Martin Laton~Civil War Causality

Martin Laton was born in 1826, a son of John Laton and Catherine Dry of Cabarrus County, North Carolina. Martin married Mary Smart on 3 October 1850. When the Civil War broke out in 1861, Martin waited until 1863 before entering the War. On 2 March 1863, in Montgomery County, North Carolina, Martin enlisted into the 17th Infantry. He would not return to the bride he left behind. On 31 December 1864, Martin Laton died at Swift Island, Nelson, Virginia.

There a lot of misinformation and erroneous death dates for Martin saying he died in 1863 at Point Lockout, Maryland. He was in Maryland but he was never at Point Lookout.

LATON, MARTIN, Private
Enlisted in Montgomery County on March 2, 1863, for the war. Present or accounted for until he deserted on August 5, 1864. Apprehended on August 26, 1864, Court-martialed and sentenced to death; however, his sentence was commuted. Died in hospital at Richmond, Virginia, December 31. 1864, of Disease. NC Troops, Volume 6, page 291, left column

Ironically, his wife Mary Smart only lived a short time after his death. I have not found an exact death date for Mary but it looks as if she was deceased before 2 Dec 1873, the date that Martin Laton estate was probated.

Martin Laton is my 1st Cousin 4X Removed.

             Know all men by these presents That We William M. Hurst and Mary E. Hurst his wife, Richard T. Powell and Ellen E. Powell Heirs and distributes of  Thompson B. Powell "deceased"  in the State aforesaid for and in consideration of the Sum of Five Hundred Dollars to us in hand paid at and before the Sealing of these presents, by Ferguson H. Smith and Ann R. Smith his wife in the State aforesaid, the receipt whereof is hereby acknowledged, have granted, bargained, Sold, and released, and by these presents do grant, bargain, Sell and released  unto the said Ferguson H. Smith & wife Ann R. Smith all that piece, parcel or tract of Land, lying Situate and being in the County of Chesterfield and State aforesaid on both sides of the Sneedsboro Road Containing one hundred and Sixty acres as will fully show by a plat of the same thereunto annexed made and certified to by John H. Lowry Deputy Surveyor, on the 14th day of November, A.,D. 1871 Together with all and Singular the rights, members, hereditament and appurtenances to the said premises belonging or in any wise incident or appertaining. To Have and to Hold all and Singular the premises before mentioned unto the Said Ferguson H. Smith and wife Ann R. Smith their heirs and assigns forever and we do herby bind ourselves, heirs, Executors, and Administrators to warrant and forever defend all and Singular the said premises unto the Said Ferguson  H. Smith and wife Ann R. Smith their heirs and assigns against ourselves and our heirs, and all and every person or persons, lawfully claiming or to claim the Same or any part thereof. And we the Said Wm. M. Hurst & wife Mary E. Hurst, R. T. Powell, Jr. & Ellen E. Powell for ourselves and our heirs, Executors  and Administrators do covenant, promise, grant and agree to, and with the said Smith and Wife their heirs and assigns, by these presents in manner and form following that is to say That we the Said Wm. M. Hurst and wife Mary E. Hurst, R. T. Powell, Jr. & Ellen E. Powell now and at the time of the Sealing and delivery of these presents are lawfully and absolutely seized of and in in the Said Lands and all and Singular other the premises herein before mentioned, and intended to be hereby granted and released, and every part and parcel thereof with their and every of their appurtenances of a good, Sure, perfect and absolute State of inheritance, in fee-Simple without any manner of condition [unreadable], power of revocation or limitations or any use or uses, or other restraint, matter, or thing whatsoever, to alter, change, charge, defeat or evict the Same. And also that we the Said Wm. M. Hurst and wife Mary E. Hurst, R. T. Powell, Jr. & Ellen E. Powell now have in ourselves good rightful power and lawful and absolute authority to grant, release and confirm the said Lands and all and singular others the premises herein before mentioned and intended to be herby granted and released. And every part or parcel thereof with their and every of their appurtenances, unto the said Smith and wife their heirs and assigns forever as aforesaid. And also that it Shall and may be lawful; to and for the Said Smith and wife, their heirs and assigns from time to time, and at all times forever hereafter peaceably and quietly to enter into, have, hold, occupy, possess, and enjoy the said land and all and Singular other the premises herein before mentioned and intended to be hereby granted and released and every part (pg 117)  and parcel thereof with their and every of their appurtenances without any of the lawful Suit, trouble, molestation, Eviction, or interruptive of us the Said W. M. Hurst and wife Mary E. Hurst, R. T. Powell, Jr. & Ellen E. Powell our Executors Administrators or any other person or persons whatsoever: And  that free and clear, and freely and Clearly, and absolutely acquitted exonerated and discharged of, and from all and all manner of former and other gifts, grants, bargains, Sales, Uses, Wills, initials, joiners, dowers, judgments, Executors charges and encumbrances whatsoever had, made, done, committed, or Suffered by us the Said W. M. Hurst and wife Mary E. Hurst, R. T. Powell, Jr. & Ellen E. Powell  or any other person or persons whatsoever.
And lastly, that we the  Said W. M. Hurst and wife Mary E. Hurst, R. T. Powell, Jr. & Ellen E. Powell and our heirs, and all and every other person or persons lawfully claiming or to claim, and estate, right, title, trust, or interest, of, in or to, the Said lands and all and singular other the premises herein before mentioned and intended to be hereby granted and released, or any part or parcel thereof Shall and will from and at all times hereafter, at the reasonable request and proper costs and charges of the law, of the said Ferguson H. Smith and wife Ann R. It’s Family Time~The Israel Franklin & Eliza Jane (Page) Hagler Family

