Be it known, that on this 14th day of September 1851 Before me Edward B. Wheeler, Judge of the Court of Ordinary for said District (being a Court of Record) personally appeared Daniel H. Davis 59 years of age, who being duly sworn, upon oath makes the following Declaration for the purpose of obtaining the benefits of the Act of the 7th of June 1832 for himself, Joseph Davis, William Davis, Maria Fladger, Mary Thomas, & Susan B. Lyles, only surviving children of Joseph Davis, a private and Sergeant of infantry and Lieutenant of Cavalry, in the war of the Revolution. That the said Joseph Davis, died in the District of Marion, on the 13th day of November 1838, leaving no widow but the aforesaid children, to wit Joseph Davis, William Davis, Maria Fladger, Mary Thomas & Susan B. Lyles, and this affiant, that Joseph Davis entered the American Army as a private, and upon the first requisition for troops, he volunteered at Ports Ferry on the great Pedee [River] and marched from thence in company with Lieutenant Benjamin Munnerlyn, (afterwards promoted to a Captain) Captain Shade Simonds, Benjamin Davis, Moses King, Francis Goddard, Jonathan Collins, & others to the rendezvous at Dunnam's Bluff, from thence to Charleston South Carolina and reported to Generals Moultrie & Marion, was in the battle at Fort Moultrie when attacked by the British fleet in June 1776 -- was in the battle of Stono Ferry, and was appointed first Sergeant -- was at Nelson's ferry, at the taking of about ninety Prisoners, was in the battle of the Siege of Savannah, was in a battle at the Pedee River against the Tories, who were commanded by a Tory Captain named Jesse Barfield, in which the Tories were defeated -- was in the engagements against the Tories at Black Mingo; Coosawhatchie, & Blue Savannah; his officers in the different tours of service, were Captain Shade Simonds, Captain James, Captain John Rogers, Captain Benjamin Munnerlyn, Captain James Giles, Major James of Williamsburg District, Colonels Baxter, Laurens, Horry, & Hill, and in the war served upwards of a year as a private, two years as a Sergeant and three years as Lieutenant of cavalry -- He was sent by General Marion on several military expeditions and on one occasion, met the distinguished Sergeant McDonald, and returned to Georgetown in company with him -- He was in actual service the whole war except for a short time, on two occasions, when he was on furlough and was discharged at Boling Green in 1783 after peace by General Marion, which discharge and Commission as Lieutenant I the said Daniel H. Davis have seen frequently in my Father's possession, and which was destroyed by fire, at the burning of his house & furniture, not long preceding the death of my Father.

Lt. Joseph B. Davis was born about 1750 in Marion County, South Carolina. He was a son of Benjamin A. Davis and Rachel Port. He married Anne Keene about 1783/84. Anne was the daughter of Buckingham Keene and Mary Lewis. Joseph and Anne had eleven children born to this union; 5 sons and 6 daughters. Yet, at the time of this pension application (14th Sept. 1851) only 3 sons and 3 daughters (named above) were still living. Two sons are named by the 3rd son, Daniel H. Davis who is making application for his Father’s Revolutionary War Pension.  

Lt. Joseph B. Davis is my 1st Cousin 6X Removed.

Last Will & Testament William Davis, son of Samuel Davis, Sr. and Lucinda R. Munsey

Sometime shortly before 17 May 1861, William Davis, son of Samuel Davis, Sr. and Lucinda R. Munsey passed away in Attala County, Mississippi. William Davis was born about 1809 in Chesterfield County, South Carolina. He was the youngest of 10 children born to this union. Between 1818 & 1819, his parents Samuel and Lucinda Davis moved the family to Warren County, Tennessee.  William and his 5 brothers were farmers just like their father, Samuel.

William didn't stay put in Warren County, Tennessee; by 1835 he had wander south to Jackson Country, Alabama. After a while in Jackson County, he married Priscilla Bryant and  moved to Pickens County and then about 1855 to Attala County, Mississippi where he was living when he died in 1861. 

William Davis wrote his Will on 28 March 1861 and died before 17 May 1861. His tombstone's bears the dates 1809-1861. His FindAGrave Memorial bears the death date of 1 May 1861. The administrative bond for his estate bears the date 17 May 1861. Unless someone has a Family Bible he died before 17 May 1861. 

William and Lucinda had 6 known children none of which are named in his Last Will and Testament. However, the 1860 Population Census for Township 13 Range 6, Attala, Mississippi does name his wife and all of his known children.

In the name of God, Amen;
I make this my last Will and testament, First, I resign my soul to Almighty God hopeing and believing in the remission of my Sins by the merits of Jesus Christ, my body I commit to the earth to be buried, with as little expense as possible.- I appoint my wife Priscilla Davis, my Sole Executrix, the 1st duties to pay all debts, which is unpaid. My Goods of every kind to remain in her possession, and under her control, and management So long as she remains unmarried for the purpose of raising and educating my children, Should any of my children get married my will is that my Executrix, give each one a negro and such an outfit as she may think proper, at a fair valuation of Eight per cent Interest, until the final division, at which time each one to have an equal share, no deduction for Board or Education. Should my lands prove insufficient for the benefit of the Heirs, my Executrix may sell or purchase more as she may think proper. No division of the property is to take place until my youngest arrives at the age of eighteen or married. At that time, I want each one to have these Shares.

