It’s Family Time~The John C. Rivers family

Its-Family-Time2John C. Rivers was born in 1848 in Chesterfield, South Carolina , a son of Luke Rivers and Mary Selina Johns. While still a young boy, his parents moved to Jones County, Mississippi. Long before the move, several of his Rivers Aunts and Uncles had already migrated to the state.

It was here that John C. Rivers grew up with the young lady who became his bride. John C. Rivers married Elizabeth Holifield sometime around 1870. I was unable to find a Marriage licensee without on-site research.

Elizabeth Holifield,  daughter of John C. Holifield and Mary A. Brown, was born about 1850 in Jones County,
Mississippi.

John C. Rivers and Elizabeth Holifield had the following children:
    i.    Jesse Rivers, born 8 May 1872, Jones County, Mississippi; married Rosa Eason; died 7 Feb 1933.
   ii.    Mary Elizabeth Rivers, born abt 1874, Jones County, Mississippi; married Thomas Pinkey Moss, 7 Jul 1895; died 1937.
  iii.    Phebe Jane Rivers, born 20 Dec 1875, Jones County, Mississippi ; married Joseph Cornelius Bullock, 1 Jan 1896, Jones County, Mississippi; died 30 Mar 1936.
   iv.    Luke Hilliard Rivers, born 2 Aug 1879, Jones County, Mississippi; married Mary Rebecca McNeil, abt 1911; died 3 Jun 1956, Whistler, Mobile, Alabama.
  v.    George Washington Rivers, born 22 Jun 1886; married Margaret Lyon, 1908; died 22 Nov 1924, Jones County, Mississippi.
   vi.    Lula Vermel Rivers, born 4 Dec 1888; married John Lemuel Barnett, 1907; died 22 Jan 1958.
   vii.    Bertie Elizabeth Rivers, born abt 1892; married John Houston Ivey, 28 Aug 1907.

Elizabeth Holifield Rivers died on 13 Jan 1895 at the age of 45. I have been unable to locate a tombstone showing her place of burial.


After Elizabeth death, John C. Rivers married Amanda J. Hill on  21 May 1895 in Jones County, Mississippi. Amanda J. Hill was born about 1860 in Jones County, Mississippi.


John C. Rivers is my 1st Cousin 5 times removed.

Wm. M. Hurst & wife to Samuel Powell Deed

The State of South Carolina.
Know all men by these presents that we William M. Hurst and wife Mary E. Hurst of the County of Chesterfield in the State aforesaid for and in  consideration of one hundred dollars to us paid by Samuel Powell of the  County of Chesterfield in the State aforesaid have granted bargained Sold and released and by these presents do grant bargain sell and release unto the said Samuel Powell all that certain piece parcel or tract of land Situate and being in the County of  Chesterfield in the State aforesaid on the waters of Abrams Creek and contains Fifty seven acres more or less (the said being the one-half part of a tract which was allowed to the said William M. Hurst and wife Mary E. Hurst in the division of the Estate of the late Thompson B. Powell deceased) and bounded as follows: - Beginning at a Pine 3X0 and runs N. 65 W 39 chs to a Stake 3Xn by a pine Station (dead) Then N. 28 E. 30 chs to a Stake 3Xn Then S. 26 E. 48 chs and 25 links to the beginning – together with all and singular the rights members hereditaments and  appurtenances to the said premises belonging or in any wise incident or appertaining to have  and to hold all and Singular the premises before mentioned unto the said Samuel Powell his heirs and assigns forever. And we do hereby bind ourselves our heirs Executors and Administrators to warrant and forever defend all and Singular the said premises unto the said Samuel Powell his heirs and assigns against ourselves and our heirs and against every person whomsoever lawfully claiming or to claim the same or any part thereof.

On 7 April 1873, W. M. Hurst and Wife Sold to Samuel Powell, 57 acres of land allocated to William M. Hurst and his wife Mary E. [Powell] Hurst in the division of the estate of the late Thompson B. Powell. Thompson Powell died before 11 June 1866 according to the probate his estate.

This Deed took place in April 1873 and Samuel Powell was available to execute the transaction. However, I have yet to find any other mention of Samuel Powell in Chesterfield County, South Carolina.

Treasure Chest Thursday~Marriage of Julius Alexander Sellers and Jennie Jackson

1888 Marriage Register

Julius Alexander Sellers, was a son of Hardy Huntley Sellers and Mary Eliza Sinclair.