 Israel Franklin Hagler was born Feb 1852, a son of Jacob Hagler and Nelly Dove of Cabarrus County, North Carolina. His father indicated in the 1850 Census that he was in the mining business; but, by 1860 he had become a farm laborer. Israel Franklin followed in his fathers footsteps as a farmer and farm laborer. 

On 30 January 1873, Israel Franklin Hagler, age 20, and Eliza Jane Page, age 21, were married in Stanley County, North Carolina. Eliza Jane was a daughter of Sion Page and his wife Nancy. In the next 20 plus years they would raise a family of ten children; seven sons and three daughters.

Israel Franklin Hagler and Eliza Jane Page had the following children:

i. John M. Hagler was born about 1874 in Stanly County, North Carolina. 

ii. Nancy Samantha Hagler, born 5 Nov 1875, Stanly County, North Carolina; married William Avery Connell; died 13 Jun 1936, Charlotte, Mecklenburg, North Carolina.

iii. James Titus Hagler, born 11 Dec 1878, Stanly County, North Carolina; married Doce Kiker, 24 Sep 1903, Mecklenburg, North Carolina; died 24 Jun 1922, Charlotte, Mecklenburg, North Carolina.

iv. Lucy Adaline Hagler, born 26 Feb 1881, Stanly County, North Carolina; married William Baker Clontz, 1902; died 24 Nov 1961, Norwood, Stanly, North Carolina.

The Death of Lt. Joseph B. Davis

 Joseph B. Davis was born about 1759 a son of Benjamin Davis and Rachel Port. He served in the Revolutionary War serving under such men as  Captain Benjamin Munnerlyn, Captain Shade Simonds, Benjamin Davis, Moses King, Francis Goddard, Jonathan Collins, & under Generals Moultrie & Marion.

About 1783, he married Anne Keene, Daughter of Buckingham Keene and Mary Lewis. To this union were borne eleven children; six daughters and five sons.

Lt. Joseph B. Davis died 11 September 1833 and is buried in the Benjamin Davis Cemetery, Davis Landing, Marion County, South Carolina. You will find other death dates for Lt Joseph B. Davis but this death date is based on his obituary which appeared in “The Evening Post Saturday Oct 12, 1833, New York, NY, page 2, column 7.”