In the matter of a certain instrument of writing purporting to be the last Will and testament of William Davis Deceased) Be it remembered that at a term of the Probate Court of the county of Attala in the State aforesaid begun and held at the Court House in and for said County on the third Monday (20th) in May in the year of our Lord, one thousand Eight Hundred and sixty one personally appeared in open Court Edward Davis, Harrison Donald and Robert Clark, Subscribing Witnesses to a certain instrument of (pg 603) writing purporting to be the Last Will and testament of William Davis late of Said County deceased, bearing date the 28th March 1861, who having first been duly sworn, deposes and Said that Said William Davis, Signed sealed published and declared said instrument as his last will and testament in the presence of these deponents, on the day of the date thereof. That said testator was then in Sound mind and memory and more than twenty one years of age and that these deponents Subscribed said instruments as Witnesses thereto at the instance and request of said Testator, in his presence and also in the presence of each other on the day and year aforesaid.

It’s Family Time~The William and Priscilla (Bryant) Davis

William Davis was born 1809 in South Carolina, a son of Samuel Davis and Lucinda Munsey Davis. This was a highly mobile family for the times and thus is a works-in-progress. About 1818-1819,  Samuel relocated his family from South Carolina to Tennessee, arriving first in Warren County. Between 1818 and 1835, Samuel lived in Warren, Dickson, Madison, Davidson and back to finally settling in Warren County. 

Sometime between 1835 and 1840, William married Priscilla Bryant. Where this marriage took place is unknown. There is a report that William migrated to Jackson County, Alabama about 1835 and it may have taken place within the State of Alabama. No record of the marriage in Jackson County can be found with records available on-line. 

William and Priscilla's first born child, a daughter they call Nancy, arrived in 1840 suggesting a marriage about or before 1839. The couples would have a total of six children before William Davis’s untimely death in the early 1860”s.  

The Children of William and Priscilla (Bryant) Davis are:

i. Nancy A. Davis was born about 1840 in Alabama, United States.

ii. Lucinda A. Davis was born about 1842.

iii. Sophia Davis was born about 1844.

iv. Sarah J. Davis was born after 1847.

v. William W. Davis was born about 1851.  

2 vi. Alabama Davis, born 29 Apr 1859, Mississippi; married Henry Lyons Hall Sr., 1879; died 24 Jan 1918, Mexia, Limestone, Texas.

William Davis wrote his Last Will and Testament on 28 March 1861. Probate record for Atalla County, Mississippi shows that William Davis died before 17 May 1861. I believe he died on 5 April 1861 and here is how I arrived at that date. There is a very old, broken tombstone for a William Davis, b. 13 Oct 1809. This tombstone  shows his age to be 51 y 5 m 23 d.

That's 51 years, 5 months and 23 days. This tombstone shows he was born 13 October 1809. A 5 April 1861 death date would be 51 years, 5 months and 23 days. This date is also compatible with him having written his Will on 28 March 1861, making this date to be 10 days before his death.  

His Probate Files shows that the Administrative Bond on the William Davis Estate was Executed 17 May 1861.

There were 3 William Davis’ in Atalla County in 1861 but only one of those William Davis was born in 1809.

Military Tuesday~Capt. Benjamin Thomas Davis

Benjamin Thomas Davis was born in 1828, a son of William Davis and Julia Thurman. He was the sixth of ten children born to William and Julia. He had six brothers of which one died young,

Benjamin Thomas Davis married Mary Jane Knight, daughter of Moses Knight and Temperance Eddins. No known children were born to this union.

When the Civil War broke out in 1861, William and Julie had five surviving sons of eligible age to serve their Country. Four of the five brothers did serve during the Civil War.

Benjamin Thomas Davis enlisted on 20 December 1861 and served Captain of Co. E, 21st. SC Inf. C.S.A. As Commanding Officer of Co. E, 21st. SC Inf. Capt. Davis became the Commanding Officer of three of his 4 surviving brothers.

Capt. Benjamin Thomas Davis was killed in the battle at Bermuda Hundred/Ft. Stevens on 28 May 1864.

After the death of  Capt. Benjamin Thomas Davis, his brother, Maj. Alfred W. Davis was promoted to command Company “E”, 21st Infantry.

It is not known what happens to the Widow, Mary Jane Knight, of Capt. Benjamin Thomas Davis after the War.

Capt. Benjamin Thomas Davis was buried on the battlefield but a cenotaph in his honor/memory can be found in The Chesterfield Cemetery, Chesterfield, South Carolina.

