1858 Land Deed~Asahel Six & Sarah his wife to Samuel Heard

 On 16 May 1858, Phillip Six of Hinds County, Mississippi died leaving a large estate with a son and three daughters as heirs-at-law. The son, Asahel and two daughters, Margaret and Lohoma had married Brock men and women all related and part of my Brock lineage. The 3rd daughter, Agnes was the wife of Samuel Heard, named within this Land Deed.

In a previous Land Deed dated 1 Feb. 1847, Phillip Six had already conveyed to his daughter Lohoma Brock a tract of land containing 200 acres.  [Deed Book 18, page 369].

Asahel Six and  Sarah Brock were married 22 Nov 1838; Margaret Six and Moses A. Brock were married 15 Feb. 1838 and Lohoma Six and Francis M. Brock were married 23 Dec. 1840. This particular land deed does not state how many acres of Land were involved; nor, have I yet found any indication that Moses Brock and his wife, Margaret Six received any portion of her father’s estate.

In the below deed Asahel Six and his wife Sarah (Brock) Six are quit claiming their interest in the Phillip Six estate lands to Samuel Heard for Five Hundred Dollars.  

Transcription: 

This indenture made and entered into between Asel Six and Sarah Six his wife of Bolivar County, State of Mississippi of the first part and Samuel Heard of Hinds County, State aforesaid of the second part. Witnesseth: that the said parties of the first part for and in consideration of the sum of Five Hundred Dollars to them in hand paid by the party of the second part the Receipt whereof is hereby acknowledged have this day granted, bargained, quit claimed, released & conveyed unto Said party of the Second part all the right Title interest to claim of said Asel in and to the land lately belonging to Phillip Six dec’d., the father of the said Asel in the County of Hinds and State of Mississippi. To have and To hold the aforesaid interest in said Estate to the said party of the second part & to his heirs & assigns forever, against the claim or claims of said parties of the first part their heirs & assigns, but against no other claim Whatsoever. In witness whereof the said parties of the first part have hereto set their hands & seal this 7th day of July 1858.

Warren County} Personally appeared before me the undersigned a Justice of the Peace for said County & State Asel Six who acknowledged that he Signed Seal & delivered the foregoing deed on the day and year therein written as his act and deed for the purposes therein named. Given under my hand & Seal this 7th day of July 1858.

Warren County} Personally appeared before the undersigned a Justice of the Peace for said County & State Sarah Six who on a private examination made by and separate and apart from her husband acknowledged that She Signed Sealed & delivered the foregoing deed on the day and year therein written as her act and deed for the purposes therein named freely & willingly without any fear thereto or Compulsion of her said Husband. Given under my hand & Seal this 29th day of July 1858.