Obituary: Joseph Davis

Died, at his residence in Marion District, (S.C) on the 11th ultimo, Mr. JOSEPH DAVIS, in the eighty-third year of his age. This patriotic man died of a lingering illness, which he bore with an entire resignation to Heaven’s decree. He was eminently useful to the community. He never turned a deaf ear to the distresses of the poor, but cheerfully bestowed a portion of those comforts, with which a kind providence had amply furnished him. Did any differences of an unfriendly aspect occur among his neighbors?--to him belonged the friendly task of a reconciliation. In his family, he was all that could be desired; and lived long enough to rear up a numerous and respectable family of children, who will remember him with affectionate respect. In addition to his many private virtues, he served his country with fidelity during our Revolutionary struggle for freedom. He was the constant companion of General Marion, and with him shared all the dangers of that trying period. All loved and respected him who knew him well, except a certain class, at that period, known and distinguished by the name of Tories.  To them he was a terror; and if he did not receive their esteem, he excited their fears. He lived and died as one entitled to the respect of all worthy citizens. Though departed from this life, he has become an immortal inhabitant of another. His winter indeed has passed -- his destined course on earth has been completed; but an everlasting spring awaits his coming.

This NY October 12, 1833 newspaper lists his death as occurring on the 11th ult. = ultimo = last month. Thus his date of death is 11 September 1833.

There are other dates of death recorded for Lt. Joseph B. Davis.

Be it known, that on this 14th day of September 1851 Before me Edward B. Wheeler, Judge of the Court of Ordinary for said District (being a Court of Record) personally appeared Daniel H. Davis 59 years of age, who being duly sworn, upon oath makes the following Declaration for the purpose of obtaining the benefits of the Act of the 7th of June 1832 for himself, Joseph Davis, William Davis, Maria Fladger, Mary Thomas, & Susan B. Lyles, only surviving children of Joseph Davis, a private and Sergeant of infantry and Lieutenant of Cavalry, in the war of the Revolution. That the said Joseph Davis, died in the District of Marion, on the 13th day of November 1838, leaving no widow but the aforesaid children, to wit Joseph Davis, William Davis, Maria Fladger, Mary Thomas & Susan B. Lyles, and this affiant, that Joseph Davis entered the American Army as a private, and upon the first requisition for troops, he volunteered at Ports Ferry on the great Pedee [River] and marched from thence in company with Lieutenant Benjamin Munnerlyn, (afterwards promoted to a Captain) Captain Shade Simonds, Benjamin Davis, Moses King, Francis Goddard, Jonathan Collins, & others to the rendezvous at Dunnam's Bluff, from thence to Charleston South Carolina and reported to Generals Moultrie & Marion, was in the battle at Fort Moultrie when attacked by the British fleet in June 1776 -- was in the battle of Stono Ferry, and was appointed first Sergeant -- was at Nelson's ferry, at the taking of about ninety Prisoners, was in the battle of the Siege of Savannah, was in a battle at the Pedee River against the Tories, who were commanded by a Tory Captain named Jesse Barfield, in which the Tories were defeated -- was in the engagements against the Tories at Black Mingo; Coosawhatchie, & Blue Savannah; his officers in the different tours of service, were Captain Shade Simonds, Captain James, Captain John Rogers, Captain Benjamin Munnerlyn, Captain James Giles, Major James of Williamsburg District, Colonels Baxter, Laurens, Horry, & Hill, and in the war served upwards of a year as a private, two years as a Sergeant and three years as Lieutenant of cavalry -- He was sent by General Marion on several military expeditions and on one occasion, met the distinguished Sergeant McDonald, and returned to Georgetown in company with him -- He was in actual service the whole war except for a short time, on two occasions, when he was on furlough and was discharged at Boling Green in 1783 after peace by General Marion, which discharge and Commission as Lieutenant I the said Daniel H. Davis have seen frequently in my Father's possession, and which was destroyed by fire, at the burning of his house & furniture, not long preceding the death of my Father.

The distinguished Sergeant McDonald, was Sergeant Donald McDonald who bayoneted the fleeing Maj. Gainey, following the defeat of the Tories under Major Gainey by the Americans under Col. Peter Horry. This bloody skirmish took place, January, 1781, between the Sampit and the Black River roads. ²

Lt. Joseph B. Davis was born about 1750, a son of Benjamin Davis and Rachel Port. He married Anne Keene abt 1783 and had 11 children. Six of those children are named within the above mentioned pension file. Anne (Keene) Davis died about 1810; Joseph B. Davis died 13 November 1833.