Louise Virginia “Jennie” Jackson was a daughter of Benjamin A. Jackson and Catherine Mary Blakeney.

Julius A. Sellers and Jennie Jackson were married on 17 December 1888 in Union County, North Carolina.

To this union were born 5 daughters between 1888 and 1896. Tragically, Julius Alexander took his life on 28 October 1917. Jennie, his wife, passed away on 31 October 1938.

Julius A. Sellers was my 1st cousin 5 time removed.

22 Oct. 1790: ANDREW DRY SOLD LAND TO MARTIN DRY THAT ANDREW DRY HAD RECEIVED IN A STATE GRANT IN 1787:


Transcription:

This indenture made the 22nd day of October in the year of Our Lord 1790 between Andrew Dry of the County of Mecklenburg  Rowan and state of North Carolina of the one part and Martin Dry of the County of Mecklenburg and State aforesaid of the other part witnesseth that for and in consideration of the sum of ten pounds of good and lawful money of said State to me in hand paid by the said Martin Dry to the said Andrew Dry in hand paid the receipt whereof is hereby fully acknowledged to him, the said Andrew Dry hath given granted bargained and sold and by these presents doth give grant bargain and sell unto the said Martin Dry his heirs and assigns a certain piece or parcel of land lying and being in the County and State aforesaid containing one hundred fifty acres lying on the east side of Dutch Buffalo Creek on both sides of the Long Run Beginning at a post oak near Charles Drys old line running thence So 26 degrees West 6 poles to a small Gum in said Run, thence with or near said line South 70 degrees West 17 poles to a Red Oak thence S 14 poles crossing the Woolfs___Branch to a stake, thence N 17 poles Crossing said branch to a B. O. grub, thence the same course N 60 poles to a stake, thence W 6 poles crossing said Long Run to a stake, thence to the Beginning. By a State Grant dated December 2nd and in the IX Year of the Independence and in the year of our Lord 1787 together with all woods mines minerals Hereditaments and appurtenances the said land belonging to have and to hold the aforesaid 150 acres of land with all rights privileges and improvements to the same in any wise belonging to him the said Martin Dry his heirs and assigns forever and the said Andrew Dry for himself and his heirs and assigns doth hereby covenant and agree to and with the said Martin Dry that he the said Martin Dry his heirs and assigns shall and may forever hereafter peaceably and quietly have hold occupy possess and enjoy the aforesaid granted lands and premises without the debt of notification of any wise whatsoever and free and clear from all manner of incumbrancers whatsoever and the said Andrew Dry doth oblige himself and his heirs to warrant and defend the aforesaid granted lands and premises to him the said Martin Dry his heirs and assigns forever against the claims of all persons whatsoever. In the above land deed Andrew Dry is selling 150 acres of land to his brother Martin. Both Martin and Andrew are sons of Charles Dry.

Charles Dry first appears in a Mecklenburg County, NC  Land Deed dated 26 July 1777. This one is dated 22 October 1790.

Charles Dry is my 5th Great Grandfather; Martin Dry is my 4th Great Grandfather; Andrew Dry is my 4th Great Grand Uncle.

Chesterfield County SC Estates~Estate Folder #460~The Case of Franklin T. Brock



Each week, on Sunday, I will select an Estate Folder from the Estate files of Chesterfield County and discuss its contents. No known estates exist for the period before the Civil War. They were destroyed by the burning of the Courthouse. There are a few “Equity Records” in the State Archives. Do not overlook this valuable resource if you are looking for ancestors in Chesterfield County, South Carolina.

When Stephen Brock and his wife Nancy Smith Brock passed away they left among their heirs a young son named, Franklin T. Brock,  who was unable to care for himself.

Stephen had passed away on 11 Sept 1867 and young Franklin who was  born on May 20, 1860 was left in the care of his mother, Nancy Smith Brock.

Then on 12 January 1878 Nancy passed away leaving 18 year old Franklin unable to care for himself and without a guardian. Franklin had three (3) living brothers; so he wasn't left alone.  

