NOTICE IS HEREBY GIVEN, THAT ON the 13^th day of April, A. D. 1868, a warrant in Bankruptcy was issued out of the District Court of the United States for the Cape fear District of North Carolina, against the estates of D. J. HUNEYCUTT, of Winchester, Union County, and State of North Carolina , who has been adjudged a bankrupt on his own petition; that the payment of any debts, and delivery of any property belonging to such bankrupt, to him for his use, and the transfer of any property by him are forbidden by law; that a meeting of the creditors of the said Bankrupt to prove their debts, and to choose one or more assignees of his estate, will be held at a Court of bankruptcy, to be holden at Charlotte, North Carolina, before A. W. Shaffer, Esq., Register in Bankruptcy for said District on the 6^th day of May, A. D. 1868, at 10 o’clock, A. M.

In my genealogical database I have four Dempsey Huneycutt of which two carries the middle initial of “J” in their name. The first Dempsey J. Huneycutt was born in 1832 and was killed in 1853. The second, is Dempsey J. Huneycutt, born 1813, son of Dempsey Huneycutt and his wife Barbary.

This Dempsey J. was married to Tabitha Helms and died 25 December 1876.
The above 1868 Bankruptcy notice contains this statement “who has been adjudged a bankrupt on his own petition.” This statement leaves me to believe that Dempsey J. Huneycutt petition the courts himself for this bankruptcy action. Dempsey with Tabitha is the only Dempsey found during this time period.  

Dempsey J. Huneycutt married Tabitha Helms on 3 September 1835.  They had eleven children. Tabitha Huneycutt died in November 1875 and Dempsey J. died in December 1876.