Amanuensis Monday~Last Will and Testament of Zabon Davis

 Amanuensis Monday is a genealogy blogging theme. It was started by John Newmark who writes the TransylvanianDutch blog.

His definition of Amanuensis is:

Amanuensis: A person employed to write what another dictates or to copy what has been written by another.

Today’s subject is the Last Will and Testament of Zabon Davis.¹

Zabon Francis Davis was born January 1773 in Marion County, South Carolina. He was a son of John Davis and Mary White. He married Esther Bullock about 1798. Their first born child, Hosea was born about 1799. At some point before August 1821, Zabon and Esther departed Marion County, SC and moved their family to Copiah County, Mississippi.

Zabon Francis Davis passed away in November 1845 in Copiah County, Mississippi. His wife died sometime after 1850.

This was the most difficult Will that I have ever transcribed. If you find errors, and I am sure there are a few,  please forgive the blunder and let me know about any errors found.

It’s Family Time~The Evan Davis, Jr. & Mary Haughey Family

Evan Davis, Jr., was born about 1722 in Merion Township, Philadelphia,
Pennsylvania, British America. He was a son of Evan David, Sr, and Jane Rees. About 1740, he married Mary Haughey, daughter of William and Sarah Haughey, of Pencader Hundred.

This marriage strongly opposed by his father, Evan David, Sr., caused an estrangement never reconciled.

Nevertheless, the marriage did take place and the couple raised a family of 6 Children; all sons, no known daughters.

On 4 May 1787, Sarah Haughey, mother of Mary (Haughey) David wrote her Last Will shortly before her death. The Will was probated on 10 May 1787, just days after it was executed. ^{2 3} 

Named within the Will is her Son-in Law, Evan David and 3 grandsons, Nathaniel, Joshua and Hugh David. Why the other three were omitted is a mystery.

I give and bequeath two shillings and six pence to my Son in law Evin David I give and bequeath two Shillings and six pence to my Granson Nathaniel David I give and bequeath the sum of twenty Shillings to my Granson Joshua David I give and bequeath the sum of twenty Shillings to my Granson Hugh David.

Mary (Haughey) David, his wife,  passed away about 1780, her estate administered in 1780. (Adms., Lib. N1, fol. 356.) Evan was living in 1787 and died sometime before 1796-7. (Davis Book page 31)

I’m sure that with some search time in the Pencader Hundred, Delaware Probate Records their death dates can be found or narrowed to a shorter time period.

No Last Will has been found for Evan David, Jr. or his wife, Mary Haughey. No Obit, death notice or tombstones have been found for this couple.

Known children of Evan David and Mary Haughey are:

 i. Nathaniel Elisha David, born 1743; married Ann Evans, 1779; died bef 12 Jan 1832, New Castle County, Delaware, United States.

 ii. Joshua David, born 1744–45; married Sidney Ellis, 1 Feb 1798; died 31 Oct 1819, Newcastle County, Delaware, United States.

 iii. David David, born 1747; married Mary, 1770; died 14 Aug 1780.

iv. James David was born about 1750. He died without issue about 1831 at the age of 81.

v. Hugh Eleazer David, born 1758, New Castle County, Delaware, British America; married Isabella Keith, 1 Feb 1779; married Mary Johnson; died 1 Sep 1818, New Castle County, Delaware.

vi. Evan David III was born in 1758–9.

Evan David, Jr. is my 5th Great GrandUncle.

In the name of God, Amen. Amanuensis Monday~Last Will and Testament of Julia Franklin (Avant) Davis, wife of Benjamin Saunders Davis

Today’s subject is the Last Will and Testament of Julia Franklin (Avant) Davis, wife of Benjamin Saunders Davis.¹

Julie Franklin Avant was born 30 January 1803, a daughter of Joshua Avant and Catherine Baker. On 15 March 1826 she and Benjamin Saunders Davis were married in Marion County, South Carolina. Benjamin Saunders Davis was born 17 August 1798, a son of Lt. Joseph B. Davis and Anne Keene. Benjamin was also the grandson of Benjamin Davis and Rachel Port.