On July 17 1879, Franklin brother Irvin Samuel Brock petitioned the courts stating that ”The petitioner (Irvin Samuel) had boarded, clothed and cared for the said [Franklin] for nearly fifteen months without any pay or compensation. And submit herewith his account Marked Exhibit “A” for his reasonable charges and expenses…”  [Images 1563 and 1564]

Review of Petition

H. D. Malloy and T. F. Malloy on their oath states that the Petition is true to the best of their knowledge and the charges and expenses are reasonable.  Dated 29 July 1879

On 29 July 1870 The Courts allowed for the payments, charges and expenses along with the Court and attorney cost to be paid out of any funds in possession of the Courts belonging to Franklin T. Brock.  [Images 1568]

It’s Family Time~The Hardy Sellers Gaddy Family

Its-Family-Time2Hardy Sellers Gaddy was born on 29 Jul 1815 in Anson County, North Carolina. He was a son of Thomas Gaddy and Mary R. Sellers. He had 4 sisters and two brothers.

Hardy died on 30 Nov 1895 at the age of 80 in Jasper, Walker, Alabama. A Memorial has been created for him at www.findagrave.com.

Hardy Sellers Gaddy married Nancy Malinda Ivey about 1856 in Dekalb County, Georgia.

Nancy Malinda Ivey, daughter of John Ivey and Armine Leverett, was born on 7 Mar 1824 in Dekalb County, Georgia.

Nancy Gaddy died on 21 Dec 1914 at the age of 90 in Jasper, Walker, Alabama. A Memorial has been created for her at www.findagrave.com.

Hardy Sellers Gaddy and Nancy Malinda Ivey had the following children:
         i.    Mary A. Gaddy was born about 1857.
         ii.    John Thomas Gaddy was born about 1860.
         iii.    Mandy M. Gaddy was born about 1865.
         iv.    George Washington Gaddy, born 14 Apr 1866; married Zorelde Belle Tubbs, abt 1894; died 10 Jun 1933, Walker County, Alabama.
         v.    Sarah M. Gaddy was born about 1870.


Hardy Sellers Gaddy is my First cousin 5 times removed.

Treasure Chest Thursday~Petition for Guardianship of William Calhoun Brock

On 11 September 1867, Stephen Brock, passed away leaving his widow, Nancy Smith  and 6 children ranging in age from 19 to 4 years  of age. There were 5 sons and a daughter.
Then on 12 June 1878, Nancy Smith Brock passed away leaving two children under the age of twenty-one.

Irvin Samuel Brock, a brother to William Calhoun Brock, petitioned the Courts for Guardianship of his younger brother.

II. That your Petitioner as Heir at Law of his Mother Nancy Brock is Entitled to an inheritance of Personal property of the value of One hundred and Fifty Dollars
III. That your Petitioner has no one to take charge of the said personal Property for him
                  Wherefore your Petitioner Prays that this Court appoint Irvin S. Brock his Brother to act and Serve as his Guardian to take control and charge of the above mentioned Property and your Petitioner will ever Pray + c

William Calhoun Brock grew up, married Lulu McGrath of Virginia on 13 Nov 1894 and raised a family of five children; four daughters and a son. William C. died at the age of 57 on 5 December 1920.

This agreement made this 3rd day of July in the year 1886 between W. J. Purvis and Elijah Wallace  both of the County of Anson and State of North Carolina Witnesseth That W. J. Purvis agrees to lease devise and let to the said Elijah Wallace one Tract of Land containing Thirty acres more or less during the Term of Ten years said Terms is to commence January the 1st 1887 + to Expire January 1st 1897 for the first year of said term the said Elijah Wallace is to have said Land free of rent + for the remaining nine years he the said Elijah Wallace agree to pay to the said W. J. Purvis Eight Dollars per annum as rent for said Land, Now said Land is known as a Tract of Land lying and being in the County of Chesterfield State of South Carolina and the said W. J. Purvis agrees to furnish material to repair a House on said Land free of charge to said Elijah Wallace in repairing said House and it is agreed muterally [mutually] that the cost of this agreement and of making and recording said lease shall be borne by the said parties equally. I suspect that the Witness to the execution of this Lease was not signed because it contains an error.  Wm. J. Purvis is leasing 30 acres of land and the statement reads that “Personally appeared before me C. E. Braswell and made oath that he saw the within named Wm. T. Hurst and Elijah Wallace”

Wm T. Hurst has nothing to do with this lease.

Mary Pitts, widow of John B. Pitts, passed away sometime before 23 September 1883. Her husband, John, had died many years earlier. The exact date of John and Mary’s  death is lost to history unless someone in the descendancy of this couple has a Family Bible in their possession.