Know all Men by these Presents, That I, William Davis, son of Nancy Davis and for her use and benefit as she is now unable from bodily infirmity to attend Court hereby constitute and appoint A. S. Wallace, Yorkville, S. C. my true and lawful Agent and Attorney, to prosecute the Claim of my mother Nancy Davis for any amount of revolutionary Pension, or Increase of Pension, that may be due; and I hereby authorize my said Agent to examine all the papers and documents in relation to said claim; on file in the Departments at Washington City, or elsewhere; to file additional evidence or arguments; and to receive the Certificate which may be issued for said Claim, which Certificate I wish may payable to her my mother Nancy Davis

To appoint one or more substitutes under him for all purposes herein expressed; and to do all things that I might or could do were I personally present. Hereby ratifying and confirming all that my said Attorney and Agent shall lawfully do in the premises.

Nancy (Rivers) Davis death date is unknown; but, by this document we know she was alive, but infirm, on 16 February 1853. 

Nancy Davis is my 4th Great Grandmother; her son, William Davis, is my 3rd Great Grand Uncle.

Being present the following businefs was transacted---
On the application of Wm. H. Davis for temporary Letters of Executorship on the estate of William Davis, Dec’d until the Will of the said Wm. Davis Dec’d can be requested Established the Witnefses residing without the state—It is therefore ordered by the Court that letters ifsue to the said Wm. H. Davis, be giving Eli Atkinson + Thos Atkinson as Securities in the sum of Thirty Thousand Dollars.
The said William H. Davis also prayed the Court for Letters of Administration on the estate of James T. Davis Dec’d and be giving Eli Atkinson + Thos Atkinson as Securities in the sum of fifteen hundred Dollars it is therefore ordered that letters issue to the said Wm. H. Davis –It is further ordered that Joseph Booth, David Mims, + George Tunstall be appointed appraisers of the above estates.

William Davis and his son James Thomson Davis both passed away within a short span of time in late 1831 and early 1832. William’s wife Mary was named as the executor of the estate but the Courts assigned this duty to the oldest living Son, William Henry Davis.

William Davis Will was probated in both Baldwin County, Alabama (WB A, page 57-59) and in Marion County, SC. (WB 1, page 233-234).

Tombstone Tuesday~Catherine Brock Davis

Catherine Brock Davis

b. March 1837

d. July 2, 1917

bu. Old Jacksonville City Cemetery, Florida

Catherine Brock is the daughter of Squire H. and Rachel Parker Brock. She married William L. Davis on 2 March 1857 in Chesterfield County, South Carolina Their marriage date is also recorded as January 6, 1856.^{1 2}

In 1860 they are living in Chesterfield County, SC; but, in the 1870 Census they are found living in Duval County, Florida. ^{3 4}

Catherine and William had seven children, five sons and two daughters. 

She is buried in the Old Jacksonville City Cemetery, Jacksonville, Florida.⁵

Surname Saturday~William, Son, Thomas Davis Family

Over the forthcoming Saturday for the next two to three months I will be highlighting and documenting 11 children of Thomas Davis and his wife Nancy Rivers.

We will highlight their children in the order of their birth. Last week we took a look at Samuel family; today we will examine the family of William Davis and his wife, Julia Thurman.

William Davis was born in 1790 in Chesterfield County, South Carolina.¹ He appeared in the census in 1850 and 1860 Census for Chesterfield, Chesterfield, South Carolina.^{2 3} William died after 1860 at the age of 70+ in Chesterfield County, South Carolina. ^4. No tombstone or obituary has been found for William.

William Davis, with Power of Attorney and acting on his Mother testified before the Revolutionary Claims Commission on 16 February 1853: 

“Know all men by these present that that I, William Davis, son of Nancy Davis and for her use and benefit as she is now unable from bodily infirmity to attend Court hereby constitute and appoint A. S. Wallace, Yorkville, S. C. my true and lawful Agent and Attorney, to prosecute the Claim of my mother Nancy Davis...” ⁵

William Davis and Julia Thurman were married about 1814 in Chesterfield County, South Carolina. Julia Thurman, daughter of Benjamin Thurman and Julia Shumate, was born between 1792 and 1798 in Chesterfield County, South Carolina. ^6 7 She died after 1860 at the age of 68+ in Chesterfield County, South Carolina. No tombstone or obituary has been found for Julia.

William Davis and Julia Thurman had the following children:

i. William Davis was born in 1816 in Chesterfield County, South Carolina. He died very young, about 1821 at the age of 5 in Chesterfield County, South Carolina.

ii. Eliza A. Davis, born 6 Jun 1819, Chesterfield County, South Carolina; married Benjamin Franklin Teal, abt 1840, Chesterfield County, South Carolina; died 1 Sep 1883, Chesterfield, Chesterfield, South Carolina.

iii. Carroll Washington Davis, born 20 Jun 1821, Chesterfield, Chesterfield, South Carolina; married Elizabeth Boatwright, 17 Feb 1846, Chesterfield County, South Carolina; married Mary B.