After the birth of six children; three sons and three daughters, Benjamin Saunders Davis passed away at the age of  44 on 13 Aug 1843. Benjamin Saunders Davis died intestate, leaving no Will. Julie Franklin (Avant) Davis wrote her Will on 3 June 1873. While five of her six children survived her; she only named the youngest daughter and two surviving sons.  Julia Franklin Davis died 7 March 1878. 

Benjamin Saunders Davis and Julia Franklin Avant had the following children:

iv. Benjamin Franklin Davis, born 2 Jun 1834, Marion County, South Carolina; married Gabriella Mary Jenkins; married Corinna Pace McCormac; died 28 May 1914, Marion County, South Carolina, .

The Tragic Death of Baby Sellers

Johnnie Garison Sellers was born 7 September 1909, the second child and son of James Arnold Sellers and Addie Ovida Davidson. The newspaper notice of his death tells the story of his tragic death.

Child Dies From Burns.
Mr. and Mrs. Arnold Sellers, of near Thompson Creek church, in Chesterfield county, have the sympathy of the whole community in the loss of their little two-year-old child, which occurred In the most distressing manner possible, last Thursday, from the result of burns received the day before. The mother had left the baby in the room while she went out for wood. Before she could return the little one screamed in agony and on rushing back to the house the  mother was horrified to meet her child in the door its clothes all aflame. She quickly extinguished the fire, but the baby was so terribly burned that death resulted next day. ¹

James Arnold Sellers and Addie Ovida Davidson would have 5 additional children after the loss of their 2nd born son. They were 4 daughters and another son.

It’s Family Time~Dr. and Mrs. Fleet William Brock

Dr. Fleet William Brock, son of Alexander and Sarah Elizabeth (Williams) Brock, was born February 28, 1883 at Dillon, Mississippi and spent his boyhood schooldays at Tylertown, Mississippi. His Grandparents, James Brock and Mary Elizabeth Purvis brought the family to Mississippi about 1820. Fleet’s father Alexander Brock was born in Mississippi about the year 1829. 

After graduating from high school, Fleet attended medical college in Tennessee and graduated from Tulane School of Medicine in New Orleans, Louisiana in 1907. 

He was married to Miss Maud Draughon of Lake Charles, Louisiana on 9 October 1906. Dr. Fleet Brock was a physician on the hospital staff at Bogalusa. Fleet and Maude would have five children, of which two died young, before her unexpected death in November 1920. They had only been married a short 14 years before untimely death. 

After the death of his wife Maude, Dr. Fleet W. Brock married Miss Mattie E. Hale, surgical supervisor of the Elizabeth Sullivan Memorial Hospital, September 15, 1922. Sadly, this marriage would only be celebrated for 11 months and 6 days when Dr. Fleet William Brock was killed in an automobile accident. 

Bogalusa, La., Aug. 21---Dr. F. W. Brock, 42 years old, a member of the staff of the Elizabeth Sullivan Memorial hospital here, was killed, and Major J. H. Friend, chief engineer of the Great Southern Lumber Company injured seriously when an automobile in which they were riding from Slidell to Bogalusa overturned at 7:30 o'clock this evening at a curve in the road two miles from Talisheek. An ambulance from the local hospital brought the accident victims to Bogalusa, twenty miles from the scene of the smash. 

    Dr. Brock and Major Friend had been to New Orleans and returned by train to Slidell late today, then got in the automobile to complete their journey. The car turned over three times in rounding a curve. Dr. Brock's skull was crushed and Major Friend's shoulder and three of his ribs were broken. 