Mary wrote her Will on 7 February 1858 and it stood as written at that time. On 21 September 1883, Mary Smith, Margaret J. Robeson with William L. Robeson presented the Will of Mary Pitts to the Probate Court for disposition. (Image 1361). Until this record; the last record of Mary was the 1860 Chesterfield County, SC census. She could have died anytime between 1860 and September 1883.

Charlie Benjamin Brock was born on 16 Jul 1893 in Chesterfield, Chesterfield, South Carolina. Charlie was a farmer in Chesterfield and Marlboro County.  

Charlie Benjamin Brock and Lora W. Brock were married about 1910 in Chesterfield, Chesterfield, South Carolina. Lora W. Brock, daughter of Joel Washington Brock and Mary Jane Brock, was born on 17 Mar 1890 in Chesterfield, Chesterfield, South Carolina.

Charlie Benjamin Brock and Lora W. Brock had the following children:

        i.    Fred W. Brock was born on 29 Nov 1911 in Chesterfield, Chesterfield, South Carolina. He died on 10 Dec 1911 at the age of 0 in Chesterfield, Chesterfield, South Carolina.
         ii.    George Brock was born about 1912 in Chesterfield, Chesterfield, South Carolina.
         iii.    Edward Brock was born about 1913 in Chesterfield, Chesterfield, South Carolina.

Lora Brock died on 16 Jul 1958 at the age of 68 in Marlboro County, South Carolina.

Charlie Benjamin Brock died on 2 Feb 1962 at the age of 68 in Marlboro County, South Carolina. He was buried on 2 Feb 1962 in Chesterfield, Chesterfield, South Carolina.

Charlie Benjamin Brock is my 1st Cousin twice removed.

Rivers of the County and State aforesaid being entitled to an undivided interest in the real and personal estate of my deceased Grandmother Eliza Rivers late of the County of Chesterfield in the State of South Carolina in consideration of the sum of two hundred and ten dollars to me paid by my Uncles Frederick Rivers, Alfred Rivers and D. W. Rivers of the county and state last aforesaid the receipt whereby is hereby acknowledged has granted, bargained, Sold and released and by these presents do grant, bargain, sell, release and forever quit claim unto the said Frederick Rivers, Alfred Rivers and D. W. Rivers all my right title claim and interest of into and out of the real and personal Estate of the said Eliza Rivers in pofsession or expectancy in law and in Equity or by any means whatever Together with all and singular the rights, members, hereditaments or appurtenances to the said lands belonging or in any wise incident or pertaining and with full power and authority to collect and receive the said personally. To have and to hold all and singular the said premises unto the said Frederick Rivers, Alfred Rivers and D. W. Rivers their heirs and assigns and the survivor or survivors of them and the heirs and assigns of such survivor or survivors forever. And I hereby warrant and forever defend the interest herein conveyed unto the said Frederick Rivers, Alfred Rivers and D. W. Thomas J. Rivers was the son of William Rivers and Mary Ann Graves. William Rivers died in the Civil War. After Mary Ann was notified of his death she married Ferguson Hale Smith between 1864-1867 in Chesterfield. 

Ferguson Hale and Mary Ann had two sons. Mary Ann died about November 1870 and her widow husband married Ann Rebecca Powell about 1871.

Thomas is listed twice in the 1870 Chesterfield Censuses; one as T. J. Graves and another time as T. W. Graves.  


Thomas J. Rivers is my 2nd Cousin 3 times removed.

Treasure Chest Thursday~Caudle-Rivers Marriage

On 5 May 1907, James E. Caudle and Martha Reily ‘Mattie’ Rivers were married in Mecklenburg County, North Carolina.

James E. Caudle, age 29, was the son of Jacob Caudle and his wife Nancy.

Martha Reily ‘Mattie’ Rivers, age 19, was the daughter of Isaac Berkley Rivers and his wife Effie Wadsworth.  

Caudle-Rivers Marriage

After a short 16 years of marriage James E. Caudle died suddenly on 4 Dec 1923 leaving surviving him, his widow, Mattie; two sons and a daughter.

Martha Reily ‘Mattie’ Rivers is my 3rd cousin twice removed.

Squire H. Brock, the father, is selling a 77 1/5 acres parcel of land located on both sides Westfield Creek to his son Samuel Washington Brock. His Son, Samuel, was recently married to Sarah Jane ‘Janie’ Lee and this was to be his purchase of land to support his family. 

Squire H. Brock is my 3rd Great Grand Uncle.

