base was a fellow researcher (Carol Harris Migdat) who has given me permission to quote from her transcripts of these records.

James David Weaver died before 6 Jan 1868. The date 6 Jan 1868 is the date that Edy (Sellers) Weaver married Hilliard Sellers. Therefore it is assumed based on Tuscaloosa County Probate documents that Edy is a widow and is marrying a Hilliard Sellers on this date.

This Notice appeared in  Tuscaloosa Weekly Times, Tuscaloosa, Alabama, 30 July 1870.

 Administrator’s Sale. 

By virtue of an order of sale, granted to me by the Honorable Judge of Probate for Tuscaloosa County, I will sell, on SATURDAY, SEPT. 3d, at the late residence of David Weaver, dec., to the highest bidder, for cash, all the Personal Property belonging to said deceased.  

And on MONDAY, SEPT. 5th. before the -------County between the usual hours of sale, will be sold the lands belonging to said Estate, subject to Widow’s dower lying in said county, and described as follows, to-wit: --N.E. Fraction East of River, Sec. 20, Town. 20, range 8, west. and the SW 1/4 of SE 1/4 of Section 21, Town. 20, Range 8, west.

Terms of sale for the land, ONE HALF CASH, the remainder on credit of 12 months, with note and approved security.

Genealogist Carol Harris Migdat found this document in the Tuscaloosa Probate records. It names all the Heirs-at-Law of James David Weaver.

Edy Sellers Administrator of said estate having this day filed her application in writing and under oath, praying for an order and proceedings to sell certain Real Estate in said petition described, the property of said decedent at the time of his death for the purpose of Division. And it appearing from an inspection of said petitions, that the only heirs of said deceased are the Petitioner, Belinda Battle wife of Berry Battle, Mary Loggins wife of Wm Loggins of full age and reside in Tuscaloosa & State of Alabama & George Weaver, W. Weaver of full age, [a son ??] residing in Jefferson Co. Ala. And Nancy Starkie wife of John Starkie of full age and reside in the state of Miss. Itawamba County Cessandra Marion wife of John Marion residing in the State of Miss. of full age, Margaret Kyser wife of Wm. Kyser reside at Little Rock in the state of Arkansas of full age, Malinda Wallace wife of Asa Wallace resides in the County of Fayette Alabama. The heirs of Caroline West wife of David West who died in Texas, to wit: William, George, David, Thomas, & Isaac West ages not known, Heirs of Ruhama Wallace, wife of Littleton Wallace, all reside in the County of Fayette Alabama as follows, Asa & Daniel Wallace of full age, Edy, Caroline, Jacob, William & Jane Wallace, the last under 21 years of age.

After the death of James David Weaver in 1867; Edy (Sellers) Weaver married Hilliard George Sellers on  6 January 1868. This union produced no children. 

Edy (Sellers)(Weaver) Sellers died before 7 January 1876.

These two notices appeared in the Tuscaloosa Weekly Times, Tuscaloosa, Alabama on 2 February 1876.

Letters of Administration, upon the Estate of Edy Sellers, have been granted to L. B. Battle. See advertisement.