    Dr. Brock is survived by a wife and three children, also three brothers, Jap Brock, state bank examiner; Col. (J. Vol) Brock, district attorney, and Dr. J. L. Brock, coroner of Washington parish. He was a native of Franklinton and has been residing in Bogalusa for many years. Major Friend has been connected with the Great Southern Lumber Company, for a long period, but was absent during the war serving overseas..

iii. Female Child Brock was born in Nov 1911 in Louisiana. She died on 10 Nov 1913 at the age of 2 in New Orleans, Louisiana. She was buried on 11 Nov 1913 at Brock Cemetery in Washington Parish, Louisiana.

iv. Robert Draughon Brock was born on 6 Jan 1912 in Washington Parish, Louisiana. He died on 15 Nov 1916 at the age of 4 in Washington Parish, Louisiana.

v. Freddie Marguerite Brock, born 1 Sep 1914, Washington Parish, Louisiana; married Nelson Wood, 13 Aug 1932, Walthall County, Mississippi; died 26 Dec 2003, Tylertown, Walthall County, Mississippi.

In the name of God Amen. I  Katharine Sides of the county of Stanly and the State of N. Carolina being in comon health and of sound disposing mind and memory but considering the uncertainly of my earthly existence, do make this my last Will & testament in the maner & form following, that is to say,

First that my Execution herein after named shall provide for me a decent burial. Suitable to the wishes of my relations and friends, and pay all my funeral expenses together with all my just debts, if any I shall owe, out of the first money that shall come in to his hands belonging to my Estate.

Item 1st It is my will & desire that the remaining portion of my property be sold at public sale on a reasonable credit by my Executor whom I shall here after appoint & the proceeds of the same together with all debts due me when collected by him & what other funds that may be on hand at my decease be divided among the following named persons, in the maner I now proceed to direct.

First give to my son Henry C. Sides, now in the State of California, twenty-five dollars, provided he comes to claim it within two years after my death, and in the event that he should not come within that time, then the same to revert & be divided in the same manor as the other proceeds of my Estate.

Secondly I give & devise to my daughter Elizabeth Biles & to the heirs of her body, an eighth part of my Estate after deducting the specific devise here in before I mentioned.

Thirdly I give to my daughter Mary Crowell and to the heirs of her body, one eighth part of the same after making the afore said.

Fourthly I give to my daughter Caroline Hearne, and to the heirs of her body, one eighth part aforesaid.

Fifthly I give to my Grand daughter Louisa D. Marshall a (child) of my daughter Sarah Marshall one eighth part as afore said, after paying to George M. Sides, the sum of thirty five dollars, it being the amount that the said George M. Sides paid as security for Henry Marshall. The said eighth part to remain in the hands of a Guardian and the interest and such part of the principal as shall be absolutely necessary for the support of and education of the said Louisa B. Marshall, to be paid annually to her Mother, Sarah Marshall.

Sixthly I give to my son George M. Sides, one eighth part aforesaid.

Seventhly I give and devise to my Grandson Henry Thomas Sides (son of Thomas Alexander Sides) one eighth part of my Estate subject to the aforesaid deductions.

Item 2nd I give and devise to my beloved son George M. Sides my looms and spooling wheel and all the fixtures, and everything that belongs to the loom.

Item 3rd I give & devise to my beloved son Nelson Sides one hundred dollars out of my Estate and then one eighth part of my Estate as named in item 1st besides after making the as named above.

Item 4th It is my desire that my Executor give to each of my daughters namely Elizabeth Biles, Mary Crowell, Caroline Hearne and Sarah Marshall and each of my daughters in law, namely Ithama Sides, and Sophrona Sides, each a canterpane to be selected for them by someone or two of the neighbor women and also that all my wearing apparel be equally divided among my said daughters and daughter-in-laws.

Item 5th I give & devise to Elizabeth Upchurch, Caroline Melton, Leonard E Melcher & Elizabeth Melcher and Mary Melcher, children of my daughter Sophia Melcher dec'd the remaining eighth part of my Estate, subject to the aforesaid deductions, 

Lastly I hereby constitute and appoint my beloved son George M. Sides my Executor to execute this my last will & testament according to the true intent & meaning of the same, hereby revoking & disclaiming utterly void all wills heretofore made by me. In writing whereof I have here to set my hand and seal this 1st day of July AD 1865.

Catherine Miller was born 22 May 1789, Cabarrus County, North Carolina a daughter of George Jacob Miller and Mary Agnes Sauer. She married Leonard Sides in 1803 and died 21Jun 1867, aged 78.