Each week, on Sunday, I will select an Estate Folder from the Estate files of Chesterfield County and discuss its contents. No known estates exist for the period before the Civil War. They were destroyed by the burning of the Courthouse. There are a few “Equity Records” in the State Archives. On 24 May 1910, Margaret “Maggie” Hurst Watson passed away. Her husband, Thomas Henry Watson had passed away almost 6 years earlier on 16 September 1904. Their deaths left nine surviving adult sons and daughters.

Her estate file (#983) consists of 4 images all related to the administrative paperwork related to the probate process.

William Cornelius Davis was born on 3 Dec 1845, a son of Isaac Jacob Davis and his wife Sarah in Chesterfield, South Carolina. William died on 27 Aug 1916 at the age of 70 in Harrisburg, Dauphin, Pennsylvania.

Amanda A. Mader was born on 29 Dec 1849 in Dauphin, Pennsylvania. She died on 14 May 1904 at the age of 54.

William Cornelius Davis and Amanda A. Mader were married in 1866. They had the following children:
i. James William Davis, born 11 Dec 1866, Dauphin County, Pennsylvania; married Leah E. Deitz; died 16 Jul 1943, Harrisburg, Dauphin, Pennsylvania.

Monday’s Mystery~Who are Elvey Ann and Sarah R. Johns?


Elvey Ann Johns is a real mystery. First, is Johns her married surname  or maiden surname? She only appears once in the census as Elvey Johns and that census is the 1880 Census shown here:

In this census she give her age as 40 years and states that she and her parents were born in NC. Ancestry on their website shows her as a widower; yet, the census does not she he as a widow nor does it shows her with children.

In Chesterfield County, SC Deed Book 5, pages 683 and 684 we find this deed.

This Deed states that Elvey Ann Johns had a daughter (deceased) named Sarah R. Johns. Other than this Land Deed I can find no record of a Sarah R. Johns. This deed is dated 11 December 1879 and states that Sarah R. Johns is deceased; so, this indicates Sarah died before 11 Dec. 1879.
There is a probate folder #438 – Johns, Smiley, Matilda et al that mentions Sarah R. Johns but not her relationship to the within named individuals.

The four minor children of Eli Johns, a son of David Johns, are requesting a Guardian to “receive whatever may be due us from the Est. of David Johns.”

We see that there is no mention of a Sarah R. Johns in this request. Yet, within the Probate Folder (#438) Image 1110 names Sarah R. Johns and Robert Tucker as her Guardian.
The 4 named children above are the children of Eli Johns and his wife Charity Johnson. They are parties to their Grandfather David Estate because their Father passed away a few years earlier before 1867.
Estate of David Johns(2)

The probate folder of David Johns Estate shows that he died 25 May 1872.
DEATH: Probate Records, Court of Probate, The petition of Robert Tucker sheweth that David JOHN late of said County, departed this life on the 19th day of May 1872...........Petition dated May 25th 1872. Signed Robert Tucker.

Obviously, Sarah R. Johns was alive and well on the day of his death as indicated by the image (1110) above.

But, again we have no knowledge of the relationship of Sarah R. and Elvey Ann Johns to David Johns but we do know both are descendants of David Johns.

Another image (1111) within the Probate Folder states “Cash paid Elvey Johns the only Heir of Sarah R. Johns.”

Request for Final Discharge of Guardianship~Martha Watson

Each week, on Sunday, I will select an Estate Folder from the Estate files of Chesterfield County and discuss its contents. No known estates exist for the period before the Civil War. They were destroyed by the burning of the Courthouse. There are a few “Equity Records” in the State Archives. Do not overlook this valuable resource if you are looking for ancestors in Chesterfield County, South Carolina.

Martha Watson Guardianship

Transcription:
State of South Carolina}
Chesterfield County}
To W. J. Hanna Judge of Probate
The petition of L. A. Watson Respectfully shows that he is the legally appointed Guardian of Martha Watson. That the said Martha Watson is now of the age of twenty one years that is to say about the age of Twenty two years. That he has fully settled the Estate of the said Martha Watson and is desirous of obtaining a final discharge for which purpose he files herewith on account of his actings and doings as said Guardian marked “Exhibit “A” and respectfully ask that the same may be taken as part of this Petition and referred to when necessary. Whereupon your Petitioner prays that an order of final discharge may be granted him and your Petitioner will ever pray +c.

I have not determined who the parents of this Martha Watson are. For a  while I thought she was the daughter of Michael and Jane Watson but now I am not so sure.
