The Last Will and Testament of Moses Dry

Moses Dry was borne 23 December 1817, a son of Daniel Monroe Dry and his wife, Rachel Lipe. He was the sixth of 14 children borne into this family.

On 18 July 1844, Moses married a young lady by the name of Susanna ‘Anna’ Ivey.

Cabarrus County}  October 2d 1863 – I Moses Dry being of sound mind and perfect memory and as life is uncertain when we have to enter the field as a soldier against the common enemy of our country have thought proper to this day to make this my last will and testament following to wit:
1st I give and bequeath to my wife Susanna Dry the lands whereupon I now live during her natural life, also my horses, cattle, sheep, hogs, household & kitchen furniture and all furniture other Stocks farming tools and all the articles  belonging to my farm. All grain and forage. Also money on hand and notes, to have and to hold and to enjoy the aforesaid property for herself and family during her natural life. In witnefs whereof I Moses Dry do hereunto set my hand and seal.

North Carolina}  Court of Pleas & Quarters Sefsions
Cabarrus County}     July Term 1864
                 I Joseph Young Clerk of said Court do hereby certify that the foregoing last will and testament was exhibited for probate in open court and the due execution thereof by Moses Dry duly proven by the oath of George Barnheart & James E. H. Barnheart the two subscribing witnefses thereto. It is therefore consider by the Court  that said paper writing is the last will and testament of Moses Dry, dec’d and that it be recorded and filed – and there being an executor named in said Will Susannah Dry is appointed administratrix with the will annexed who comes into court and gives bond in the sum of two thousand dollars with George Barnheart and Mathias Barrier as securities is qualified and receives letters of Administration with the Will annexed.

Moses Dry was killed at the Battle of Plymouth on 20 April 1864 just 6 months after executing his Last Will on 2 October 1863.

Enlisted in Cabarrus County on September 28, 1863, for the war. Present or accounted for until killed at Plymouth on April 20, 1864. [Volume 4. Page 595]

Susanna Dry is buried in the Saint Stephens Lutheran Church Cemetery; Gold Hill Township, Cabarrus County, North Carolina. Moses Dry is said to be buried there also. A tombstone exist for Susanna Ivey Dry but, no tombstone's is shown for Moses Dry. 

Moses Dry is my 2nd Cousin 4X Removed.
